RESOLUTION APPROVING CONTINUED TAX ABATEMENT
WHEREAS, Bestway Trucking, Inc., by Resolution No. 91-R-14,
was granted a ten (10) year tax abatement for improvements to real
property and a five (5) year tax abatement for new computer equip-
ment on February 25, 1991, by the Common Council of the City of
Jeffersonville, Clark County, Indiana;
WHEREAS, Bestway Trucking, Inc. was not assessed for taxes in
the years 1991 and 1992;
WHEREAS, because Bestway Trucking, Inc. was not assessed in
the years 1991 and 1992, Bestway Trucking, Inc. was left with the
mistaken belief that it had no obligation to renew its tax
abatement;
WHEREAS, due to Bestway Trucking, Inc.'s mistaken belief
regarding its tax abatement, it did not file an application for
deduction from the assessed valuation for the 1994 tax year within
thirty (30) days of its first Notice of Assessment to Land and
Improvements from the Township Assessor, which it received on
December 19, 1994; and
WHEREAS, Bestway Trucking, Inc, received a tax bill for 1994
taxes due and payable in 1995 and has caused said taxes to be paid,
even though a portion of those taxes were attributable to improve-
ments for which Bestway Trucking, Inc. received a tax abatement;
and
WHEREAS, There exists no reason for Bestway Trucking, Inc.'s
tax abatement not to continue;
NOW, THEREFORE, BE IT RESOLVED, BY THE COMMON COUNCIL OF THE
CITY OF JEFFERSONVILLE THAT IT SPECIFICALLY FINDS AS FOLLOWS;
1. That the tax abatements granted to Bestway Trucking, Inc.
should continue.

That the tax abatement on Bestway Trucking, Inc.'s new
computer equipment should be treated as if it is in its
third year of the original five year abatement period.
That the tax abatement on improvements to real property
of Bestway Trucking, Inc. should be treated as if it is
in its third year of the original ten year abatement
period.
