Dear Ms. Ellis:
i want to thank you for taking time recently to talk with me and discuss the
Personnel Department of the City of Jeffersonville. One of the main objectives of
the Risk Control Department is to assist member entities in recognizing and
reducing any existing and/or potential liability exposures, which may be present
in their daily operations.
Based upon discussions and observations made on this visit, I did not find
conditions that would appear to be of immediate concern to the Risk Control
Department. will be making the following recommendations.
· It was indicated that there w~sa probationary period for at-will employees
of the County. Please be advised that statements made in the employee
handbook creating a probationary period for at-will employees may imply
that at completion of [he probationary period, an employee may only be
discharged for just cause. If a probationary period is still desired, it is a
good idea to inform employees that the successful completion of the
probationary period will not change the at-will employment relationship
between the employee and the employer. They also need to be advised
that during and after the probationary period, employment is not for any
definite term and the employer or employee can terminate it at any time
with or without cause.
The County should review the Motor Vehicle Records of all employees
who will be permitted to drive County vehicles prior to hiring and on an
annual basis thereafter. It is always important to obtain a release
statement that allows the prospective and current employees to be
informed and authorize the investigations of any driving records. Using
wording in the Employment Application above the signature line can
achieve this. (Please see the enclosed sample wording.)

within the next 30 days, indicating the status or intent to implement the above
recommendations. Please also indicate a time frame for this implementation.
As you have questions regarding these recommendations, other areas of liability
exposure, or if we can be of service in other ways, please call the Risk Control
Department. I plan to return at a later date, to assess remaining properties and
operations. I look forward to a cordial and productive working relationship with
the City of Jeffersonville.
