HomeMy WebLinkAbout01-31-2007 4 MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA JANUARY 31, 2007 Mayor Waiz called the meeting to order at 9:30 a.m. and on call of the roll those members present were: Engineer Miller and Council person Perkins. Also present were: Fire Chief Miles, Vehicle Maintenance Director Drury, Building Commissioner Segraves, City Attorney Merkley, Street Commissioner Ellis, Sewer Office Manager Johnson, Councilperson Wilson, Planning and Zoning Director Hicks, Personnel Director Calabro, IT Director Hardy, Assistant Police Chief Lovan, and Deputy Clerk Mayfield. Engineer Miller made the motion to approve the payroll, seconded by Councilperson Perkins n\ and carried unanimously. . Engineer Miller made the motion to approve the minutes of 1-5-07, 1-10-07, 1-17-07, and 1- 24-07, seconded by Councilperson Perkins and carried unanimously. Engineer Miller made the motion to approve the claims, seconded by Councilperson Perkins and carried unanimously. NEIGHBOR HOOD CONCERN- Linda Williams, owner of Old Bridge Inn spoke to the Board about her concerns with the soup kitchen in the old Jaycee Building in the Rose Hill neighborhood. She said she is fearful of being robbed by some ofthe clientele that frequent the soup kitchen. She would like help from the City in moving the soup kitchen to another location. Mayor Waiz said this would be looked into. (1\ ..- . . THUNDER BLANKET WALKING PERMIT- Josh Kelley came before the Board to request a blanket permit to sell novelties exclusively on the day of Thunder. He proposes to pay $3,000.00 for the permit and would like a three year contract. He would have approximately twenty people working with him. After some discussion Mayor Waiz and Assistant Police Chief Lovan suggested meeting with Mr. Kelley to discuss the possibility of this or working out some type of agreement if a blanket permit cannot be given. Councilperson Perkins made the motion to table this request until further discussion, seconded by Engineer Miller and carried unanimously. PROMOTIONS Fire Chief Miles asked the Board to approve promotions as follows: Maj. Phil Lovan to Head Fire Marshall of the Fire Prevention Bureau Lt. Mike McCutcheon to Captain, Deputy Fire Marshall in Fire Prevention Capt. Steve Case to Battalion Chief Capt. Kevin Lindsey to Battalion Chief Lt. Joe Lee to Captain Maj. Dennis Dierking to leave Fire Prevention Bureau to become Crew Captain Sgt. Pam Bottorff to Lieutenant Sgt. R. Van Gilder to Lieutenant Pvt. Jason Sharp to Sergeant Pvt. Josh Kempf to Sergeant Councilperson Perkins made the motion to approve the promotions, seconded by Engineer Miller and carried unanimously. RESOLUTION CONVEYING REAL ESTATE TO DEPT. OF REDEVELOPMENT- City Attorney Merkley asked the Board to approve Resolution #7 conveying a parcel of real estate by deed to the Jeffersonville Department of Redevelopment. Councilperson Perkins made the motion to approve Resolution #7, seconded by Engineer Miller and carried unanimously. . , ....,. . . CHANGE ORDER #21 FOR CITY HALL- Engineer Miller made the motion to approve Change Order #21 for aluminum clad windows, seconded by Councilperson Perkins and carried unanimously. The change order will deduct $10,000.00 from the contract. There being no further discussion to come before the Board, Mayor Waiz made the motion to adjourn the meeting at 10:30 a.m., seconded by Councilperson Perkins and carried unanimously. ENTERING A NEW ERA OF COMMUNITY GROWTH AND UNITY 'I .. Dear committee This is a proposal for a contract to sell light up toys and children's festival toys at Thunder. We have made these proposals with other festivals and it has worked out very nicely. We would like to pay $3000.00 a year as the exclusive light up toys and children's festival toy vendor during the festival. The payment will come in two payments half when the contract is accepted and half on April 1 before the date of the show. We would like this to be a three-year contract. This contract will be valid come rain or shine. This works well for the festivals for many reasons: All of our workers selling the Light Up Toys and children's festival toys are clean-cut students from our own local high schools and collages. The Quality and prices of the toys are good for the public. Since we import and wholesale all of the toys we can give the public very nice toys at a very convenient price so no price gouging. Customer satisfaction is always #1. Ifthere is a problem we always make the customer happy. We are experienced at crowd control. We have a lot of experience working large festivals. We have paid for mobile vendor festival license for Thunder $75 a cart for many years. Some of the local festivals that we participate in are Harvest Homecoming, Adam Mathews Balloon Festival, Independence Forth of July Festival at the Waterfront in Louisville and New Albany, Kentucky State Fair, and Jeffersontown Gaslight Festival. You as the festival organizer will not have any problems. The festival will allow us to have mobile cart vendors. Security: Security is not a problem as we give good customer service and our toys are usually pretty low cost items so theft is not a high priority. What is a priority is that no other light up or children's festival toy vendors are allowed in the festival area during the day and especially at night. This is easily done with the help of a point of contact with one security or police officer. Don't worry this is not a security nightmare. We don't worry about some guy who walks up with a duffle bag with a few toys in it. What we worry about is a clever vendor who walks in 30 minutes before it gets dark with 10 carts and sets up and sells thousands with out paying. Vendors with these items will be asked to leave and will not receive a refund: a) Fireworks, including but not limited to "Snappers", Cracker balls', "Poppers", or any other device that explodes on impact. No Smoke Bombs, Sparklers or any type of device that has to be ignited. Any device e:enerally considered to be a "Fireworks" is not allowed. b) Aerosol or compressed air products, including but not limited to "Spray String", "Silly String", Hair Colorant, Hair Sprays, Paint or any item considered to be such. c) Any item or device that produces a waste product d) Any item considered to be a weapon, such as knives, guns, swords, throwing stars, mace or self defense sprays are not allowed. 2) All Vendors must clean up the area around their cart space before they leave at the end of the day. The space must be left, as it was found, CLEAN. 3) The Festival Committee reserves the right to remove any vendor from the festival ifit feels the Vendor is in violation of the rulesor spirit ofthe Festival 4) All Vendors must keep the area around their space clean and free of trash. 5) Refunds will NOT be e:iven for bad weather. 6) No other Novelty Vendor will by allowed to sell this will be easily done with the help of a point of contact with one security or police officer. The other $1,500 will be paid on April 1. 3) This contract will be a three year contract and will be valid come rain or shine. 4) LightUpToys.com will follow all of the Rules and Regulations. 5) LightUpToys.com will have mobile Novelty vendors. 6) A Law enforcement officer will be at a point of contact with the company owner making sure that all of the Rules and Regulations are being followed. 7) LightUpToys.com has Liability insurance for3 million dollars. 8) LightUpToys.com promises to service the event very professionally.d9) Please look over this proposal and we can modify it to make it better for both parties. ..
