JEFFERSONVILLE, INDIANA MONDAY, SEPTEMBER 14, 1998
Mayor Galligan called the meeting to order at 9:30 a.m., and on call of the roll those members
present were: City Engineer Bob Miller, and Sewage Office Manager Bob Goldman.
Also present were: Vehicle Maintenance Foreman Mike Ewton, Wastewater Treatment Plant
Assistant Director Jim Traylor, Fire Chief Mike Smith, Street Commissioner Bobby Ervin,
Animal Shelter Manager Rick Broy, Building Commissioner Larry Decker, Parks Director Rick
Elliott, City Attorney Anne Marie Galligan, Police Chief Mike Pavey, and Clerk Lynne Kempf.
City Engineer Miller made the motion to approve the claim as presented, seconded by Manager
Goldman and carded unanimously.
Manager Goldman made the motion to approve the payroll as presented, seconded by Engineer
Miller and carried unanimously.
ALLISON LANE BID
John Toombs of Jacobi, Toombs, and Lanz recommended awarding the Allison Lane bid to K
and I Construction. Their bid was $286,995.50. The traffic signal portion of the job will not be
awarded at this time. City Engineer Miller made the motion to approve accepting K and I
Construction's bid of $286,995.50, seconded by Sewage Office Manager Goldman and carried
unanimously.
MALLARD RUN ROAD CLOSURE
Amelia Goffinet requested the Board's approval to close Goslen Court on September 26th at 3:00
p.m. for the annual Neighborhood Picnic. Sewage Office Manager Goldman made the motion to
approve closing Goslen Court, seconded by Engineer Miller and carried unanimously.
ROAD CLOSURE
Leigh Klein asked the Board to approve closing the northern half of Court Avenue from Wall St.
to Spring St. in front of Warder Park on September 19th from 10:30 a.m. to 4:30 p.m. on Court
Avenue from Wall St. to Spring St. for the Head Start Awareness. Engineer Miller made the
motion to approve the closure, seconded by Sew. Office Manager Goldman and carded
unanimously.
ART MYER
Art Myer of 212 Hopkins Ln. spoke to the Mayor concerning his ongoing drainage problem. Mr.
Myer said it is becoming a health problem having water standing in his yard. The Mayor said he
has put a drain on Mr. Myer's neighbor's property and with her permisson he would have to go
on her property to do some grading on Mr. Myer's property. The lady will not give permission
for the City to go on her property to do this. Therefore, there is nothing else that the City can do.
City Attorney Galligan said that it is Mr. Myer's responsibility to deal with his water problem in
the way in which he wants, but that the city is not responsible.
3436 CHAS. PIKE
Don Adams of 3436 Chas. Pike asked for an update on the drainage problem in his
neighborhood. The Mayor said he would be going out to look at it.
FAIRVIEW ALLEY
Several residents of Fairview Ave. appeared before the Board to voice their opinion on blocking
the alley. They also want the City to maintain the alley. City Atty. Galligan told them it is not the
city's responsibility to maintain the alley unless it is dedicated to the City. AtSer much
discussion,Mayor Galligan is going to go out and look at this again and talk to Mr. Munich of
Munich Welding.
IN.-AMERICAN WATER TRI-PARTY AGREEMENT
City Att. Galligan presented to the Board for approval the In.-Amer. Tri-Party agreement
between two developers, the City, and In.-Amer. Water to allow In.-Amer. to construct a large
storm water drainage pipe that will go from Middle Rd. through Perdn Park to the river. The Jeff
Sewer Utility will provide engineering as well as putting in some sanitary sewers. Engineer
Miller made the motion to approve entering into this agreement, seconded by Manager Goldman
and carded unanimously. The project is estimated at 2 million dollars.
CROSSWALK
Nellie Nolan asked the Board ifa crosswalk could be made at Frank St. for the safety of children
waiting for the school bus on Spring St. The Mayor said the school corp. will be notified that the
bus should not be picking up children on Spring Street.
FRANCIS DRIVE
Marvin Grant took Engineer Miller to his son's address on Francis Drive where he would like to
have the alley closed and use it as a driveway. The Mayor said he would look into this. Engineer
Miller made the motion to table until next week, seconded by Manager Goldman and carried
unanimously.
NOTICE OF VIOLATIONS
City Att. Galligan said EMC recommended a Notice Of Violation to The Dallas Group of
America for violating it's Industrial Discharge Permit and the Industrial Sewer Use Ordinance.
Engineer Miller made the motion to require Dallas Group to submit in writing a report stating
why this spill occurred and was not reported to the facility. A response is to be submitted in 10
days. The Dallas Group is required to reimburse the city for labor costs and truck costs incurred
in this cleanup.
EMC recommended a Notice of Violation to Wyandot, Inc. for violating the Industrial Discharge
Permit and the Sewer Use Ordinance. Engineer Miller made the motion to require Wyandot to
submit in writing a report stating why this exceedence occurred. This response is to be submitted
within 10 working days. Wyandot also is required to pay $1,000 for the Oil and Grease
violation, seconded by Manager Goldman and carried unanimously

SPENCERPROPERTY
The Spencer property which is the property right above Point Liquors has been sold. The owner
wants to have a median put in. Engineer Miller said he would go out and look at this.
There being no further business to come before the Board of Public Works and Safety, Manager
Goldman made the motion to adjourn at 11:00 a.m., seconded by City Engineer Miller and
carried unanimously.
