OF THE CITY OF JEFFERSONVILLE~ INDIANA
MONDAY JANUARY 27,1997
Mayor Thomas R. Galligan called the meeting to order at 9:30 A.M., and
on call of the roll those members present were: Personnel Director
Harold Lakeman, and Safety Director Anthony Earrod.
Also present were: City Engineer Bob Miller, Sewage Office Manager Bob
Goldman, Planning and Development Director Jim Urban, Parks
Superintendent Rick Elllott, Vehicle Maintenance Foreman Mike
Ewton,Wastewater Treatment Plant Assistant Director Scott Timmerman,
Police Chief Mike Pavey, Building Commissioner Bill Gavin, Wastewater
Treatment Plant Manager Kendall Coleman, Animal Shelter Director Jim
Gillenwater, Fire Chief Mike Smith, and Clerk Lynne Kempf.
Director Lakeman made the motion to approve the payrolls as presented~
seconded by Director Harrod and carried unanimously.
CLARK MEMORIAL HOSPITAL
Wayne Estopinal of the Estopinal Group presented the plan for
improving the traffic problems at the Clark Memorial Hospital. The
approximate cost to the hospital is between $225,000 to $230,000.
Director Lakeman made the motion to approve proceeding with the plans,
seconded by Director Harrod and carried unanimously.
DUTCH LANE/ HAMBURG PIKE
Nathan Grimes of Jacobi, Toombs, and Lanz requested approval on the
enclosed Supplemental Agreement for Construction Engineering Services
in connection with the Hamburg Pike/Dutch Lane Intersection
Improvements Project. The total amount of the additional request is
$11,850.72 with the City's share being $2~370.1~. Director Lakeman
made the motion to approve the request, seconded by Director Harrod
and carried unanimously.
SEWER BACK-UP
Bill Barber was present on behalf of a sewer back up problem that was
discussed at a previous BPW meeting. Mayor Gallingan asked him to
stay after the meeting so they could discuss this problem further.
ELECTRICAL CAP ADJUSTMENT REPORT
Wastewater Treatment Plant Assistant Director Scott Tlmmerman
presented a report detailing PSI's electric rate increase and it's
effect on the electrical costs of the Treatment Facility and Lift
Stations. Director Lakeman made the motion to table any action,
seconded by Director Harrod and carried unanimously.
There being no fuFther business to come before the Board of Public
Works and Safety, Director Lakeman made the motion to adjourn at 9:45
A.M.~ seconded by Director Harrod and carried unanimously.

Request for Supplemental Fees
Dear Mayor Galligan:
The purpose of this letter is to request that the enclosed Supplemental Agreement for Construction
Engineering Services in connection with the HambUrg Pike/Dutch Lane Intersection Improvements
Project be approved by the City and forwarded to INDOT for their review.
The reasons for this request are detailed on page foUr (4) of the request.
The total amount of the additional request is $11,850.72. The City's share is 20 % of this amount
($2,370.14), and the State's share is 80% (9,480.58). The additional monies are required to cover
inspection expenses that are being incurred in this project.

This Supplemental Agreement made and entered into this day of January, 1997, by and
between the City of J'effersonville, acting by and through the Board of Public Works and Safety,
hereinafter referred to as the "LOCAL PUBLIC AGENCY", and Sacobi, Toombs and Lanz, Inc.,
Consulting Engineers, 120 Bell Avenue, Clarksville, Indiana, 47129, hereinafter referred to as
the "CONSULTANT",
WITNESSETEI
WHEREAS, the LOCAL PUBLIC AGENCY and the CONSULTANT did, on November
4, 1991, enter into an agreement providing necessary Construction Engineering Services required
in connection with Federal Aid Project No. STP-M-MG-C700( )~ Hamburg Pike/Dutch Lane
Intersection Improvements, including installation of traffic signal, traffic lanes, and profile
correction, located in the city of Jeffersonville, in Clark County, Indiana.
WHEREAS, it has become necessary to continue to provide Construction Engineering
Services required to complete this project, and,
WHEREAS, the Construction Engineering work required to complete this project is
appropriate, and will result in an adjustment to the maximum fee.
NOW THEREFORE, it is agreed by and between the parties hereto to the following
additions or changes in the agreement:

AMOUNT OF PAYMENT
4. The total compensation for Section A (1), (2) and (3) of the Appendix "D"
shall not exceed $ 37,062.72 unless approved in writing by the Local Public
Agency, Indiana Department of Transportation and Federal Highway
Administration.
A breakdown of the estimated costs for the project is as follows:
Base Payroll Cost $ 14,897.60
Payroll Burden and General Overhead $ 1.8,768.76
Estimated Total Labor and Overhead Costs $ 33,666.36
Fixed Fee $ 3,272.36
Direct Non-Salary Costs $ ~
Total $ 37,062.72

Fuel, asphalt and limestone bids
City Attorney, Anne Marie Sedwick, reviewed the bids that the Board had opened at its
January 6, 1997 meeting. She recommended that the Board accept the Iow bid in each
category as follows:
1. Makowsky Oil for fuel
2. Sellersburg Stone for crushed limestone and cold patch
3. Asphalt Supply for asphalt to be picked up at the plant
Gohmann Asphalt and Construction for paving (i.e. asphalt and primer to be
applied by the construction company). The City Attorney, Sedwick,
recommended that the Gohmann Asphalt bid be accepted conditional upon
Gohmann entering into a hold harmless agreement with the City and showing the
City as an additional named insured as required in the Request for Bids. Director
Harrod made the Motion to accept the bids as recommended, seconded by
Director Lakeman and carried unanimously.
EXCEPT as herein modified, charged and supplemented, all items of the original
agreement dated November 4, 1991, shall continue in full force and effect.
IN WITNESS WHEREOF, the parties hereto have made and executed this Supplemental
Agreement the day and year first mentioned above.

The original Construction Engineering Agreement was negotiated in 1991, with projected wage
rates for 1992. The project construction has not taken place until 1996 and 1997, and wage rates
are greater than the amountS projected for 1992.
Also, the Resident Construction Representative has required time to complete the required
paperwork for preparation of the Construction Record.
The As-Bid contract price was $308,708~89. Change orders have increased the construction cost
by $10,900.35 to a total of $319,609.24. The revised not-to-exceed fee of $37,062.72 is within
the 12% of construction cost allowed by INDOT.
