OF THE CITY OF JEFFERSONVILLE, INDIANA
MONDAY AUGUST !5, 1994
Mayor Raymond J. Parker Jr. called the meeting to order at 9:30 A.M.,
and on call of the roll those members present were Mayor Raymond
J.
Parker Jr.~ Personnel and Safety Director Harold Lakeman, and Sewage
Collection Office Director Jim Matra.
Also present were: Building Commissioner Bill Gavin, City Engineer Bob
Miller~ Street Commissioner George Trembly, City Attorney Mike
Gillenwater, Sewage Office Manager Bob Goldman, Maintenance Foreman
Mike Ewton~ Interm Police Chief Charles Elder, Fire Chief Jerry
Dooley~ Temporary Animal Shelter Director Ed Voyles, City Services
Coordinator Leslie Kavanaugh, Parks Superintendent Donnie Poole,
Administrative Assistant Donna Baird, Wastewater Treatment Manager
Kendall Coleman~ Clerk and Treasurer C~ Richard Spencer Jr., and Clerk
Alice Davis.
Director Lakeman made the motion to approve the minutes of the meeting
of August 8, 1994 as presented, seconded by Director Matra and carried
unanimously.
Director Lakeman made the motion to approve the payrolls as presented,
seconded by Director Matra and carried unanimously.
Mayor Parker welcomed Ed Voyles to the Board of Public Works and
Safety Meeting as the Temporary Animal Shelter Director.
CHERRY CREEK CONDO ASSOCIATION
Charles Igert representing Cherry Creek Condo Association reported
that they have been on City Services since the first of the year, and
the City agreed to give trash pick-up servicess a non-commercial
contract. Mr. Igert said that he has delt with Les Kavanaugh and
Barbara Wilson about this problem with the 16-4yd. dumpsters that was
suppose to be delivered to the Condos, instead they delivered 13-8yd
dumpsters as of June 1~ 1994. Mr. Igert said that he has gotten in
touch with Rumpke about the dumpsters and he has not gotten any
results. He read a letter from Rumpke stating that the dumpsters will
arrive on the August 15th 1994. (see copy)
BIDS FOR HAMBURG PIKE/MEADOWS SUBDIVISION SEWERS
The bids for Hamburg Pike/Meadows Subdivision Sanitary Sewers at the
request of Jacobi~ Toombs and Lanz will be taken under advisement for
one more week and be awarded at the Board's meeting on 8- ~, 199~.
VACATE PARTS OF MISSOURI AVE. & 11TH STREET.
Building Commissioner Bill Gavin reported that Clark Memorial Hospital
is requesting that Missouri Avenue and 11th Street be vacated. Mike
Gillenwater said that they need to make a recommendation to the
~ouncil whether it should or should not be vacated. Mike and Bill
have no problems with vacating it. It needs to be put on the Council
Agenda on the G-~9-9~. Director Lakeman made the motion to approve
the Building Commissioners request to put this on the Council Agenda
for the 8-89-94~ seconded by Director Matra, and carried unanimously.

CRIPPLED CHILDRFN }~i~'~
Doris King representing Tri=County Shriners and M J'S is requesting a
roadblock for crippled children on Friday August 19, !994 from
4:00-?:00 PM at Market and Main Streets. Director Lakeman made the
motion to approve the roadblock for crippled children~ seconded by
Director Marra~ and carried unanimously.
ADDITIONAL FUNDS FOR RIVERFRONT
Carroll Gowens~ Executive Director of the Department of Redevelopment
of the City of Jeffersonville is requesting $206~000 from the Sewer
Department toward the Riverside Drive Improvements Project. City
Attorney Mike Giilenwater said that the only stipulation is to use
this money exclusively on the se~ers~ and pay claims instead of a lump
sum. Director Lakeman made the motion to approve the request on claim
basis to grant $~06~000 to the Redevelopment Department, seconded by
Director Marra~ and carried unanimously.(see copy).

SEWAGE BACK-UP POLICY /RESIDENTS AND COMMERCIAL BASEMENTS
Wastewater Treatment Plant Supervisor Kendall Coleman reported that
last month City Attorney Mike Gillenwater and the Board of Public
Works and Safety requested him to make up a proposal on sewage back-up
in residential and commercial basements. Director Matra made the
motion to implement the policy of EMC on Jeff Sewage back-up in homes
and commercial basements, seconded by Director Lakeman, and carried
unanimously.(see copy)

Parks Superintendent Donnie Poole wants to thank everyone who helped
with the Concert at Warder Park on Thureday for Community House and
The Villages.
ANIMAL SHELTER
Mayor Parker asked the new Temporary Animal Shelter Director Ed Voyles
how everything,s going at the Shelter. Ed said that he was happy to
report that last Tuesday there was only one full time employee and
himself~ today there should be himself and 5 additional employees that
have agreed to come back. Mayor Parker asked Ed if we had all the
employees back that worked there. Ed said that all have returned with
the exception of one~ this employee wants to discuss this with a
family member before she comes back. Ed said that they have had many
citizens come and help along with the Humane Society.

THANK YOU
Mr. Charles White wants to thank you for the work done in the Meadows
Subdivision for cleaning out the ditches, he sent a letter to Indiana
Cities Water Corportion about the hydrants. Mr. White said that he
has gotten follow-up from Chief Dooley and Interm Police Chief Elder
that were very professionally.

CITY OF JE~-~JRSONVILLE SEWAGE BACK-UP POLICY
RESIDENTIAL AND COI~4~RCIAL BASEMENTS
1. The complainant must notify the collection system maintenance
personnel that a back-up of sewage has occurred.
2. p~n investigation of the problem will be conducted immediately
by a representative of the City of Jeffersonville.
3. The investigation will determine the cause and severity of
damage. The cause must be determined to have occurred from: act
of God (rain, power failure), blockage in line (City's or property
owner), or equipment failure.
4. A copy of the preliminary investigation report must be
distributed to: Property Owner, Facility Manager and Board of
Public Works & Safety.
5. The property owner will

request a meeting with city representatives to present a claim for
reimbursement of cost.
7. At the time of the meeting the investigation report will be
reviewed and discussed with all parties present~
8. A final decision will be made at this time as to the exact
cause of ~he back-up. The City will not be held responsible for
damages that are due to an act of God (heavy rain or power
failure). If at this time it is determined that the back-up
occurred due to either a blockage in a line owned by the City or
equipment failure (lift station malfunction), the City will
negotiate a settlement with the complainant. At this time the
Board of Public Works & Safety will authorize reimbursement of cost
due to damage if deemed necessary.
9. If at any time a property owner presents a claim to the City
for damages due to sewage back-up, the City can require the
property owner to install backflow prevention equipment at the
property owners expense.
