JEFFERSONVILLE, INDIANA MAY 13, 1999
Mayor Galligan called the special meeting of the Board of Public Works and Safety to order at
9:45 A M., and on call of the roll those members present were: City Engineer Bob Miller, and
Sewage Office Manager Bob Goldman.
Also present was City' Attorney Anne Marie Galligan and Clerk Suzy Bass.
CONDEMNATION HEARING
Attorney Galligan informed the Board that the special meeting was called in order to begin a
condemnation that needs to be finished as quickly as possible. On Keystone Blvd. the City built
a bridge over a CSX railroad track that bisects the property at Keystone and the bridge is a part
of Keystone Blvd. The City has to have an easement across the CSX track. After months of
inquiries, CSX has finally informed the City that they are under an injunction against conveying
any property, easements, or anything else in the State of indiana. So the only way to acquire an
easement is to condemn it. CSX actually suggested that the City do so. Attorney Galligan said
that the City did need to begin the condemnation procedure which is set out in IN Code
32-11-1.5. The first step is to pass a resolution condemning the property. Then the City will
publish notice twice in the newspaper and they will have a hearing at the Board in about three
weeks to finalize it. Attorney Galligan presented the Board with a resolution coveting the
portion of Keystone Blvd. that crosses the CSX Railroad. The motion was made by Engineer
Miller to pass a resolution condenming a roadway easement over the CSX Railroad in Keystone
Industrial Park seconded by Manager Goldman and carded unanimously.
There being no further business to come before the Board of Public Works and Safety, Manager
Goldman made the motion to adjourn at 9:50 a.m., seconded by City Engineer Miller and carded
unanimously.
