JEFFERSONVILLE, INDIANA MONDAY, AUGUST 24, 1998
Mayor Galligan called the meeting to order at 9:50 a.m., and on call of the roll those members
present were: City Engineer Bob Miller, and Sewage Office Manager Bob Goldman.
Also present were: Vehicle Maintenance Foreman Mike Ewton, Fire Chief Mike Smith, Street
Commissioner Bobby Ervin, Building Commissioner Larry Decker,Police Chief Mike
Pavey,Wastewater Treatment Assistant Director Traylor, Parks Superintendent Rick Elliott,
Animal Shelter Asst. Manager Rick Broy, City Attorney Anne Marie Galligan, and Clerk Lynne
Kempf.
City Engineer Miller made the motion to approve the minutes as presented, seconded by Sewage
Office Manager Goldman and carded unanimously.
Sewage Office Manager made the motion to approve the payroll as presented, seconded by City
Engineer Miller and carded unanimously.
3436 CHARLESTOWN PIKE
Don Adams spoke in regards to his drainage problem. He said it's getting worse. City Engineer
Miller said he had spoken with Dave Broady and he said he would take care of it. Engineer
Miller will check back with Mr. Broady and Roger Schmitt. Engineer Miller said 10 days should
be ample time to get the job done.
HORSE CARRIAGES
Kristi Bivens wants to bring another carriage service to downtown Jeffersonville. The Mayor
said there is no problem with this. City Attorney Galligan said she would just need to send her
insurance certificate to her.
317 PEARL STREET
Kathy Starr requests speed bumps in the alley beside her house. Mayor Galligan said speed
bumps can't be installed because of a public right of way. The Mayor suggested making the alley
one way or a dead end. He asked Ms. Starr to get a petition signed by all her neighbors in favor
of this.
IN.-AMERICAN WATER
City Attorney Galligan said she received a request fi.om Indiana-American Water for a 25 ft
easement from the City to put water pipes in to get back to the new animal shelter. Manager
Goldman made the motion to approve the 25 ft. easement, seconded by Engineer Miller and
carded unanimously.
YOUTHFOOTBALLLEAGUE
Sam Crowe requested to hold a roadblock for Saturday, August 29th at three different locations
to raise money to help suit kids for football. The Mayor said the City is no longer granting
permission for roadblocks because of the potential for injury. The Mayor suggested that the
Crowe's go the the County for permission to hold a roadblock in the County. Parks
Superintendent Elliott brought to the Mayor's attention that the City does help the Youth
Football League by supplying them a park to play their games in free of charge and by paying
their utilities.
.SILO RIDGE
Rick Elliott said there is a drainage situation at Silo Ridge. A ditch put in there is going to rot the
trees out and cause damage. City Engineer Miller is aware of this problem and is working on it.
FRANK STREET
Street Commissioner Ervin said he checked the location and he saw no prblem with making it a
dead end. Mayor Galligan said a sign would be put up at both ends and the property owner of
117 Frank Street needs to put up a barrier of some sort.
STREET LIGHT REQUEST
Umang Bhatt requested a street light at Frontage Road, the access road by U-Haul. After some
discussion, Manager Goldman made the motion to approve the street light, seconded by Engineer
Miller and carried unanimously.
NOTICE OF VIOLATIONS
IWR98-3
City Attorney Galligan said IWR has been found to be in violation of the conditions of the
wastewater discharge permit. On 8/2/98 a spill took place at the IWR site and appeared to be
some sort of oil. It did not invade any drainage systems. A response is expected within 10 days.
Engineer Miller made the motion to notify IWR of Violation 98-3, seconded by Manager
Goldman and carded unanimously.
IWR-98-4
IWR was found in violation of the conditions of the wastewater discharge permit. There have
been numerous complaints of malodorous gases from Industrial Water Recycling. A report
explaining the cause of the odors is expected within 10 days and a $2,500.00 fine for this
violation. Manager Goldman made the motion to approve the violation with a report within 10
days and a $2,500.00 fine, seconded by Engineer Miller and carded unanimously.
WY-98-3
Wyandot has been found to be in violation of an oil and grease result of 325 mg/1 on August 3,
1998. This exceeds the limit of 100 mg/1.Wyandot is required to submit in writing a report
stating why this exceedence occurred within 10 working days. They are also required to pay
$1,000 for the oil and grease violation. Manager Goldman made the motion to approve the
violaton with a written report within 10 days stating the reason for the exceedence and a
$1,000.00 fine, seconded by Engineer Miller and carried unanimously.
AC-98-1
On July 9, 1998 Aero Container reported an oil and grease result of 619 mg/l. This exceeds your
permit limit of 100 mg/1.As this is in violation of the Industrial Discharge Permit and the
Industrial Sewer Use Ordinance of the City of Jeffersonville, Indiana. Aero Container is required
to submit in writing a report stating why this exceedence occurred and why it wasn't it reported.
This response is to be submitted in 10 working days. No fine will be issued for July but Aero
will be required to pay $1,000 per day per violation for furore violations and/or $1,000 per day
for future non-reporting of violations. Manager Goldman made the motion to require a written
report in 10 working days w/th a fine in the future, seconded by Engineer Miller and carded
unanimously.
AC-98-2
On Monday, August 3, 1998 an oil and grease spill was located that had accumulated in the
Silver Creek Lift Station. Aero personnel were not aware of the spill. Aero Container is required
to submit a report in writing stating why this spill took place and why it was not detected and
reported in accordance with the spill control plan and the City Sewer Use Ordinance. This
response is to be submitted within 10 working days. Aero Container is required to pay a $1,000
fine for August's violations. The fine is due in full within 30 days of this order. Engineer Miller
made the motion to require a report of explanation on the spill within 10 days and a $1,000 fine,
seconded by Manager Goldman and carded unanimously.
IWR DELINQUENT SEWER ACCOUNT
Manager Goldman stated that IWR has an unpaid fine of $2,500.00 in addition to the fine levied
today. He said IWR is also one month delinquent in payment of its monthly sewer bill. Director
Traylor suggested that the Board give IWR 10 days to pay both its fines and it's delinquent sewer
bill, and if those sums are not paid within 10 days, the Board revoke IWR's discharge permit.
Manager Goldman made a motion to revoke IWR's discharge permit if both fines ($5,000.00
total) and the outstanding sewer bills are not paid in full within 10 days, seconded by Engineer
Miller and carried unanimously.
STEAMBOAT COMMITTEE
Police Chief Pavey said the Steamboat Committee asked him to let everyone know about
Keisler's intent to have their armor equipment in the Steamboat Parade and would like
permission to fire off some rounds as they've done in the past. Mayor Galligan said the
Steamboat Committee would need to put in writing everything they want so there is no mix-up.
There being no further business to come before the Board of Public Works and Safety, City
Engineer Miller made the motion to adjourn at 10:20 a.m., seconded by Sewage Office
Manager Goldman and carried unanimously.
