Parker Jr., Administrative Assistant Donna Baird called the meeting to order at 9:30 A.M., and on call of the roll those members present were Personnel and Safety Director Harold Lakeman, and Sewage Collection Office Director Jim Matra, Also present were: Building Commissioner Bill Gavin, City Engineer Bob Miller, Street Commissioner George Trembly, City Attorney Mike Gillenwater, Sewage Office Manager Bob Goldman, Maintenance Foreman Mike Ewton, Police Chief Charles Elder, Fire Chief Jerry Dooley, Temporary Animal Shelter Manager Ed Voyles, City Services Coordinator Leslie Kavanaugh, Assistant Parks Superintendent Rick Elliott, Wastewater Treatment Manager Kendall Coleman, Clerk and Treasurer C. Richard Spencer Jr., and Clerk Alice Davis. Director Lakeman made of August 29, 1994 carried unanimously. the motion to approve the minutes of the meeting as presented, seconded by DirectOr Matra and Director Lakeman made the motion to approve the payrolls as presented, seconded by Director Matra and carried unanimously. RESIDENTIAL PARKING 1228 MOSSWOOD CT. Police Chief Charles Elder Mosswood Ct., he is waiting who represents Karen and situation and would like to reported on the residential parking at 1228 for a phone call from Attorney Greg Fifer Dale Wilson for some information on this table this until he talks to Mr. Filer. STOP SIGN MEADOWLARK DRIVE Police Chief Charles Elder reported on the request for a stop sign on Meadowlark Drive. Chief Elder recommends no stop sign, he will have more patrols in that area. RESIDENTIAL PARKING 326 WATT STREET Police Chief Charles Elder reported on the residential parking 326 Watt Street for Mrs. Trini Mayflower. Chief Elder said that Lt. Dave Schmidt talked with Mrs. Mayflower and he recommends a Handicapped Parking for 1 place in front of her home. Director Lakeman made the motion to approve the handicapped parking sign at 386 Watt Street, seconded by Director Matra, and carried unanimously. RESIDENTIAL PARKING 913 GOYNE AVENUF Phyllis Kaelin, 713 Goyne Avenue requested a residential not present at the meeting. RESIDENTIAL PARKING 1110 E. 9TH STREET parking, was Rene Taylor~ 1110 E. 9th Street requested a residential parking sign, was not present at the meeting. PAGE P SEPi~5~?~ f~ -- · 1994 REINBURSEMENT Mr. Jack Tussey, 603 Martha Avenue appeared before the Board requesting a reinbursement of $748.24 loc damage in his basement resulting from a sewage backup on August 16, 1994. Wastewater Treatment Plant Manager Kendall Coleman explained that on August 16, 1994 there was a power failure in the City of Jeff which caused a poweroutage at the Ewing Lane Lift Station and thats when Mr. Tussey had sewage in his basement, Mr. Ronnie James of our staff investigated and determined the cause in Mr. Tussey's home. Kendall said that Mr. Tussey received a copy of our policy on sewage backup. We go by policy and proceedure and we do not give reinbursement for an act of God which is #3 in the Sewage Backup Policy. Kendalls recommendation is that we abide by the policies and procedures and we stick to those~ it was caused by power failures it was out of our control. (see copy) INDIANA CERTIFICATION Administrative Assistant Donna Baird read a letter from Wastewater Treatment Plant Manager Kendall Coleman informing the Board that he was granted a Class IV Certification in the State of Indiana by reciprocity. Kendall's Indiana Certification number is 18885, and expiration date of June 30, 1996. (see copy) AMERICAN HEART WALK Administrative Assistant the American Heart Walk~ Campus. If anyone is information REMINDER Donna Baird reported that she has packets for on October 1~ 1994, 9:00am-18-Noon, at IUSE interested in walking see Donna for more Administrative Assistant Donna Baird wants to remind everyone that Steamboat Days will be this weekend. LETTER OF CREDIT RELEASE, LANDSBURG COVE City Engineer Bob Miller is recommending to the Board for the Bond to be released after inspecting the storm sewers and catchbasin for Landsburg Cove. The Bond is for $84,~60.00. Director Matra made the motion to take the recommendation of City Engineer Bob Miller to give the Letter of Credit of Release to Landsburg Cove for $84~460.00~ seconded by Director Lakemans and carried unanimously. STORM SEWER, MICHIGAN AVENUE AWARDED City Engineer Bob Miller received ~ quotes on the installation of storm sewers, sidewaiks~ sewers to be put out into the 4R" main. The ~ quotes were from Irish Park and Joe Reschar Construction. Bob is awarding the contract to Joe Reschar Construction, the quote is $9,850.00 for item A which is to put the sidewalk in and filling the sewers and Item B is $1,300.00 for each latteral that's put into Michigan Avenue. Director Matra made the motion to take City Engineer Bob Millers recommendation to award the low bid to Joe Reschar Construction for the storm sewers on Michigan Avenue, seconded by Director Lakeman, and carried unanimously. PAGE 3 REMINDER Police Chief Charles Elder wants to remind everyone that Steamboat Days is this weekend, he said everything is in line and he gives Lt. Dave Schmidt the credit for this. Also Chief Elder introduced Ronnie Thompson a student at Jeff High who is in the Job Shadowing Program. He will be in the Police Department for 12 weeks for 1 hour on Tuesdays, Wednesdays and Thursdays. There being no further business to come before the Board of Public Works and Safety~ Director Lakeman made the motion to adjourn at 9:50a.m., seconded by Director Marra, and carried unanimously. The complainant must notify the collection system maintenance personnel that a back-up of sewage has occurred. 2. An investigation of the problem will be conducted immediately by a representative of the City of Jeffersonville. 3. The investigation will determine the cause and severity of damage. The cause must be determined to have occurred from: act of God (rain, power failure), blockage in line (City's or property owner), or equipment failure. 4. A copy of the preliminary distributed to: Property Owner, Public Works & Safety. investigation report must be Facility Manager and BOard of 5. The property owner will be responsible for repair or replacement of any damages. 6. After repair ®f ~ama~e is c®mplete, the property owner may request a meeting with city representatives t® present a claim f®r reimbursement ®f c®st., 7. At the time of the meeting the investi~ati®n rep®rt will be reviewe~ an~ discussed with all parties present. 8. A final decision will be made at this time as to the exact cause of the back-up. The City will not be held responsible for damages that are due to an act of God (heavy rain or power failure). If at this time it is determined that the back-up occurred due to either a blockage in a line owned by the City or equipment failure (lift station malfunction), the City will negotiate a settlement with the complainant. At this time the Board of Public Works & Safety will authorize reimbursement of cost due to damage if deemed necessary. 9. If at any time a property owner presents a claim to the City for damages due to sewage back-up, the City can require the property owner to install backflow prevention equipment at the property owners expense.
