TUESDAY JANUARY 20~1998
Mayor Thomas R. Galligan~ called the meeting to order at 9~50 A.M.~
and on call of the roll those members present were: Sewage Office
Mananger Bob Goldman sitting in for City Engineer Miller, and Planning
and Development Director Urban.
Also present were: City Attorney Anne Marie Galligan, Sewage Office
Manager Bob Goldman, Parks Superintendent Rick Elliott, Fire Chief
Mike Smith, Police Chief Mike Pavey, Building Commissioner Pinkston,
Wastewater Treatment Plant Director Scott Timmerman, Vehicle
Maintenance Foreman Mike Ewton, Safety Director George Trembly, Street
Commissioner Bobby Ervin,and Clerk Lynne Kempf.

Director Urban made the motion to approve the payroll as presented,
seconded by Sewage Office Manager Goldman and carried unanimously.
PAY RAISE
On January 5, 1998, City Engineer Miller asked the Board to approve a
pay raise for one of his operator's. Director Urban made the motion
to approve the raise, seconded by Sewage Office Manager Goldman and
carried unanimously.
CAUTION LIGHT
Safety Director Trembly said on behalf of City Engineer Miller that a
caution light has been requested on llth Street. Another one has been
requested on A Avenue. Sewage Office Manager Goldman made the motion
to approve both signs, seconded by Director Urban and carried
unanimously.
HIGH MEADOW SUBDIVISION
"-~avid Blankenbeker on behalf of Charlie Reisert and High Meadow
~-~ Subdivision requested permission to tap into the city's sewer system.
Director Urban made the motion to allow High Meadow Subdivision to tie
into the Jeffersonville sewers, sub3ect to the developer providing the
required lift station and collection system improvements, seconded by
Sewage Office Manager Goldman and carried unanimously.

CITATION
Paul Torma of 1525 Waverly Road appeared before the Board in regards
to the cltatlon he received from the Building Commissioner's office.
Mr. Torma said he is in the process of building a house and is aware
of and working on the water problem. Mayor Galligan told Mr. Torma he
has to get the water out and that the City will put a pipe in if he
digs the ditch. Director Urban made the motion to give Mr. Torma 45
days to get the drainage put in, seconded by Sewage Office Manager
Goldman and carried unanimously.
ANNUAL REPORT
Wastewater Treatment Plant Asst. Director Timmerman submitted the
1997 Annual Report for bio-solids. Director Urban made the motion to
accept the Annual Report, seconded by Sewage Office Manager Goldman
and carried unanimously. (copy attached)
NOTICE OF VIOLATION
Wastewater Treatment Plant Asst. Director Timmerman requested the
Board's approval on a Notice of Violation for Chemtrusion. (findings
attached) Chemtrusion agreed to take all responsibility and cost of
repaifi~g~all equipment damaged from the discharge of abrasive
material. Director Urban made the motion to approve the violation
with no fine, seconded by Sewage Office Manager Goldman and carried
unanimously.
NOTICE OF VIOLATION
Wastewater Treatment Plant Asst. Director Timmerman requested the
Board's approval on a Notice of Violation for Wyandot for 4
violations. Director Timmerman recommended a $4,000.00 fine on the 4
violations. (findings attached) Director Urban made the motion to
approve the Notice of Violation with a $4,000.00 fine, seconded by
Sewage Office Manager Goldman and carried unanimously.
TRAFFIC SIGNALS
Director Urban on behalf of City Engineer Miller said that the traffic
signal at Hamburg Pike and New Albany/Chas. Road gets thrown off,
sometimes causing all sides to have a green light. He said
approximately S15,000.00 is needed to repair the light. The repairs
will be done by Metzger Electric. Sewage Office Manager Goldman made
the motion to approve repairing the traffic signal immediately,
seconded by Director Urban and carried unanimously. Council approval
will also be needed.

SEWER DEPT. LOAN
Mayor Galligan siad a S100,000.00 loan to the Department Of
Redevelopment is needed from the Sewer Dept. in order to buy a lot on
Spring Street, which in turn will be sold. The loan should be paid
back in 60 days. Director Urban made the motion to approve lending
the Department of Redevelopment S100,000.00 to exercise the option to
purchase the property at Spring and Maple Street, seconded by Sewage
Office Manager Goldman and carried unanimously.
Director Urban made the motion to approve the claim for the Department
of Redevelopment on the loan from the Sewer Department in the amount
of $100,000.00, seconded by Sewage Office Manager Goldman and carried
unanimously.
There being no further business to come before the Board of Public
Works and Safety, Director Urban made the motion to adjourn at 10:35

ABANDONED VEHICLE- IMPOUNDED VEHICLE
POLICY
PURPOSE
Establishes guidelines for the removal and impounding of abandoned
vehicles or parts of vehicle.
POLICY
Department personnel shall cause abandoned, or impounded vehicles
or part of vehicles to be removed to a place of safekeeping, as
authorized by state statute or local ordinance.
PROCEDURE
A. Pursuant to IC 9-22-1-11, an officer who finds or is notified
of a vehicle or parts believed to be abandoned shall attach a
Jeffersonville Police department impound sticker in a prominent
place on the vehicle, containing the following information;
date, time, make, model, license or VIN, officers name and badge
~].~er and a statement that the vehicle will be removed after 72
hours.
B. This policy shall apply to all towed vehicles that are
impounded, involved in accidents, traffic hazards, seized as
evidence, contraband, fruits or instruments of a crime, or towed-in
for any other reason by the department, unless the vehicle is towed
at the owners or operators request.
C. The following vehicles are exempt from the provisions by IC 9-
22-1-1.
1. A vehicle in operable condition specifically
constructed for operation on privately owned raceways.

2. A vehicle stored as the property of a member of the armed
forces of the United States who is on active duty assignment.
3. A vehicle located on a vehicle sale lot or at a commercial
vehicle servicing facility.
4. A vehicle located upon property licensed or zoned as an
automobile scrap yard.
5. A vehicle registered and licensed under IC 9-18-12 as an
antique vehicle.

D. If the vehicle is not removed by the owner within 72 hours after
it its tagged~ the department shall have it towed to a storage
area. An inventory of the vehicle or parts shall be conducted
the release of the vehicle to the

inventory is not necessary. Example: an accident where the driver
is present.
t. A general description of the articles of value is required on
the inventory portion of the Jeffersonville Police Tow Card.
Example: golf clubs, fishing poles, hand tools, luggage, etc. The
officer who conducts the inventory shall complete a tow card and
sign the card. The tow card shall be placed in the towed vehicle
file.
2. The purpose of an inventory is to record the contents of a
vehicle in order to safeguard the owner from theft.
3. In order to fully protect an owner, a police employee may open
any container whose contents the police employee determines can not
readily ascertain following the examination of the container's
exterior.
E. This policy shall apply to all vehicles that are towed to
protect the property right of the owner of such property and to
protect the department and its employees and the private business
having f~ustody of said vehicle from false claims of lost or damaged
Property. Photographs may be taken to describe the condition of
the vehicle.

NOTICE OF VIOLATION

LEGAL AUTHORITY
The following findings are made and notice issued pursuant to the authority vested in the City of
Jeffersonville, Indiana, under sections 50.01, 50.31, 50.32 and 50.33 of the City's Sewer Use
Ordinance. This order is based on findings of violation of the conditions of the wastewater
discharge permit issued under Sections 50.01, 50.31, 50.32 and 50.33 of said Ordinance.
FINDINGS
1. Jeffersonville, Indiana is charged with construction, maintenance and control of the
sewer system and treatment works.
2. To protect the sewer system and treatment works, Jeffersonville administers a
pretreatment program.
3. Under this pretreatment program, Chemtrusion Compounding Plant is allowed to discharge
waste to the City sewer system without an industrial permit.
Under the provisions spelled out within the Server Use Ordinance of the City of
Jeffersonvilte, under no circumstance shall wastewater be discharged to the City sewerage
system that will create interference to the operation of system. Operation of system meaning
all conveyance, pumping and treatment systems of the wastewater utility.
Chemtrusion Compounding Plant discharged an abrasive material to the City sewer system
approximately between the dates of 10/20/97 and 12/15/97. The material was back traced
through the City sewer system to Chemtmsion.
NOTICE
THEREFORE, BASED ON THE ABOVE FiNDiNGS, CHEMTRUSION COMPOUNDiNG
PLANT IS HEREBY NOTIFIED THAT:
1. It is in violation of the Industrial Sewer Use Ordinance of the City of Jeffersonville, Indiana.
Chemtrusion Compounding Plant is required to submit in writing a report stating why this
abrasive material was discharged to the City sewer system and not reported to our facility,
what has beeri done to alleviate the problem and what future measures are in place to not
allow this problem to occur again. This response is to be submitted ~vithin 10 working days.
3. Chemtrusion Compounding Plant will be responsible for the repair of all equipment
damaged from the discharge,of the abrasive material.
4. Chemtrusion Compounding Plant may be fined up to $1,000 per day per violation of the
Sewer Use Ordinance.

The following findings are made and notice issued pursuam to the authority vested in the City of
Jeffersonville, Indiana, under sections 50.31, 50.32 and 50.33 of the City's sewer Use
Ordinance. This order is based on findings of violation of the conditions of the wastewater
discharge permit issued under Sections 50.31, 50.32 and 50.33 of said Ordinance.
FINDINGS
1. Jeffersonville, Indiana is charged with construction, maintenance and control of the
sewer system and treatment works.
2. To protect the sewer system and treatment works, Jeffersonville administers a
pretreatment program.
3. Under this pretreatment program, Wyandot Incorporated was issued a discharge permit.
4. The discharge permit issued to Wyandot Incorporated contained numerical limits and
monitoring frequencies for pollutants which Wyandot Incorporated could discharge.,
Wyandot Incorporated on numerous occasions has not fulfilled the permit requirements for
monitoring the wastewater flow for the following constituents; Daily: biochemical oxygen
demand (BOD) and total suspended solids (TSS). During the month of December 1997,
Wyandots' Monthly Self Monitoring Report provides 4 instances in Which daily required
monitoring of the above mentioned constituents were not performed and no reasonable
explanation was given.
NOTICE
THEREFORE, BASED ON THE ABOVE FINDINGS, WYANDOT INCORPORATED IS
HEREBY NOTIFIED THAT:
1. It is in violation of its Industrial Discharge Permit and the Industrial Sewer Use Ordinance df
the City of Jeffersonville, Indiana.
Wyandot Incorporated is required to submit monthly a completed Monthly Self Monitoring
Discharge Report with all required permitted parameters and sample frequencies. If in any
case the permitted sample parameters cannot be adhered to, an explanation as to 'why' the
permit requiremems were not fulfilled and what steps the company plans to take to alleviate
future reoccurrences of permit violations.
3. Wyandot is required to pay $4,000 for December's violations.
