HomeMy WebLinkAbout06-30-2003MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA JUNE 30, 2003 Mayor Galligan called the meeting to order at 9:40 a.m. and on call of the roll those members present were: City Engineer Miller and Councilperson Frantz. Also present were: Planning and Zoning Director Padgett, Animal Shelter Director Wilder, Redevelopment Director Robinson, Administrator Rich Davis, Fire Chief Smith, Police ChiefPavey, Building Commissioner Gavin, Street Commissioner Grant, Personnel Director Ellis, Wastewater Treatment Director Crawford, Vehicle Maintenance Director Dmry, and Chief Deputy Clerk !Bass. Engineer Miller made the motion to approve the payroll as presented, seconded by Councilperson Frantz and carried unanimously. Mayor Galligan asked Department Heads if there was anyone on the payroll that either he or Personnel Director Ellis did. not know about. WILLOW TRACE AGREEMENT Mayor Galligan presented the Board with an agreement between the City, Zion Properties, and Willow Trace Limited Partnership (attached). After discussion, the motion was made by Conncilperson Frantz to approve the agreement, seconded by Engineer Miller and carried unanimously. REQUEST FOR HANDICAP PARKING PERMIT Michael Coley, 701 E Court Ave, requested a handicap-parking permit per Mayor Galligan. Mayor Galligan told the Board that if he issued a handicap permit, those visiting the field house would park there. Therefore, Engineer Miller made the motion to approve a resident only permit and waive the fee, seconded by Councilperson Frantz and carried unanimously. COURT AVE EXTENSION CHANGE ORDER John Toombs, Jacobi, Tombs, & Lanz, appeared before the Board to request approval of a Change Order for the Court Ave extension project (attached). Engineer Miller made the motion to approve the order seconded by Mayor Galligan and passed on a vote of 2-1, with Councilperson Frantz voting no. CHANGE OF SPEED LIMIT Engineer Miller informed the Board that he received a request from the Board of Commissioners to change the speed limit on Utica Pike from 35 mph to 40 mph. After discussion, the motion was made by Engineer Miller to change the speed limit, seconded by Councilperson Frantz and approved unanimously. Mayor Galligan said that there is sign in front of Kobe's that is not a City sign. He asked Commissioner Grant to have this sign removed. There being no further discussion to come before the Board the motion was made by Councilperson Frantz to adjottm at 10:00 a.m., seconded by Engineer Miller and carried unanimously. ATTEST: f..., AGREEMENT This Agreement is entered into on the day of June, 2003 by and between the City of Jeffersonville, Indiana (the "City") and Zion Properties, LLC,an ~ndiana limited liability company ("Zion"); and Willow Trace Limited Partnership, an Indiana limited partnership ("Willow Trace"). ] RECITALS: Whereas, the City wishes to alleviate chronic drainage and traffic problems existing in the vicinity of Spring Street between Peaceley Street and Dutch Lane; and Whereas, Willow Trace Limited Partnership ("Willow Trace"), proposes to develop a senior residential community between Peaceley Street and Dutch Lane, and has received approval of its developm~.~nt plan, construction plan and subdivision plats from the City Plan Commission· Whereas, Zion has contracted with Willow Trace to construct the development for and on behalf of Willow Trace. Upon such / deposit, the Contractor Contribution shall be complete and, except as expressly set forth below, neither Willow Trace nor Zion will be obligated to expend any further sums for the construction of the Roadway Improvements. The sanitary sewer lines and storm drainage collection lines shall be constructed in accordance with the construction plans previously approved by the City and in accordance with City ordinances governing construction of sanitary sewer and storm drainage. Upon the City's acceptance of the sanitary sewer and storm drainage improvements constructed by Zion, Willow Trace shall be obligated to maintain the sanitary sewer and storm drainage improvements situated within the confines of the real property owned by Will°w Trace for such period of time as is required by the City ordinances governing construction of sanitary sewer and storm drainage. _The City's Duties. A. The City has contracted, and must pay, for all engineering services required for construction of the Roadway Improvements, including preparation of plans and specifications, clarification of plans and specifications during construction, handling unforeseen contingencies during construction, and providing full-time inspections during construction. The City shall also reimburse Zion for all engineering or consulting fees associated with the change in design of the Willow Trace development and construction plans to accommodate the Roadway Improvements, to the extent the plans and specifications relating to the Roadway Improvements differ from those Willow Trace construction and development plans previously approved by the City or the City plan commission. B. The City must, at the City's cost and expense, promptly obtain all permits necessary for construction of the Roadway Improvements. · on the execution of this Agreement, the City must provide Zion with temporary access to its C Up ~ - ' o* ,~ ion of the Developer Improvements to be Spring Street right o~way for purposes of performing th,,~ vort situated within the right of way (which Developer Improvements include sanitary sewer and potable water installation). The City shall prosecute the constmction of the Roadway Improvements with diligence and continuity to completion, and will cause the same to be completed in a good workmanlike manner in accordance with the plans and specifications provided to Zion and in compliance with all applicable goremmental requirements. The City shall cause the Roadway Improvements to be substantially completed on or before October 1, 2003 (the "Roadway Improvements Completion Date"). In the event Zion does not complete the Developer Improvements to 2 be situated within the Spring Street right of way on or before the completion dated described in paragraph 2(C) hereof, the Roadway Improvements Completion Date shall be extended by the number of days by which Zion exceeds the Zion Improvements Completion Date. E. The City must own the Koadway Improvements, and must operate and maintain the Roadway Improvements. ] F. The City shall bear all construction costs of the Roadway Improvements except to the extent Willow Trace or Zion is required to do so under the terms of this Agreement. In the event the City or the City's contractor(s) do not proceed continuously with construction of the Roadway Improvements or construction thereof is otherwise discontinued for a period of thirty (30) days, for any reason except for causes beyond the reasonable control of the City, Zion shall be entitled to a return of any unexpended portion of the Contribution. If for any reason, the City or the City's contractors do not proceed continuously with the construction of the Roadway Improvements for a period of sixty (60) days, Zion shall be entitled to a return of any unexpended portion of the Contribution. In either of such events, (i) neither Willow Trace nor Zion shall have any further obligations under this Agreement, and (ii) Willow Trace shall be entitled to all improvements within the City right-of-way which are necessary to complete Willow Trace's project in accordance with the plans and specifications approved by the City at the time of approval of Willow Trace's development plan and plat. Miscellaneous. A. This Agreement shall be governed by the laws of the State of Indiana. B. The parties hereto represent that: 1) the parties hereto are authorized to enter into this Agreement and the City is not required to obtain the approval of this Agreement by the City of Jeff~sonville City Council, 2) that the execution of this Agreement is not prohibited by the organizational documents or Indiana statutes governing any party to this agreement that is not an individual and, upon such execution, shall be a valid and binding contract between the parties hereto enforceable according to the terms hereof, and 5) the execution of this Agreement does not conflict or violate the terms of any agreement to which either party hereto is subject. C. Nothing herein contained shall be deemed or construed by the parties hereto, nor by any third party, as creating the relationship of principal and agent, or of partnership, or of joint venture, between the parties hereto. D. In the event of a default by any party to this Agreement, the other party hereto shall be entitled to recover all attorneys' fees, costs and expenses reasonably incurred to enforce the provisions of this Agreement. E. Item 0107, Maintain Street Lighting, added to the contract so the four lights located on US31 and the I65 Ramp can remain on while the three south lights can be relocated.
