HomeMy WebLinkAbout09-15-2003MINUTES OF THE BOARD oF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA SEPTEMBER 15, 2003 In Mayor Galligan's absence, Parks Director Elliott called the meeting to order at 9:45 a.m. and on call of the rot those ~nembers present Were: Police Chief Pavey sat in for City Engineer Miller and Fire Chief Smith sat in for Councilperson Frantz. Also present were: Building Commissioner Gavin, Street Commissioner Grant, Animal Shelter Director Wilder, Wastewater Treatment Director Crawford, Vehicle Maintenance Director Drury, Redevelopment Director Robinson, Coordinator Rich Davis, Planning and Zoning Director Padgett, and Clerk Lynne Mayfield. Police Chief Pavey made the motion to approve the payroll as presented, seconded by Fire Chief Smith and carried unanimously. Police Chief Pavey made the motion to approve the minutes of 9-8-03 as presented, seconded by Fire Chief Smith and carried unanimously. UNITED WAY A United Way representative passed out information and pledge cards to the department heads. The cards need to be turned back in to Personnel Director Ellis or Redevelopment Director Robinson by Friday, September 19, 2003. 1101 LOCUST STREET Building Commissioner Gavin told the Board that the owner of the property at 1101 Locust Street has been notified properly and photos sent in regard to the unsafe building. Building Commissioner Gavin recommends removing the unsafe building and billing the owner. A lien will be placed on the property if payment is not made to the City. Fire Chief Smith made the motion to approve Building Commissioner Gavin's recommendation, seconded by Police Chief Pavey and carried unanimously. FREE CONCERT ON RIVERFRONT On Saturday, September 27, 2003 from 6:00 to 9:00 pm. Matt and Pauly Zarb (an Australian band) will perform on Jeffersonville's Riverfront on the Terrace Lawn. The street closures are from Riverside Drive from Pearl Street to Wall Street and south of the floodWall at Spring Street in the 100 block. Some police officers and firemen will be needed there. Fire Chief Smith made the motion to approve the street closures, police security and firemen, seconded by Police Chief Pavey and carried unanimously. STREET CLOSURES. Parks Director Elliott said that Spring Street would be closed on October 1, 2003 through October 14, 2003 from Young's Comer to Eastern Boulevard. (Quarry will be notified.) Also Woodland Court at the fioodwall will be closed in the next week or two to cut down the hill for safety reasons. Police Chief Pavey made the motion to approve the road clOsures, seconded by Fire Chief Smith and carried unanimously. NE! ~LIE KNOWLAND Mrs. Knowland said there are kids who live iff the 105-123 Magnolia Avenue apartments who are littering and removing rocks from driveways. Fire Chief Smith made the motion to pass this information on to the City Attorney, seconded by Police Chief Pavey and carried unanimously. There being no further business to come before the Board the motion was made by Fire Chief Smith to adjourn at 10:00 a.m. seconded by Police Chief Pavey and carried unanimously. Hornung 3209 Hearthstone Road Ellicott, Maryland 21043 SUBJECT PROPERTY: ~RE: 1101 Locust Street Jeffersonville, Indiana 47130 REMOVAL OF UNSAFE BUILDING ON SUBJECT PROPERTY Dear Mr. Hornung: Pursuant to Chapter 36-7-9 of the Indiana Code and Jeffersonville City Ordinance No. 84-OR-18, the following information is hereby provided: 1. As Building Commissioner of the City of Jeffersonville, I am the "Enforcement Authority" referred to in the Indiana Code Section 36-7-9-2 for the City of Jeffersonville, and that pursuant to Jeffersonville City Ordinance No. 84-OR-18, my department is designated as the "Department" referred to in Indiana Code Section 36-7-9-2 to enforce the provision of Indiana Code Chapter 36-7-9 and Ordinance No. 84-OR-18. 2. The Jeffersonville Board of Public Works and Safety has been designated by Thomas Galligan as the Hearing Author ty referred to in Indiana Code Section 36-7-9-2. 3. You have been designated as the Administrator of the Estate over the real estate located at 1101 Locust Street, Jeffersonville, Indiana 47130 and more specifically described as follows: An equal oppormnlt7 Key #19-45-08 The building on the property described in paragraph three (3) above is hereby declared to be an unsafe building for the following reasons: A. It is in an impaired structural condition that makes it unsafe to a person or property. B. It is a fire hazard. C. . It is a hazard to public health. D. It is a public nuisance. E. It is dangerous to a person or property because of a violation of a · Status or Ordinance concerning building condition or maintenance. ' HEREBY ORDERED TO REMOVE THiS UNSAFE BUILDING. YOU ARE ' YOU HAVE TEN (10) DAYS FROM THE DATE YOU RECEIVE THIS LETTER TO REMOVE THIS BUILDING. A Hearing will be held by the jeffersonville Board of PublicWorks and ~be~f i5, 2003;? at Safety (the designated "Hearing Authority") on S~L~,,, 9:30 a.m. in the Mayor's Conference Chamber, Room 404, City-County Building, jeffersonville, Indiana to review this order to determine your compliance herewith. Should you fail to comply with this order, you have the following personal rights; A. To appear at the Hearing on September 15, 2003 at 9:30 a.m. B. To present evidence . C. To call witnesses and have witnesses subpoenaed within Clark County. D, To cross-examine opposing witnesses. E. To present any arguments you wish to present. The City Attorney will represent the Enforcement Authority at this ·Hearing. 10. If you do not comply with this Order to remove the unsafe building designated above, the Enforcement Authority may order the building removed at the September 15, 2003 Hearing and will place a lien upon your property for the cost of this removal. 11. Pursuant to the requirement of Indiana Code section 36-7-9-5 (8) the following information is provided: Section 36-7-9-27 (a) A person who has been issued and has received notice of an order relative to unsafe premises and has not complied with that order: (1) must supply full information regarding the order to a person who takes or agrees to take a substantial property interest in -'-~ the unsafe premises before transferdng or agreeing to transfer that interest; and (2) must, within five (5) days after transferring Or agreeing to transfer a substantial property interest in the unsafe premises, supply the Enforcement Authority with written copies of; (a) The full name, address and telephone number Of the person taking a substantial property Interest in the unsafe premises; and (b) (c) The legal instrument under which the transfer or agreement to transfer the substantial property interest is accomplished. If a judgement is obtained against the department, Enforcement Authority, or other governmental entity for the failure of the entity to provide notice to persons holding an interest in the unsafe premises in an action taken by entity under this chapter, a person who failed to comply with this section is liable to the entity for the amount of the judgement if it can be shown that the entity's failure to give notice was a result of that person's failure. ¸12. 13. 14. 15.. Extensions of the time limit set forth in this order will not be granted unless extreme circumstances are set forth pdor to the hearing date.
