HomeMy WebLinkAbout04-17-1995MINUTES OF THE BOARD OF PUBLIC WORKS AND SAPETY OF THE CITY OF JEFFERSONVILLE~ INDIANA MONDAY APRIL 17~ 1995 Administrative Assistant Donna Baird called the meeting to order at 9:30 A~M. in the absence of Mayor Raymond J. Parker Jr.~ and on call of the roll those members presen~ were Sewage Collection Office Director Jim Matra and Street Commissioner George Trembly setting in for Personnel and Safety Director Harold Lakeman in his absence~ Also present were: Buil'ding Commissioner Bill Gavin~ City Engineer Bob Miller, City Attorney Mike Gillenwater~ Sewage Office Manager Bob Goldman, Maintenance Foreman Mike Ewton, Police Chief Charles Elder, Fire Chief Jerry DooIey~ Parks Superintendent Donnie Poote~ and Clerk Alice Davis. Director Matra made of April lOs 1995 as unanimously. the motion to approve the minutes of the meeting presented~ seconded by Member Trembly and carried Director Matra made the motion to approve the payrolls as presented~ seconded by Member Trembly and carried unanimously. DOG KENNEL City Attorney Mike Gillenwater reported that he hae talked with Karen Walker~ 9 Center Street concerning the Dog Kennel on her property. Mike said that she needs time to come into compliance~ She has 18 dogs~ and we will try and work with her and he will have someone come an~d talk to her about the complaint~ and will also send the Animal Control Officer to take a look at it. DUST PROBLEM AT LITER's QUARRY City Attorney Mike Gillenwater reported on the dust problem at Liter's Quarry~ Mike said that the tipple is not located down in the quarrry and Les Kavanaugh is going to contact them and ask the to start running the water truck. PEDDLER'S PERMIT Police Chief Charles Elder reported on the Peddler~s Permit for Chauncey Lewis~ Chief Elder said that he talked with Mr. Lewis and he had a permit for last year and had no problems with it. Chief Elder recommends giving the permit to him. Director Matra made the motion to approve the Peddler's Permit for Chauncey Lewis~ seconded by member George Trembly and carried unanimously. B80 E. MAPLE STREET City Attorney Mike Gillenwater reported on the property at ~EO E. Maple Street~ he eaid that the hearing will be at iO:O0 am today~ PAGE 2 APRIL i?, 1995 ROADBLOCK Lana Steinbarger representing Truth Tabernacle is requesting a roadblock on May 6~ 1995 from tO:OOam-4:OOpm~ to raise money to buy a van ~ith a wheelchair for her daughter who has been confined to a wheel chair for most of her !ife~ She would like the location to be Bth &~ Nachand, Allison Lane &~ Middle Road, Dutch Lane & Hamburg Pike~ Plank Road & Springd~le Drive M ' ~ · ~ emoer Trembly made the motion to approve the roadblock locations with the exception of Allison Lane and Middle Road~ seconded by Director Marra~ and carried unanimously. {see copy) ' ROAD~OCK Mike Ouzts is requesting a roadblock to raise money to send his son on a trip to play tennis outside the United States. The cost to send him to various countries will be ~B~I00.00. Mr. Ouzts said he has information from the World Sports Exchange. Donna eaid for Mr-. Ouzts to get his information on what street locations~ the times he wants and bring them back to the Board next week. R.W~ NOEL CITED Building Commissioner Bill Gavin reported he cited R. W. Noel to appear before the Board concerning his property in the 300 block of Pearl Street. Bill said that Mr. Noel called and this is rental j property and he will see that it gets taken care ~ SELL?,t__G OF DRINKS AT ~REAT S~E_~MB~O. AT ~ACE ~ Administrative Assistant Donna Baird reported that Ms Diana Johnson from Clark County Youth Shelter appeared before the Board last week in regards to selling soft drinks at the Great Steamboat Race~ she has met with Donna with the appropriate information in order for her to do that. Director Matra made the motion to approve the soft drink sales for the Clark County Youth Shelter at the Great Steamboat Race and there was a request by the Mayor to waive the permit fees~ seconded by member Trembly. 'The meeting was ad3ourned at 9:50am until IO:OOam for the property at BBO E~ Maple Street. MAPLE STREET Administrative Assistant Donna Baird called the meeting to order in regards to the property at 2~0 E. Maples ~hich has been cited for condemnation. City Attorney Gillenwater sent Ms. Pat Evans a letter citing her to appear before the Board at 10:00am April 17~ 1995 and the Ietter states that if she did not appear we would pursue the meeting in her absense. Ms. Evans is not in attendence. Mike said to make the record clear Mr. Gavin issued an order to remove the building at ~0 E~ Maple Street on February 23~ 1995 and required that Ms. ~vans, attend and then immediately scheduled March RO, 1995 here at the Board unless she has resolved the problem. Then on March 16~ 1995 Ms. ~vans sent a letter to Mr. Gavin and Mike requesting that the hearing · be postponed until April 15~ 1995~ Mike called her to tell her the Board ~ould allow her that delay~ and Mike contacted her spoke to her ~and sent her something in writing advising her that the hearing will be held today if the problem has not been resolved first, Ms~ Evans agreed with that. Under the code we did not have to give her a continuance~ if you choose to go head and find that this order should be enforced then we can go ahead and proceed with the demolition of the building. For the record Mike asked Mr. Gavin to state what is wrong with the building. Bill said that the house is well beyond the code requirements it meets the requirement of condemnation, the supportive beam in the basement is particially pulled away from the ~mll~ a strong wind could move the beam and then we would have real problems, floors are settling down~ raccoons, rodent infested~ it's been unoccupied for some time and is a danger to the adjacent residences. Mike is asking the Board to vote on this and to find the ~ouse is in an unsafe condition. (SEE COPY) Bill asked Mike if we see that this cost of demolishing this and grading the yard out can be · Filed as a lien against the lot. Mike said there is a proceedure ~here we can file a civil suit in court. Director Matra made the .,motion to proceed with the demolition order of the structure located at 2~0 E. Maple Street, seconded by member Trembly and carried ~nanimously. Mike said that we can either do it no~w and get a judgement against Ms. Evans now and have her reinburse us, or get a judgement against her and hope that we can get the money, or ask the Court to issue an order requiring Ms. Evans do it, Mike said that if we go with the Court it will take another 3 months to get it done, George said he thinks she has had enough time~ and go the quickest route. Mike said that he would like the opportunity to send her a certified letter retiring her of the action that we've taken and we are going to proceed to file the civil suit. Going to court the Judge will ask her to reinburse us. Bill said he will have to get bids on the demolition. Mike will notify her to get this law suit started. ~PROPERTY AT lOTH STREET PUMP STATION City Attorney Mike Gillenwater reported on the property at the loth ~treet Pump Station that Jack Waldrip from Clark Memorial Hospital asked to buy. Mike said they had it appraised and there appraisel is $4,800.00. We paid $89~000~00 'From Joe Conner and $1~900.00 from T. Kempf, we need to have our own appraiser to look at it. Director Matra made the motion to approve getting the property appraised at the loth Street Pump Station adjacent to Clark Memorial Hospital~ seconded by member Trembly and carried unanimou!sy. Box 1394 Jeffersonville, IN 47130 220 East Maple Sue, et Jeffersonville, IN 47130 Pursuant to I.C. 36-7-9 et seq. and the City of Jeffersonville Ordinance 84-OR-18, the structure located at 220 E. Maple St. in Jeffersonville, Indiana has been determined to be an unsafe building which is a hazard to public health, safety and welfare because it is not maintained or because it is become dilapidated. In addition, it is located in close proximity to adjacent structures creating an increased risk of conflagration and the spread of insect and/or rodent infestation. This structure is an unsafe building as defined by I.e. 36-7-9-4 in that it is in an impaired structural condition that makes it unsafe to persons or property; it is a fire hazard; it is a hazard to public health; it is a public nuisance; and it is vacant and not maintained in a manner that would allow human habitation, occupancy or use under the requirements of the Indiana Code or the City of Jeffersonville Building Code. YOU ARE HEREBY ORDERED to remove this structure from the real estate located at 220 E. Maple St. in Jeffersonville forthwith. Failure to do so will result in an enfOrcement action being brought before the City of Jeffersonvilie Board of Public Works on March 20, 1995 at 10:00 o'clock a.m. in room 400 of the City-County Building, 501 East Court Avenue, Jeffersonville, Indiana 47130, pursuant to I.C. 36-7-9-7. You are encouraged to attend the enforcement hearing and may have an attorney to represent you, at your expense. If you fail to appear or do not request and receive an order rescheduling this matter the enforcement hearing will be held in your absence. If the City of Jeffersonville Board of Public Works and Safety finds that there has been a willful failure to comply with this Order it may impose a civil penalty'against you in an amount not to exceed $1,000.00 and may request that a Court proceeding be instituted to require the removal of the structure designated above, at your expense.
