OF THE CITY OF JEFFERSONVILLE, INDIANA
SEPTEMBER 16, 2002
In Mayor Galligan's absence City Attorney Galligan called the meeting to order at 9:40 a.m. and on call
of the roll those members present were: Councilperson Waiz and Parks Director Elliott sitting in for
Engineer Miller.
Also present were: Personnel Director Ellis, Redevelopment Director Duggins, Fire Chief Smith,
Building Commissioner Gavin, Animal Shelter Director Wilder, Mark Wright with EMC, Engineer
Dixon, Planning and Zoning Director Padgett, Vehicle Maintenance Director Drury, Street
Commissioner Grant, and Clerk Cindy Gardner.
Councilperson Waiz made the motion to approve the payroll, seconded by Parks Director
Elliott and carried unanimously.
Councilperson Waiz made the motion to approve the minutes of August 19, 2002 as
presented, seconded by Parks Director Elliott and carried unanimously.
MEIGS AVENUE PROPERTY
Richard Russ spoke on behalf of Gary Speth in regard to a 7 ft. strip of property off Meigs Avenue that
Mr. Speth is requesting a quitclaim deed on from the City. City Attorney Galligan said she would need
to look at the paperwork. She asked Mr. Russ to explain what the problem is. Mr. Russ said there was a
deed from 1889 where the property was conveyed to the City of Jeffersonville accepting the strip of
property. In 1936 it was conveyed from the City back to a private entity. The best he can tell, there was
a typographical error made on the deed, which states that, the City still owns the strip of property. A
title search uncovered this and it's holding up a commercial loan. Attorney Galligan asked Mr. Russ to
get the deed to her and the Mayor would need to sign it.
ENGINEERING AGREEMENT
City Attorney Galligan asked Jorge Lanz to explain the Engineering Agreement between the
City of Jeffersonville and Jacobi, Toombs, and Lanz on the NPDES Permit. Mr. Lanz said
the Environmental Protection Agency and the Department of Environmental Management
passed new regulations that cities greater than 100,000 in populations requires a permit to
control storm water quality. Mr. Lanz said permit application has to be submitted in
Indianapolis by March 2003. He said he has been working on this and putting it together for
a year and that Clark County, City of Jeffersonville, Town of Clarksville, and the Town of
Sellersburg are all on board. A budget was set up to prepare application totaling and not to
exceed $75,000.00. Everyone's share is pro-rated based on their population to the total
amount. If not done, a fine can be imposed. Councilperson Waiz asked if the reason we went
with other cities and towns was to save money. Mr. Lanz said absolutely. Councilperson
Waiz made the motion to approve the Engineering contract with Jacobi, Toombs, and Lanz
for the Phase II Storm water Permit contract, seconded by Parks Director Elliott and carried
unanimously.
CONDEMNING RESOLUTION #30
City Attorney Galligan said that about two or three weeks ago the Board approved a
Resolution beginning the condemnation on the fireworks store and Tex Bar-B-Q building at
Tenth and Spring Streets. The required notices were sent to the Evening News telling them
the dates to publish but they published them on other dates. She said because of this the
process has to be started over. A new Resolution has been prepared with the hearing on
October 7, 2002 and asked that the Board adopt this Resolution. Councilperson Waiz made
the motion to approve the Resolution condemning the property owned by Glen Lewis at
Tenth and Spring Streets, seconded by Parks Director Elliott and carried unanimously.
There being no further business to come before the Board the motion was made by Parks Director Elliott
to adjourn at 10:00 a.m., seconded by Councilperson Waiz and carried unanimously.
