Vehicle Maintenance Director Drury, Safety Director Rodden, Planning and Zoning Director Padgett, Building Commissioner Gavin, Wastewater Treatmen~ Director Crawford, Animal Shelter Director Wilder, Parks Director Elllott, Police ~hiefMike Pavey, Paralegal King, Street Commissioner Grant, Redevelopment DirectorRobinson, Fire Chief Mike Smith. and Clerk Lynne Mayfield. · City Engineer Miller made th~ motion to approve the payroll as presented, seconded by Councilperson Frantz and carried unanimously. Mayor Galligan asked i~anyone is on the payroll that he or Personnel Director don't know about. City Engineer Miller made the motion to approve the minutes of 1-6-03 and 1-13-03. seconded by Councilperson Frantz and carded unanimously. BITUMINOUS BIDS Engineer Miller made the motion to award the bid for sto, ne to Liter's Quar .fy Inc., the asphalt bid to Sellersburg Stone, and the gasoline bid to Makowsky Oil, seconded by Councilperson Frantz and carried unanimously. CONFIRMING CONDEMNATION RESOLUTION 2003-R-1,2,AND 3/SEWER EASEMENT Parallegal Sharon King said this Confirming Condemning Resolution is for the Sewer Easement properties belonging to Hollis, Chapman, and Ward.. Mike Gillenwater, the attorney representing the owners of the tracts that are being gondenmed appeared .t,,.o file a remonstrance and ask that the City refrain from conderrming the pr°Pei-ties based 9g several i~eas°ns' The first being that the advertised statute under which the City is proceeding has been repealed. In addition, Mr. Crillenwater said the properties are located in the City of Charlestown, Indiana because of the annexation that occurred on November 11, 2002 and the City of Jeffersonville- Board of Public Works has no authority to condemn property in another municipality without an inter-local agreement with that municipality. There is no inter-local agreement said Attorney Gillenwater. AttorneY Gillenwater said there is no public purpose for this condemnation and that it is exclusively for the benefit of one parcel of property and that there may be a conflict of interest. Mayor Galligan ~sked him what interest he thinks he has. Att. Gillenwater said that the estate under the Trust of Mr. Kempf, lists the Mayor's wife as a beneficiary and also serves as Trustee. Gillenwater said "You as her husband have an equitable interest in any property that she has an interest in. This condemnation for purposes of running a sewer line for the sole purpose of increasing the value of this property where there is no approved subdivision or development on that property. Mayor Galligan said he believes there is. Attorney Gillenwater said Judge Donahue issued an order on October 22, 2002 indicating that anY approvals that weregiven by the County after June of 2000 were illegal and would have to~be,3econsidei'ed. There hgs been no approval of a subdivision on that property. There also isn't any pending approval of a subdivision on that property.. Mayor Galligan asked if it has been recorded as being the City of Charlestown and Mr. Crillenwater said "Yes, it is." He said it has been recorded with the Recorder's Office, the Auditor, and the Clerk of the Circuit Court as well as sent .to the Indiana Secretary of gtate. Councilperson Frantz said this is the first time he's heard about this and would like to get more information. Engineer Miller made the motion to take this under advisement, seconded by C6Uncilp~rson FrantZ md c~bd unanimously. HEALTH INSLrRANCE~ Edward Culpepper Cooper said Humana is very interested in giving the City an attachment point for twelve months. Mayor Galligan had asked if it would be possible to get a rate to begin April 1, 2003. Mr. Cooper said Humana agreed to that. Mr. Cooper asked the Board to grant him permission to pursue Humana's offer. Engineer Miller made the motion to approve proceeding to lock in Humana by March 10, 2003, seconded by Councilperson Frantz and carried unanimously. Mr. Cooper said Marsha Mi!l?r S ,rnith will be involved in the policy procedure manuals for the City. There being no further business to come before the Board of Public Works and Safety, City Engineer Miller made the motion to adjourn at 10:00 a.m. seconded by Councilperson Frantz and carried unanimously. Formal letter to follow via mail, This fee includes ail expenses associated with the upcoming Electronic Data Interchange (EDI) regulations as set forth by HIPAA. As you recall the compliance date for ED/is October 2003 SCM anticipates being compliant by June/July 2003. Should the City elect to change TPA's our quote for paying run-off claims is as fol~ows: $3125 - month 1 $2500 - month 2 $2000 - month 3 $1600 - month 4 $1280 - month 5 $1025 - month 6 I have not received the renewal information from ICM but I will predict they will go from the current $2.26 to $2.32, As soon as I receive this t will forward to you as I always do.
