HomeMy WebLinkAbout07-08-2002MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA July 8, 2002 Mayor Galligan called the meeting to order at 9:40 a.m. Board members present were Engineer Bob Miller and Councilperson Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk. Also present were: Clerk Lynne Mayfield, Personnel Director Ellis, Wastewater Treatment Director Crawford, Police Chief Mike Pavey, Fire Chief Smith, Engineer Dixon, Building Commissioner Gavin and Vehicle Maintenance Director Drury. Clerk Treasurer Wilder presented the minutes of the June 17, 2002 meeting, the June 24th, 2002 meeting and the July 1, 2002 meeting. Mayor Galligan indicated that they would be addressed later. Claims were presented for approval. Engineer Miller made a motion to approve the claims as presented, seconded by Councilperson Walz and carded unanimously. Payroll was presented for approval. Engineer Miller made a motion to approve the payroll, seconded by Councilperson Walz and carded unanimously. ANIMAL SHELTER VENTILATION Beth Mull, 2307 Arthur Street, appeared before the Board regarding ventilation at the Animal Shelter. She said she came representing the animals and the employees at the Shelter. She said that days over 80 degrees are especially intolerable and unbearable for the animals. She said that the ventilation system would also help prevent airborne disease, as well as help control the odor, which is a deterrent to people who want to adopt. She also said that she understands the funding is limited and that she has done some research regarding grants. She would like to work with Kathy Haller in this regard. Mayor Galligan responded by saying that the city was trying to hold down costs as much as possible, and that the natural smell from the animals would cause some of the odor problems. The Mayor said he had researched a ventilation system and that it would cost approximately $20,000, and that he did not believe the City Council would fund this in the budget. He also stated that the budget had also been funded inadequately in previous years. Mayor Galligan said that bad press and public criticism was also killing the adoption rate. He told Ms. Mull that he had no problem with her following through with Kathy Haller to work on a grant for the ventilation system. Mayor Galligan and Councilperson Waiz thanked Ms. Mull for devoting her time to the project. FABRICON BOULEVARD VIOLATION Building Commissioner Gavin told the Board that he has been dealing with problems at the property at 1416 and 1418 Fabricon Boulevard owned by Lawrence and Susan Rosen since 1987. The Rosen's were not in attendance. He said that the Rosen's had been cited and fined. He presented photos that showed debris and junk items that had to be removed before the grass could be cut by city crews. He said that he had been by the property and the Rosen's are making progress but he is afraid that it will not last. Commissioner Gavin said that the office spaces are also in a state of disrepair and raw sewage is emitting from one of them. He also said he believes that new tenants have been moved in although the City has notices on doors stating that the buildings are not to be occupied. Gavin stated that this is a Class C misdemeanor, and that Mr. Rosen is aware that the buildings are not to be inhabited. City Attorney Anne Made Galligan instructed Commissioner Gavin to see the Prosecutor regarding any violations of the law. Commissioner Gavin asked the Board where he should begin with the Rosen's property. Mayor Galligan recommended that the property be cleaned up and Engineer Miller said the property should be condemned. City Attorney Anne Marie Galligan said that a notice regarding unsafe buildings should be sent. Engineer Miller made a motion that the building be condemned. Councilperson Waiz said he would need to look at the property before he could offer a second. City Attorney Galligan said the statutory notice needed to be sent and that the property owners could be given ten days to do whatever necessary to bring the property up to code, and set a hearing within the next couple of weeks. Engineer Miller withdrew his motion. 934 EAST CHESTNUT Engineer Miller said that William Hendrix, the property owner at 934 East Chestnut Street was a no-show. Commissioner Gavin informed the Board that there were items of junk ail over the Hendrix property. He requested that the City be allowed to send a crew to clean up the property at the owner's expense. City Attorney Anne Marie Galligan told the Board that a notice of violation of the Exterior Maintenance Ordinance had been sent on June 10, 2002 citing Mr. Hendrix to be present at the meeting of the July 8, 2002 Board of Public Works. She and Commissioner Gavin said that they had heard nothing from Mr. Hendrix regarding the notice. Councilperson Waiz made a motion to send City workers out to 934 East Chestnut Street to clean up the property and place a lien on the property for the expense, with a fine of $100.00 for failure to comply, seconded by Engineer Miller and carried unanimously. VETERAN' S PARKWAY CONTRACT Mayor Galligan distributed to the Board a contract from the State for the Inner-City Road, also known as Veteran's Parkway. City Attorney Anne Marie Galligan told the Board that the contract met with her approval. Funding for the project is a loan from the State in the amount of 6 million dollars for the complete project. Another 2 million dollars is to be received from KIPDA. She said that since this is a joint project between Jeffersonville and Clarksville, the contract reads for both entities. The remainder of the funding will come from the TIF, mainly for land acquisition. She said that payments to the State would not begin until three years after the completion of the project. At that time she believes the revenue to the TIF area will be significant. Engineer Miller made a motion to approve the contract as presented, seconded by Councilperson Waiz and carried unanimously. OTHER BUSINESS Engineer Miller said he appreciated the kindness shown by the employees of the City of Jeffersonville following the recent deaths of two family members. Nellie Knowland commented to the Board that there were problems in her neighborhood with fireworks on the Fourth of July. Mayor Galligan said for the most part the holiday was successful and no injuries were reported. There being no further discussion to come before the Board, Councilperson Waiz made a motion to adjourn the meeting.
