AN ORDINANCE AMENDING CERTAIN PORTIONS OF
ORDINANCE NO. 97-OR-20
ESTABLISHING STAFF APPROVAL FOR
CERTIFICATES OF APPROPRIATENESS
WHEREAS, Ordinance No. 97-OR- 20, "Historic Preservation and Protection
Districts" requires the owner of property in an Historic District or a Conservation District
to obtain a Certificate of Appropriateness ("COA") f~om the Jeffersonville Historic
Preservation Commission (the "Commission") before the City will issue a permit or work
is begun to alter the property; and
WHEREAS, the Commission has adopted guidelines for issuance of COAs in
routine situations; and
WHEREAS, it is in the best interest of the citizens of Jeffersonville to streamline
the administrative process required before improvements are made in the City's Historic
and Conservation Districts, thus encouraging property owners to improve their
properties;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF JEFFERSONVlLLE that the following shall be added as a subsection to
§152.08.020 (c) of Ordinance No. 97-OR-20:
(1) Staff approvals. The Commission may authorize the staff of the
Commission, on behalf of the Commission, to grant or deny an application
for a Certificate of Appropriateness. The Commission shall specify by rule
the types of applications for Certificates of Appropriateness that the staff
of the Commission is authorized to grant or deny. The staff may not be
authorized to grant or deny an application for a Certificate of
Appropriateness for the following: i) The demolition of a building,
structure, or site; ii) The moving of a building or structure; iii) The
construction of an addition to a building or structure; or iv) The
construction of a new building or structure.
This Ordinance shall become effective immediately upon its passage and
adoption.
