Parker Jr. called the meeting to order at 9:30 A.M., and on call of the roll thos~ m~mbers present were Mayor Raymond J. Parker Jr., Personnel and Safety Director Harold Lakeman~ and Sewage Collection Office Director Jim Matra. Also present were: Building Commissioner Bill Gavin~ City Engineer Bob Miller~ Street Commissioner George Trembly~ City Attorney Mike Gillenwater, Sewage Office Manager Bob Goldman, Maintenance Foreman Mike Ewton~ Police Chief Rick Eltiott, Fire Chief Jerry Dooley, Animal Shelter Manager Jan Wheatley, City Services Coordinator Leslie Kavanaugh~ Interim Parks Manager Donnie Poole~ Administrative Assistant Donna Baird, Interim Wastewater Treatment Manager Phil Thompson~ Clerk and Treasurer C. Richard Spencer Jr., and Clerk Alice Davis. Director Lakeman made the motion to approve the minutes of the meeting of April 252 1994 as presented, seconded by Director Matra and carried unanimously. HEDGE COMPLAINT ON MAIN STREET Building Commissioner Bill Gavin reported on the hedge complaint on Main Street on Steve Prather~s property. Bill showed pictures that he took of the hedge this morning~ Mr. Prather has trimmed the hedge on the South side of his driveway so he can see to get out, butthe neighbors cannot~see when they come tothe intersection of Main Street and Windsor Drive. Bill called him last week and he said that he would get on the agenda to speak on his behalf, but he did not call to be on the agenda. Bill suggested for the City to trim the hedge and put a lean on his property. City Attorney Mike Gillenwater asked City Engineer Bob Miller to measure to see if the hedge is on the City right of way. Mayor Parker said that if it is not in the right of way they will have to take stronger action. William J. Saucer, resident of Windsor Drive addressed the meeting representing the neighbors. Mr. Saucer said that it started during the last administration, and 'they did not take any action on it. Director Matra made the motion to advise City Engineer Bob Miller to take proper measures to see if the hedge on Main Street at Windsor Drive is in the right of way, seconded by Director Lakeman, and~carried unanimously. RESIDENT PARKING AT WALL AND CHESTNUT STREETS Police Chief Rick Eltiott reported on the resident parking at Wall and Chestnut Street for Mike Drury. Chief Elliott recommends to give him ~ parking spots in front of his house and 1 on the side street to accommodate his apartments. Chief Elliott will get in touch with Mr. Dcury. PAGE 2 MAY 2, 1994 COMPLAINt Building Commissioner Bill Gavin reported that Mr. Hackett, 418 Myrtle Street was cited one year ago for having old washers in his yard. As long as he made an effort to clean it up he would not be taken to court. Bill said that he has had more complaints, he is bringing more washers in his front yard. Mayor Parker asked Mike Gillenwater to reinforce this. Mike said that he has given him warnings to comply with~ but he is apparently not going to, it is Mike's recommendation to cite him into court. Mayor Parker said that we will send him some correspondence. RESIDENT PARKING, 1845 WALROLE DRIVF Madalyen Bradley~ 1845 Walpole Drive is requesting a resident parking sign. Mayor Parker asked Police Chief Rick Elliott to investigate this and bring his recommendations back to the Board next week. RESIDENT PARKING, 601 E. CHESTNUT STREFT Larry Byrne, 601 E. Chestnut Street is requesting a resident parking sign. Mmyor Parker asked Police Chief Rick Elliott to investigate this and bring his recommendations back to the Board next week. VENDOR'S PERMIT Ken Coomer of Ann's on the River is requesting a vendor's permit to sell hot dogs at the overlook and at the Court House during lunch time, or other times. Mayor Parker said that he would have to go to the City Clerk Treasurers Office and get an application, then go to the Police Department for an investigation. COMPLAINT ON CENTER STREET Louise Dallman~ 1E Center Street is here about a complaint that she brought to the Board on March E8, 1994. Ms. Dallman read a portion of her abstract and title to the Board because of some concern about the residents on the street as to what portion of the street is theirs. Ms. Dallman asked for rock and was turned down. City Attorney Mike Gillenwater said that the part that is dedicated to the City is correctly owned by the City and the City has the right to use it as a public right of way~ there is no requirement that the City has to maintain it in a way that the residents adjacent to it feel it is neceseary. As for as the water problem~ if it needs to have a ditch put in~ then the City could do it, or the residents could do it~ but if there is a problem developed because of the way the residents are using it, then it could be up to the resident to change the way they are using it, if there was an existing ditch there and it was filled in, the residents should dig it out. Ms Dallman said that the street has been built up so much from blacktop that the water drains into their yards. Mike said that there is a provision that allows the City to do the work and then bill the residents along Center Street. Mayor Parker said that he will discuss this with City Engineer Bob Miller and they will work with her. SEWER TAP IN Ron Endres is requesting a meeting~ this was tabled. RAGE 3 MAY 2, 1994 sewer tap in, he was not present at the FIREWORKS PERMIT Marsha Gilley~ representing Freedom Fireworks is requesting a permit to sell fireworks at 4 locations, 3 are at Dairy Marts~ and the other one is at 300 E. loth Street. Fire Chief Jerry Dooley said that she needs to contact the State Fire Marshell~s Office in Indianapolis to get the fireworks permit. Bill Gavin said that she needs a tent permit and must be approved by the Board of Public Works and Safety, its good for only 30 days, it has to be renewed and approved each time. Ms. Gilley said that she needs it for only 2 weeks. Mayor Parker said that she needs to go to the Police Department to register with them. City Attorney Mike Gillenwater said that she should apply for this permit around June 1~ 1994. Chief Elliott can submit it for her to the Board and then get in touch with her. JEFF MAIN STREET Tom Galligan, representing Jeff Main Street is requesting to block off the intersection of Chestnut and Spring Streets starting May 13, 1994 for about 30'days to put in a brick pattern circle and brick pattern around the edge of the sidewalk and make a concrete intersection~ redo the sidewalks down each side approximately 75~ put new curbs in with a brick 14" inlaid along for a pattern so it can be carried adventually all the way down Spring Street to tie into each intersection. Its a long range plan, Chestnut Street was chosen this time and the next one will be Maple Street. Mayor Parker said that he thinks its a good plan and Tom should work with Lt. Dave Schmidt for the traffic flow and parking~ also with our Street Commissioner, and City Engineer. Director Matra made the motion to grant permission to Jeff Main Street at the request of Tom Galligan to start the process of Chestnut and Spring Streets to put the brick and curbs in, seconded by Director Lakeman, and carried unanimously. ANNOUNCEMENT Mayor Parker announced the resignation of Parks Superintendent Rodger Caldwell last week. Donnie Poole will fill that position temporarily until it can be filled. NAMING STREETS Building Commissioner Bill Gavin reported that the Northside Church of Christ, 2510 Hwy 62 has 2 streets going in to the homes behind the Church and they are planning to build 5 or 6 retirement homes, Bill suggested that they need to give them names even though they are no dedicated streets, for emergency vehicles. Director Matra made the motion to approve Building Commissioner Bill Gavin to look into naming the streets at Northside Church of Christ, for emergency purposes, seconded by Director Lakeman~ and carried unanimously. PAGE 4 MAY 2~ 1994 B-WAY STOP City Engineer Bob Miller has a request to have a B-way stop put at the intersection of Clearstream and Pebble Brook. Mayor Parker asked Police Chief Elliott to investigate this and bring his recommendations back to the Board next week. There being no further business to come before the Board of Public Works and Safety, Director Lakeman made the motion to adjourn at lO:15a.m., seconded by Director Matra, and carried unanimously. _MAYOR
