A RESOLUTION PROTESTING THE ENACTMENT OF
SENATE BILL NO. 326 AND HOUSE BILL NO. 1412
WHEREAS, Senate Bill No. 326 requires that all of the municipal property taxes
imposed on a residential annexed territory must be impounded in a special fund and
used to provided additional services in the annexes territory for at least five (5) years
after the annexation takes effect; and
WHEREAS, on February 26, 1997 the Indiana Senate passed Senate Bill No.
326 on the third reading; and
WHEREAS, House Bill No. 1412 provides that a municipality which has any
significant financial liability would be unable to annex any additional territory; and
WHEREAS, on February 27, 1997 the Indiana House of Representatives passed
House Bill No. 1412 on the third reading; and
WHEREAS, both'Senate Bill No. 326 and House Bill No. 1412 ("the Anti-
Annexation Bills") would create a serious impediment to the economic development of
the State of Indiana because they create a strong disincentive for municipalities, and
specifically the City of Jeffersonville, to provide infrastructure outside their current
boundaries; and
WHEREAS, the Anti-Annexation Bills would cause the citizens of Indiana
municipalities, and specifically of the City of Jeffersonville, to incur significantly higher
property tax rates; and
WHEREAS, the Anti-Annexation Bills would have an overwhelmingly detrimental
effect on Indiana municipalities and specifically on the City of Jeffersonville;
NOW THEREFORE, BE IT HEREBY RESOLVED that Common Council of the
City of Jeffersonville, Indiana ("the Council") on behalf of all of the approximately
Twenty-Six Thousand (26,000) citizens of the City of Jeffersonville hereby protests the
passage of either Senate Bill No. 326 or House Bill No. 1412; and
NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Council
hereby directs the Clerk-Treasurer to immediately distribute a copy of this Resolution to
each member of the Indiana General Assembly,

and approval.
