AN ORDINANCE GRANTING PETITION TO VACATE
A PORTION OF A CERTAIN RIGHT-OF-WAY
WHEREAS, the Jeffersonville Redevelopment Commission (hereinafter '"[he Commission") has petitioned the
Common Council of the City of Jeffersonville (hereinafter "the Council") to vacate a portion of a certain dedicated right-
of-way in the Riverfront Development Project Area in the City of Jeffersonville, Indiana:
WHEREAS, after publishing notice in accordance with the provisions of I.C. 5-3-1, the Council held a public
hearing on the 15th day of December, 1998 to hear comments and concerns regarding the vacation of said right-of-way,
during which hearing comments and concerns were recorded; and
WIIEREAS, the Council having examined and heard evidence on said petition and being duly advised, now
f'mds that said petition should be granted;
NOW, THEREFORE, IT IS HEREBY ORDAINED that the above-described right-of-way is hereby vacated
and the fee simple title to said right-of-way shall vest in the J~ffersonville Department of Redevelopment.
This ordinance shall be in full force and effect from and after its passage and approval.

PETITION TO VACATE A PORTION OF A CERTAIN RIGHT-OF-WAY
TO THE JEFFERSONVILLE COMMON COUNCIL:
The Jeffersonville Redevelopment Commission (hereinafter the "Petitioner"), hereby Petitions the Common
Council of the City of Jeffersonville, Indiana, (hereinafter "the Council") to vacate a portion of a certain dedicated right-
of-way in the Riverfront Development Project Area in the City of Jeffersonville, County of Clark, State of Indiana. The
area requested to be vacated is the portion of Southern Indiana Avenue (formerly Illinois Avenue) from Riverside Drive
to the Ohio River.
The vacation of the right-of-way described above is requested based upon the following:
1. The fight-of-way is not used by the public for travel;
2. The right-of-way has not been improved for use as a public way;
3. The fight-of-way described is unimproved, and contains no utilities.
There is no property owner other than the Petitioner whose property abuts the area proposed to be vacated.
WItEREFORE, the Petitioner requests that public notice be given pursuant to the provisions of I.C. 5-3-1 and a
public hearing be held and thereafter, that the Council grant this petition to vacate.

Notice is hereby given that Jeffersonville Redevelopment Commission has filed a petition with
the Common Council of the City of Jeffersonville requesting vacation of a portion of Southern Indiana
Avenue (formerly Illinois Avenue) from Riverside Drive to the Ohio River within the City of
Jeffersonville, County of Clark and State of Indiana.
A public hearing will be held on December 15, 1998 at 7:00 p.m. in the Multi-Purpose Meeting
Room on the Third Floor o£the City-County Building, 501 East Court Avenue, Jeffersonville, Indiana.
