Parker Jr., Personnel and Safety Director Harold Lakeman, 'and Sewage

Also present were: Building Commissioner Bill~'G~gin,'City Engineer Bob
Miller, Street Commissioner George Trembly, City Attorney Mike
Gillenwater, Sewage Office Manager Bob Goldman, Police Chief Charles

Donna Baird, Wastewater Treatment Plant 'Director Kendall Coleman,

Clerk Alice Davis.
Director Lakeman made the motion to approve the minutes of the meeting
of September 11, 1995 as presented, sec0nd~d by Director Matra and
carried unanimously. ~'

LOUISVILLE BARREL-S~WER~'TAP"~ PERMIT
Wastewater Treatment Plant Dir~6'r Kendall Coleman reported on the
sewer tap in permit for Louisville Barrel. Director Coleman said he
could 'not deny this permit after"~hecking with Metropolitan Sewer
DistriCt, there was no significant violations there, 'his only concern
is what is being discharged through the sewer system. Director
Coleman recommends giving Louisville Barrel a sewer tap in permit.
Louisville Barrel repres'entatlve Debbie McDonald said the company will
abide with ail necessary guidelineS. Mr. Herman Sommerville of
Sommerville Distribution and Supply Co. Stated his opinion against
Louisville Barrel moving into the Industrial Park With all the
problems theyhave had in L6utsville. Councilperson Frantz asked
~Attorney Glllenwater queStions,~nd then she s~at~d she would continue
to fight against the business. Mary Grimes, owner of Air Compressor
-Dist'fibutors, Inc. asked questions and discusSed-'them with Attorney
Glllenwater. Mike explained the requirements of the law. Mayor
Parker said he wants to make s statement after this is voted on.

like to make is he thinks it originates around the comment that Mrs.

McDonald made at the first meeting, "are we doing anything different
on this investigation on the sewer tap contrary to the others in the
past". And yes we have, because this is a very highly sensitive,
technical tap in as you'all know obvious by the number of people that
have responded by Attorney being hired, by a consultant being hired,
we did do a more thorough ingestigation. That is because, we Want
everyone to be treated fair and imparticial. We ordered our Director
at the Wastewater Treatment Plant to do a thorough investigation, I
ordered him to do so and respond in writing which he has, I had our
Attorney to do a thorough investigation, we do have an obligation, we
do have a moral obligation but, we also have a legal obligation to
make sure that we do not make the City liable. I for one, took the
initiative to monitor and register all complaints that came in. We
have petitions in the amount of over 300 that were sent to this
office, signatures against] I have a stack 6f letters here, of 413
infact requesting the City to deny for odor reasons and various other
problems. We have an obligation you know, its tough for this Board
especially for me as the Chief Executive an elected official for
people of this City. And I for one would like to say that, I am not
against economic development, we will do and work hard in this City to
get economic development in this Community, even though this
technically speaking is not in the City limits of Jeffersonivlle, it
is in the 2 mile fringe which the City has Jurisdiction over. And we
do have a strong Ordinance which We are making Stronger to monitor
odors. Now what we OK'd today was Just the tap in. Now if there is a
problem after the various other hoops that Louisville Barrel has to
Jump through we are going to strongly monitor the Ordinance like Mrs.
Frantz stated, we are in a law suit at the present time with people on
an odor problem and violation and it means something to our people
here, over and above an economic development, the quality of life is
something to us and the quality of life is something these people
here, which I most certainly respect. And I hope you can appreciate
what we've done we've tried to be thorough. You heard our Attorney
respond to say that we could not legally deny this, even though we
gave it some thought, but we wanted to be legally right representing
the tax payers of the City of Jeffersonvllle we hesrd a report from
like I previously said from the management of the Wastewater Treatment
Plant, we let people respond, we heard from the general public, we
monitored, we did everything humanly possible, and again I want to go
on record that "The Quality of Life means something to us" so
therefore, what I ~.~ saying to Louisville Barrel is you are going to
be monitored, highly monitored, because we do not want anything in our
Community similar to what we have how, but, we had no other choice but
to OK this, but we will be monitoring Louisville Barrel.

Director Matra made'themotion ko approve the Wheel Loader Bid to
Whayne Supply Company and also the 5yr..warranty for 82,100.00, on the
power train, seconded by Director Lakeman, and carried unanimously.

PROBLEMS WITH NEIGHBORS
Floyd Harvey, 922 Watt Street has problems with neighbors, Mrs. Harvey
spoke in his behalf. Mrs. Harvey said and several neighbors have come
to the Board with complaints about their next door neighbors and one
who lives across the street. Ms. Harvey explained the problems they
are having, and when they call the Police they do respond. Mayor
Parker asked if they have filed complaints in the Prosecutors Office~
Chief Elder said he has talked with Mr. Harvey about the complaints,
and he will get a report made and take to the Prosecutors Office.
Chief Elder said for them to keep calling in the complaints because
this is logged in and is a permanent record. Mayor Parker asked~Chief
Elder to have extra patrols in their neighborhood.
EVENT OF SEPTEMBER 30, 1995 BY SUNSHINE PROMOTIONS
Marc Elfenbaum, representing Sunshine Promotions is appearing before
the Board to discuss the Concert by K C & the Sunshine Band, on
Saturday September 30, 1995 at 3~00 p.m. Mr. Elfenbaum explained the
different things that needs to be done, and the time of 8:00am to
close the streets, and he also presented a '~ertlficate of insurance.
Mayor Parker said he thinks they need to have more advertising for
this Concert. Administrative Assistant Donna Baird said she will be
working with Marc on this. Director Lakeman made the motion to
approve the September 30, 1995 concert from Sunshine Promotions at
Riverside Drive and Spring~ Str~e~ and~als~ the cl0sing of the streets,
seconded by Director Matra, and carried unanimously.
HUMANE SOCIETY DOG WALK-A~THON ~. .~ ~ ~
Mrs. Faye Schoen, representing the Humane Society, is requesting to
use Riverside Drive on October 14, 1995 for a dog walk-a-thon from
9:00a.m.-3:00p.m. Mrs~ Schoen said they will be using the sidewalks
only, and will not require street closings. They will also clean up
after the walk-a-thon is over. Also would like to use the overlook
for registration.", The proposed route will be down one side of
Riverside Drive for about 2 miles at the most. Mayor Parker said he
would like for Mrsl Schoen to work with Mrs. Baird for this event.
Director Matra made the motion to approve the Humane Society dog
walk-a-thon from 9=00am-3:00pm on ~Saturday October 14, 1995, seconded
by Director Lakeman, and ca'tried unanimously.' ..... ~ ~i
CONTRACT
City Attorney Mike Gillenwater has prepared a contract, A Consent To
Enter, between the City and Kempf's who own the property on 10th
Street at the railroad viaduct. Director Matra made the motion to
approve the contract, seconded by Director Lakeman, and carried
unanimously.
Ed Voyles reported that our first SaturdaY of being open at the Animal

Shelter was a success and would like to thank the Advisory Board and
members of the Humane Association for helping to make it a success.
REMINDER
Street Commissioner George Trembly wants to remind everyone that the
City Auction will be on Saturday September 30, 1995 at 10:00a.m. over
at EMC.
ROADBLOCK SATURDAY SEPTEMBER 16, 1995
Police Chief Elder reported the DUI roadblock on Saturday September
16, 1995 from midnight 'til 4:00am netted 10 arrests at the Second
Street Bridge, there were a total of 40 arrests made during that time
with the State and County Police Departments. Chief Elder wants to
thank the Fire Department for providing the lights to make it safer.
Wastewater Treatment Plant Director Coleman announced that on October
9, 1995 the Southern Indiana Chamber of Commerce will be touring the
Plant at 12:30p.m. and want to extend an invitation to the Board and
anyone else who wants can come.
There being no further business to come before the Board of Public
Works and Safety, Director Lakeman made the motion to adjourn
10:lSa.m., seconded by Director Matra, and carried unanimously.
