Mayor Raymond J. Parker Jr. called the meeting to order at 9:30
and on call of the roll those members present were Mayor Raymond J.
Parker Jr., Personnel and Safety Director Harold Lakeman, and Sewage
Collection Office Director Jim Matra.

Mayor Parker said that we will take these bids under consideration and

OUTFALL PIPE FINAL CLAIM
John Toombs representing Jacobi, Toombs and Lanz Engineering is
requebting that the Board approve a final change order on the
Jeffersonville Wastewater Treatment Plant for $1,298.95. We added a
bar screen over the intake so no one washes through the pipe. Mr.
Toombs has papers for the Board to sign. Director Lakeman made the
motion to approve the outfall pipe, seconded by Director Matra, and
carried unanimously.
Mayor Parker explained that the meeting will recess for a Funeral and
Administrative Assistant Donna Baird, City Attorney Mike Gillenwater
and Board Member Harold Lakeman will take ail the necessary
information on the one's that can be handled this morning and we will
reconvene at l:30pm.

STREET DEDICATION IN W~ILLIAM~BuRG STATION
City Engineer Bob Miller said that he doesn't have a report on this
today.
SPRING STREET AREA AT CLARK MEMORIAL HOSPITAL
Street Commissioner George Trembly said that Mr. McDaniel who inquired
about the width of the street between 14th and 13th street was at the
morning meeting and George did not know it until Mr. McDaniel called
him at the Street Department. George said that he measured the street
between 14 & 13th Street and it measures 14 feet wide which makes it a
single lane. George talked to Mr. McDaniels about this.
PARKING PROBLEM
Brian Smith, 43? Mechanic Street has a parking problem at his
residence, the problem is turning at the Fieldhouse. Police Chief
Rick Elliott will make an investigation on this and bring the
recommendation to the next Board meeting.
BRIDGE CLOSURE
Police Chief Rick Elliott is requesting that the Bridge be closed on
Saturday March 19, 1994 from 8:00am-lO:OOam for the Rodes City Run in
Louisville. Director Lakeman made the motion to approve the bridge
closure request by Chief Elliott, seconded by Director Matra, and
carried unanimously.

COMPUTER SCIENCE PROJECT
Pesonnel Director Harold Lakeman reported that Silvercreek High School
has selected the City of Jeffersonville to do a Computer Science
project on Tuesday January 11~ 1994 at 8;30am in the Mayor's
Conference Room. Mr. Lakeman talked to the Department Heads that they
requested to talk with, they are the Police Departments Fire
Department, Personnel~ Street Departments Wastewater Treatment Plant.
The class is putting together a Computer Science program on what the
Departments do.
LETTER
Street Commissioner George Trembly said that he has written a letter
to send to Transit Authority of Rivercity. They continuously send
notifications that their signs are crooked or poles are bent~ we have
been replacing the poles~ and the price of the poles are $10.32 ea. I
want to send the letter telling them that they will have to start
paying for the poles and brackets that go up on the steel poles
downtown. Mayor Parker agreed and told George to send the letter.
CDL CLASSIFICATIONS
Plant Superintendent Larry James reported that the City Council
approved an Ordinance stating that any CDL driver will be given an
increase in pay for obtaining the license. We have 4 slots to fill.
Larry is recommending these 4 people~ Rodger Bolton, Dave Shelton,
Mike Arms~ Hershel Hamby and would like for the Board to consider this
today. Director Matra made the motion to approve the recommendation
from Larry James on the CDL pay~ seconded by Director Lakeman~ and
carried unanimously. (see copy)
SEWER TAP-IN
Plant Superintendent Larry James reported that Phyllis Stoner, 1819
New Albany/Charlestown Pike is requesting to tap in our sewer line at
her expense. City Attorney Mike Gillenwater said that she will have
to sign a wavier in the event that we annex that area.
THUNDER OVER LOUISVILLE MEETING
Administrative Assistant Donna Baird reported that Thursday January
13, 1994 at lO:OOam in the Mayor's Conference Room will be the first
Thunder Over Louisville meeting.

City Attorney Mike Gillenwater read the Take Home Car Policy questions

INVESTIGATION OF COMPLAINT FILED BY DONNA FRANTZ AGAINST LT. COL.
CLIFTON JAMES, JR.
Mayor Parker said that Lt. Col. Clifton James, Jr. wavied his rights
to have an Executive Session, it is an open session. For the record
it is a little bit lengthy. Mayor Parker asked Fire Chief Jerry
Dooley to read the investigation and recommendation. Mayor Parker
also said that after the reading we will allow anybody that wants to
respond, that opportunity either Pro, Con~ or indifferent. Fire Chief
Jerry Dooley read the investigation. After the reading Mayor Parker
asked Chief Dooley if he anything further to add~ he responded thats
ail. Mayor Parker asked Donna Frantz if she had anything to add
questions or comments. Donna asked some questions and Chief Dooley
answered them and there was further discussion. Donna Frantz wants it
in the record that her Husband Dennis did not call the Mayor while he
..~as on duty. Director Lakeman asked Chief Dooley to explain the Chain
f Command. Chief Dooley said it starts with Sergeant, Lt., Captain,
ajor, Lt. Colonel, Chief. Chief Dooley said that he was on vacation
the day this happened. Major DeArk was in charge of the Fire House
that day. Lt. Colonel James made some comments. Mayor Parker asked
if everyone has had an opportunity to respond. He asked City Attorney
Mike Gillenwater from a legal stand point if he has any comments.
Mike responded with no comment. Director Matra said that by reviewing
the statement where there was no Department rules or violations, he
made the motion to accept Chief Dooleys recommendations on the no
action taken, Director Lakeman wants to make a comment before he
seconds the motion, He doesn't think anyone in this room thats a
public figure should talk to a Citizen or whoever it is that way. We
need to watch our conduct. Mayor Parker said that he commends what
Donna Frantz has done for the Children, he also said that he does not
want any employee to talk to anyone in a rude manner. Donna said that
she wanted the men at the Fire Department to take credit for the Toys
Under the Tree. Chief Dooley said that he commends all the efforts
that Donna and everyone did, seconded by Director Lakeman, and carried
unanimously.
There being no further business to come before the Board of Public
Works ~ and Safety~ Director Lakeman made the motion to adjourn at
2:45p.m.~ seconded by Director Marra~ and carried unanimously.
SUMMARY OF INVESTIGATION OF A
COMPLAINT AGAINST LIEUTENANT COLONEL JAMES
FILED BY MRS. DONNA FRANTZ
This is a summary of the investigation conducted by Chief Jerry Dooley,
Jeffersonville Fh'e Depm-tment, in reference to a complaint filed against Lt. Colonel
Clifton James about an incident that happened on December 23, 1993.
The following statements are attached to this report:
1. Complaint filed by Councilperson Donna Frantz
2. Response to the Complaint filed by Lieutenant Colonel Clifton James
3. Statement by Sergeant Robert Jones
The complaint, the response and the statement from Sergeant Robert Jones are self-
explanatory. I have also had conversation with Lieutenant Tim Conlen and Private Steve
Gavin, who are the people that were in the rea- of Fire Headquarters when this incident
happened. Lieutenant Conlen did not get to the rea- of Fire Headquarters until after the
phone conversation, but he did hem- exactly what happened after the phone conversation.
Private Gavin was back there pretty much the whole time, and was a witness to the
incident. Both men agreed that the statement that Sergeant Jones gave was true and
con'ect. Mrs. Frantz did not want to identify any oil:er poszible witnesses.
CHRONOLOGY
~,~' EVENTS
October, 1993
The Fire Chief, with the blessing of the Board of Public Works and Safety,
volunteered willing members of the Fire department and the use of space in the buildings
to assist in helping with an empty stocking like program for needy children and fanilies
called "Toys Under the Tree".
October- December, 1993
The Jeflarsonville Fire Department began serving as a storage, sorting and
distribution location for the volunteer organization to help prepare donated toys to be
distributed to needy families at Christmas time. During this period, volunteers of the
organization, as well as the personnel of the fire depm-tment worked at the fire department
on these actiw;ties.
November, 1993
After notifying the Clarksville Fire Depm'tment, Jeffersonville Fire Department took
a truck to Thurnall's Harley Davidson to pick up toys which had been collected for
donation to needy families. These toys were placed on the truck and returned to Fire
Headquai'ters.
December 23. 1993
Mr. Sweetman appeared at the Fire Department asking if he could obtain assistance
for his family for Christmas. He stated that his family needed clothing, shoes and toys.
A representative of the Double T Tavern called and indicated that a collection had
taken place and that they had $206.00 which they were willing to donate for some needy
family.
An officer of the Fire Depmtment attempted to call Mrs. Frantz, an organizer of
the "Toys Under the Tree' p~ogram and was eventually able to relay the message that the
Double T money had been collected and that Mr. Sweetman had requested assistance.
Mrs. Frantz came to Fi,-e Headquarters and requested that Fire d~partment personnel
who were on duty go to tCMart and shop for items for the Sweetman family, using the
money donated by the Double T.
Sergeant Bob Jones indicated timt he would need to receive permission from a
superior before taking personnel on duty tip to KMart.
Mrs. Franz indicated that she would call Chief Dooley regarding the request. But
when she found out Chief Dooley was out of town, she indicated that she would call
Lieutenant Colonel James.
Sergeant Jones indicated that he requested that Mrs. Frantz not call Lieutenant
Colonel James until he (Jones) checked with Lieutenant Conlen to see if it would be okay
to take the men to KMm-t. This statement by Jones was confh~med by other personnel
who were on duty. Mrs. Frantz denies that anyone asked her not to call Lieutenant
Colonel James.
While Sergeant Jones was attempting to secure pem~ission to go to KMart Mrs.
Frantz called Lieutenant Colonel James to request permission to use the fire truck and
have the Fire det,~ ~ ..... l~, ~c ~c~ perform the sl;c;pp:ng.
A.t,~t a short conversation, Mrs. Frantz hung up on Licutenant Colonel Jzanes, who
called b,~,: A,,c~ ,~ 3~ef comment by her Mrs. Frantz st~ddenly ended the second phone
call and then cursed.
Mrs. Frantz left the Fire Department with a representative of the Double T Tavern.
Fire Department employee Dennis Frantz contacted Mayor Parker at his residence
to complain about the failure of Lieutenant Colonel James to grant the request of his wife,
Mrs. Frantz. During that phone call Mrs. Frantz spoke to the Mayor and voiced her
complaint. The Mayor advised her to file a complaint with the Personnel Department.
COMMENTS AND RECOMMENDATION
For approximately 2 1/2 months the Jeffersonville Fire Department cooperated and
assisted Mrs. Frantz and others with the "Toys Under the Tree" program in collecting,
sorting and distributing toys for the needy. This was done after approval by the Fire
Chief and the Board of Public Works. In all instances before December 23rd, requests
for manpower were made well in advance by the "Toys Under the Tree" program and
those requests were always accommodated by the fire department. On December 23rd the
incident which led by the Complaint by Mrs. Frantz occm~'ed.
The event leading to this complaint was an unanticipated request for immediate
action by Fire department personnel which had not been authorized by either the Fire
Chief or the Board of Public Works. This request was different than what had been
usually done in the past. Sergeant Jones u'ied to follow the chain of command, as he
should have, and obtain permission fi'om his superiors. Apparently, because of time
c.~:tsh-aii~',s, ?,5~'3. ~ ,ait',z chose to skip the rcgular chain of command and called Lieutenant
Colonel James directly, and made a request for immediate assistance in a manner which
had not been discussed before.
This incident seems to have occmTed because of a breakdown in communication
between the Complainant, Mrs. Frantz, and Lieutenant Colonel Janes. Lieutenant Colonel
James indicated that he was not aware of any previous time that fire department personnel
had been allowed to shop for clothing or toys while on duty and was concerned that he
and the department might receive some criticism from citizens or other council people if
City equipment was used. He indicated that because of all of the controversy smrounding
the take home car policy that he wanted some assurances from councilperson Frantz
before he would agree to grant her request.
In hindsight, it appears that Lieutenant Colonel James used bad judgment in relating
the request from Mrs. Frantz to the take home ca',' policy. But, I believe that his concern
about possible criticism for allowing on-duty fire department personnel to usc City TM ~
vehicles to go shopping for children's clothing is legitimate and understandable, since
there is no set policy on this.
Before this incident there have been personality differences between Lieutenant
Colonel James and Mrs. Frantz. They have disagreed on several occasions about various
issues. I believe that both of them could have approached this matter differently with
better results.
AS an employee of the Fire department, Lieutenant Colonel James is expected to
abide by the rules and regulations of the City of Jeffersonville Fire Department. I feel
that his handling of the situation with Mrs. Frantz resulted from fnlstration and confusion
over the use of City vehicles for private purposes. His response to her should have been
handled differently to avoid any misunderstanding. But, on reviewing the written Fire
department policies I found no violation of any of the roles or regulations. Therefore, I
feel that any formal disciplinary action would not be justifiable. I have personally spoken
to him and directed him to be more diplomatic in the future and encouraged him to use
better judgment.
Finally, I would recommend that Dennis Frantz be verbally reminded that
complaints regarding the conduct of other fire department personnel should proceed
through the chain of command, as per the rules and regulations, aud not directly to thc
Mayor's office.
RECOMMENDATIONS FOR FUTURE ASSISTANCE TO CHARITIES
Because of what I think was a communication problem the assistance requested by
Toys Under the Tree was not given, a complaint was filed and two newspapers were
notified about the fire department's lack of cooperation with the charity. I am not aware
of any note of thanks which was received by the City of Jeffersonville or the
Jeffersonville Fire Department fi'om either the "Toys Under the Tree" program or any of
the people who received packages from that program. The newspapers were not notified
about the hours of work and assistance provided by the fire department and the City of
Jeffersonville, but they were notified the first time a request from "Toys Under the Tree"
was not granted immediately.
I do not believe that the men and women who work at the fire depaXmen~ expect
praise for all of the things which they do to help other people. But, this entire incident
has given the fire department a black eye as payment for all of the cooperation, time and
effort given by the department. It also looks bad on the "Toys Under the Tree" program.
In the future, if any charitable o~ganizations request the assistance of the
Jeffersonville Fire Depa'tment I recommend that they be required to put that request for
assistance in writing and submit it to the Chief, who should then communicate the request
to the Board of Public Works. In the event that assistance is needed immediately, and the
Board of Public Works is not available, the Chief should make the decisic',n based upon
his best judgment and a consultation with the Mayor,
If assistance is given to any charitable organizations or groups the volunteers for
that group should be required to follow the departmental chain of command. They should
not call the Fire Chief or Assist Chief directly when an officer of the department requests
that the regular chain of command be followed.

JONES: Right. Then after - then Tim Collins or Conlen and Private
Jackson came back there.

JONES: That was - right.
DOOLEE' Okay. CouM you tell me~ to the best of your ability, just
~. exactly what happened, start from the beginning.
JONES: Well~ first of all~ that morning a Mr. Sweetman come in saying
he needs some shoes and wanted to know if we were giving out
Christmas baskets and stuff like that, and he - he had four
kids and he said his seven year old kid really needed shoes
bad. So the guys around Fire Headquarters took up a
collection and we were going to get him shoes and then in the
meantitne, Double T's called and said they had $206.00 they
wanted to give us and if we knew any family that needed it
and we said yea we just had this guy come in this morning.
So we was going to get the stuff for him, but in the meantime,
somebody wanted to call Donna because they said they had
some money left over frotn that account so I tried to call
Donna but her line was busy and then we went out to Engine
3's and we got a call out there and said Donna stopped in

here at Fire Headquarters and wanted us to stop at the
residence of Ms. Sweet,nan.
DOOL~Y.. That's Engine 3 on Hatnburg Pike.
JONES: Right. And wanted us to stop at Mr. Sweetman's house on
Myrtle and-
DOOLEY: Which is in that same area?
JONES: Right. And pick up the size of all his kids. So we did. And -
uh - then we come back to Fire Headquarters and then later
on that afternoon, Donna come down to Fire. Headquarters.
DOOLEE. ApproxhnateIy what time was that?
This was somewhere around 3:30, 4:00 o'clock.
Okay.
And - uh - I had this list and me and Private Gavht were out
back. And she come in and she said ~ uh ~ that I was
meeting a guy from Double T's, he w~s co~3'.g out back to
bring the $206.00 down, and go to get what the family needed.

JONES: And then slte pulled up out back and she come in and she said
- uh - can you all go get the stuff in the fire truck up at K-
Mart? And I said well, I don't think so because we're not
allowed to take the truck up that far but I had to find out.
She said well, let me call Jerry, and Private Gavin said, well
he's out of town so you can't call Jerry. Then she said let me
call Butch. I said no, I:ll call Butch if we have to, and then -
uh - because I ~;eed to go through the chain here at Fire
Headquarters first so I wet:t to go get Lieutenant Conlen
because he would be the next above me in rank, to ask him if
we could take the truck to K-Mart. And in the meantime,
when I went to get him and come back, she was on the phone
with Butch after I asked her not to, already - they was already
- she was just hanging up with him. They were already -
DOOLEY: So you asked her not to, not to call Butch that you would do it
you~'~elf?.

DOOLEY: And how did she get Butch's number?

I tom her I would call. I sam no, don't call Butch because I
will. If we even need to call Butch. First I had to go through
tile chabt here at Fire Headquarters.
Well, when I tom her I didn't think we could use the fire truck,
site said we'll let Theresa Popp may go so Private Gavin went
and got tile list and gave her the list of the phone numbers.
Hum-urn (yes).
And gave her Theresa Popp's phone number and then he left
the list itt the back of the pick up truck in the back bay and
she got the number off the list on her own. Nobody gave her
the phone number.
What happened after that?
Well - uh - after that, she was - size was mad and size said a
few tilings and she left, she went with the guy from Double T's
and they went to K-Mart and went attd got the

how we was gohzg to do it. Because see, I didn't kttow how to
shop for a 12 and 13 year old girl either. That was another
reason why [ didn't thbzk it was a good idea to take the fire

JONES: No. More than anything else, I was a little upset with Donna
was is earlier in the day, when we first started getting the
collection together, well the guys said I ought to call her.

JONES: And I really didn't think it would be a good idea to call her
but they wanted me to, so I called her and the phone was busy
attd when I got out to Engine 3's that afternoon, she come
down here and more or less called me a liar because she said
well he couldn't have called me, there's no way because I have
call waiting. But I did call her and there was three guys in
tile kitchen when I called her and. uh - that's one reason wily
I didn't want to get Donna involved in it. You know, I was
just wanting to go - the guys took up a collection here at the
firehouse attd we were just going to do ~t on our own on this~
