HomeMy WebLinkAbout09-09-2002MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA SEPTEMBER 9, 2002 Mayor Galligan called the meeting to order at 9:30 a.m. and on call of the roll those members present were: Councilperson Waiz and City Engineer Miller. Also present were: Safety Director Rodden, Personnel Director Ellis, Wastewater Treatment Director Crawford, Redevelopment Director Duggins, Administrator Rich Davis, Fire Chief Smith, Police Chief Pavey, Building Commissioner Gavin, City Attorney Galligan, Animal Shelter Office Manager Gartelman, Engineer Dixon, Parks Director Elliott, Mayor Assistant White, Planning and Zoning Director Padgett, Street Commissioner Grant, and Deputy Clerk Lynne Mayfield Engineer Miller made the motion to approve the payroll as presented, seconded by Councilperson Waiz and carried unanimously. Mayor Galligan asked if anyone is on the payroll that shouldn't be or that he or Personnel Director Ellis don't know about. Engineer Miller made the motion to approve the claims as presented, seconded by Councilperson Waiz and carried unanimously. FLOODING COMPLAINT Attorney David Sprawls appeared ~vith homeowner Tim Wahl in regard to the flooding problem at his residence at 1508 Brigman Avenue. He said the flooding is a result of run off water when it rains from the baseball field behind him. He said a 1/2 inch of rainfall results in 2 inches of water in his yard. Mr. Wahl said he never had a problem with this until the baseball field was redone. Mayor Galligan said he has some possible solutions to fix the problem. The Mayor said he would have Engineer Dixon take some shots of the area. Mayor Galligan said if Mr. Wahl's yard is too low he couldn't guarantee that he can fix the problem. Mr. Wahl said the city fixed their drainage problem at the baseball park but created one for him. Attorney Sprawls said they would wait to hear from the City. M]EIGS AVENUE ~ ! Attorney Richard Rush appeared with Gary Speth in regard to properly Mr. Speth owns on Meigs Avenue. Attorney Rush said there is a typographical error on the deed, which makes a small portion of his property in the City's name. He is requesting that the City quit claim this portion back to Mr. Speth. Mayor Galligan said the city would need to explore this. Engineer Miller made the motion to table this item for one week, seconded by Councilperson Waiz and carried unanimously. GRIEVANCE A grievance was filed by Sgt. Sam Veals in regard to 12 hours borrowed time he was scheduled to have taken and was bumped from. After much discussion, Councilperson Waiz made the motion to grant Sgt. Veal's a half-day's (12 hours) time as settlement for his grievance, seconded by Engineer Miller and carried unanimously. CITATION-2800 Block of Cooper's Lane Planning and Zoning Director Padgett said he has received more complaints on James Harbeson and his failure to remove the vehicles and signs from his "Golf to Go" storage in the 2800 block of Cooper's Lane. Mr. Harbeson was cited previously and has not complied. Planning and Zoning Director Padgett said he would attempt to contact Mr. Harbeson by certified mail. CITATION Building Commissioner Gavin said the property at 3625 Hamburg Pike owned by Gary Mattingly has been cited numerous times for lack of exterior maintenance and the problem has not been resolved. Building Commissioner Gavin recommended having the city clean it up and bill Mr. Mattingly's taxes. The house is not being lived in at this time. There is no electricity, the fence needs repairing and the grass and weeds need to be cut. City Attorney Galligan said the statute regarding this has changed and it can now be charged to the next tax bill and if not paid, the house can be put up for tax sale. She said it could also be cited as a fire hazard. Engineer Miller made the motion to send a notice to Gary Mattingly giving him 10 days to take care of the problem and if he doesn't comply he will be fined $100.00 per day, seconded by Councilperson Waiz and carried unanimously. CONDEMNATION RESOLUTION #27-JAMES AND LISA JOYCE/PLEASANT RUN City Attorney Galligan said the Joyce's changed their mailing address and their notice was sent to the previous address so they received no hearing notice for damages. The city had gotten an appraisal of #1,300.00 and the Joyce's appraisal was $2,500.00. Attorney Galligan recommended that the city settle with the Joyce's for a total of $2,500.00. Councilperson Waiz made the motion to approve the damage award to $2,500.00 instead of $1,300.00, seconded by Engineer Miller and carried unanimously. The check for $1,300.00 will be voided and a new one will be done for $2~500.00. PERF Personnel Director Ellis asked the Board to sign an affidavit for Mary Beth Schnatter Ackerson who worked for the City from 1961-1962 or 1963 to receive her Perf money. Engineer Miller made the motion to approve signing the affidavit allowing Mary Beth Schnatter Ackerson to receive her Perf money, seconded by Councilperson Waiz and carried unanimously. MONITORING WELL Engineer Miller made the motion to allow Chevron Oil to put their monitoring well in on 5~h Street seconded by Councilperson Waiz and carried unanimously. BRINLEY-HARDY '~ Councilperson Waiz told Mayor Galligan thanks for the work done at Brinley-Hardy on the ditches. There being no further discussion to come before the Board the motion was made by Councilperson Waiz to adjourn at 11:20 a.m., seconded by City Engineer Miller and carried unanimously. Regular vacations (i.e. three (3) or more consecutive vacation days) are based on department seniority and will be picked in increments of 3 or 6 days. First pick must be scheduled by February 15th, and second pick by March 15th of each year for that calendar year. No more than three (3) Firefighters may be scheduled for Regular vacation at one time. Individual vacation days (i.e. one (1) or two (2) consecutive vacation days) are based on department seniority and may be scheduled no more than thirty (30) days in advance. A Firefighter may not take an Individual vacation day if three (3) or more Firefighters are not working because ora Regular vacation, sick leave (not including extended sick leave of four (4) consecutive days or more), or bereavement. Single Day: The total vacation may be taken as single days.. These days are the only days that may be changed or traded, or split into 6, 12, or 24 hours. To Change or bump, 48 hours notice is required before a Firefighter is scheduled to take single day vacation time. Single vacation days may not interfere with minimum staffing requirements. A maximum of four-(4) days vacation may be carried over to the next year. Split days that require movement of personneI must be requested prior to 1900 hours. AtSer 1900 hours, the split will be denied. 25.6 25.7 25.8 25.9 Incentive Days accrued prior to January 2002 may be used for extended sick leave or for retirement. Traded Time carries no seniority. Vacation days will be accrued January 1 st of hired anniversary year. Bumping rights: After bumping if you decide to cancel the day or days you will be responsible to notify the person you bumped, if failure to do so you will be locked into that day or lose a day. After review of (article25) of the contract and roles and regulation bumping rights (vacation days) the executive board has approved Sgt. Veals grievance. This decision was based on the terminology in the contract and the roles and Regulation. The executive board per grievance procedure wishes to submit this Grievance and ask to schedule a meeting with all parties involved. Sam Veals After our discussion on Thursday, August 22nd. with the Union Executive Board, I feel that a honest mistake may have been made by Major Carter. There may have been several rules that conflict concerning this issue, and the union agreed to make some minor adjusting to prevent this from happening again. I also feel that since Sgt. Senority will prevail in full slngle days vacation and also hours of equal time. 2. In split days-vacation amount of time will prevail to greatest amount of time. 3. Funeral Leave (immediately family) will not effect ±ncentive time, Immediate family is - Wife, Children, Mother, Father, Brother, and Sister. This only reflects Incentive time. 10.,Vacations: 1. 12 hours DOES NOT bump .24 hours * la. However: 24 hours will bump 12 hrs. regardless of senority.
