HomeMy WebLinkAbout08-19-2002MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA AUGUST 19, 2002 Mayor Galligan called the meeting to order at 9:40 a.m. and on call of the roll those members present were: Councilperson Waiz and City Engineer Miller. Also present were: Safety Director Rodden, Wastewater Treatment Director Crawford, Administrator Rich Davis, Fire Chief Smith, Building Commissioner Gavin, City Attorney Galligan, Vehicle Maintenance Director Drury, Mayor Assistant White, Street Commissioner Grant, Planning and Zoning Director Padgett, Animal Shelter Director Wilder, Clerk Treasurer Wilder, Police Chief Pavey, Parks Director Elliott, Engineering Coordinator Dixon, and Deputy Clerk Mayfield. Engineer Miller made the motion to approve the payroll as presented, seconded by Councilperson Waiz and carried unanimously. FREE HEALTH SCREENING Mayor Galligan announced that there would be free health screening on Wednesday, August 21, 2002 on the 4th floor at 1:00 p.m. and at the Street Department at 3:00 p.m. The screening is free of charge. CITY INSURANCE Agent of Record Edward Culpepper Cooper distributed to the Board informational rates to be used for Budget purposes as well as payroll deduction purposes. There are two groups of people who have been paying the old rates since renewal who should be paying new rates. Mr. Cooper asked that the Board approve the 4 tier maximum rates for Cobra people. Cobra people are ones who no longer work for the City but want to remain on the City insurance. The new Cobra rates are to be effective October 1, 2002. The second tier is er~,pected rates because retirees have contributed to the non-reverting fund and given more tMn 20 years service in a lot of cases he asked that the City use expected claims liability for -etirees. The City pays 60% of their informational rates and the retirees pay 40% under the ordinance. Mr. Cooper recommended the City use maximum liability for Retirees and that these rates go into effect October 1, 2002. Councilperson Waiz asked Cooper how many people are on family and single coverage for Cobra and how many Retirees are on the single plans and how many are on the family plan. Mr. Cooper said he wasn't sure of the numbers. Councilperson Waiz said he thought that should be explored. Personnel Director Ellis said she would gather this information. Mr. Cooper said he thinks there are more retirees than people on Cobra. Clerk Treasures Wilder said the rates haven't been changed for several years so the rates have been reconfigured. The Board will vote on this next week after Councilman Waiz gets the information he requested. Mr. Cooper told the Board that Anthem Insurance turned down the City's request for a quote due to claims and size. Quotes are expected from two other companies in about 30 days. A quote has been obtained from Humana. Mr. Cooper said he has started negotiations with Clark Memorial Hospital to get an additional discount for the City because of being a governmental entity and being partially self funded. BOY SCOUTS BIKE SAFETY Ma~y Kramer spoke to the Board about a new bike safety event to be held on Saturday, August 24, 2002 at Warder Park from 9:00 a.m. to noon. She said Police support will be needed and she requested Rusty Settles be present if possible for tips on bike inspection and safety. At the end of the Bike Safety event she would like to have a bike ride downtown. Police Chief Pavey said he would put together a route for the ride. CITY BUILDING INSPECTIONS Judy Sapp appeared before the Board to voice concerns that when building inspections are done there are notations of things that are not in compliance with the Ordinances. She said there is no follow up a lot of times to make sure that violators comply with the set guidelines. She asked how a policy can be set forth to make sure that people do what they are supposed to do. She said she works with Building Commissioner Gavin and Steve Hardin by giving them information on common errors that have occurred or are occurring pertaining to accessibility issues. Examples of this are at Tinsletown Video and Subway on Charlestown Pike and she distributed photos of them She said several businesses in Jeffersonville do not have the required handicapped parking markings in blue as per State guidelines. She said when notations are made of corrections needed there should be follow-up to make sure things are done properly and corrected when improperly done. Building Commissioner Gavin said he could start entering anything that needs to be recalled into Goldmine. Many times when the final inspections are done on the buildings the parking lots are not even in. Mrs. Sapp asked how far back they would go to remedy the existing violations. Mayor Galligan said they would go back two years. Building Commissioner Gavin said it would take time. INITIAL CONDEMNATION RESOLUTION//26 City Attorney Galligan said there are two parcels of property at the end of Tenth Street at Tenth St. and Spring Street that a condemnation needs to be done on. It includes the Fireworks store on the northeastern corner and the adjacent building that used to house a Chinese restaurant and Tex's Bar-B-Q in the past. There have been attempts to contact Mr. Glenn Lewis, the owner. Phone calls to him have not been returned and he has not been notified by mail because he has a P.O. Box and certified mail cannot be delivered to a P.O. Box. However, Mr. Lewis's attorney has been contacted and will receive notice. Attorney Galligan said this is the first resolution in a four-step process. This first step is against the property itself and will be published in the newspaper twice, and then the confirming resolution will be done after the publication of notice. The hearing is scheduled for Monday, September 9, 2002. Engineer Miller made the motion to approve the initial Condemnation Resolution #26, seconded by Councilperson Waiz and carried unanimously. DANGEROUS ROAD Clerk Treasurer Wilder said she was contacted by Dennis Blake, the principal at Thomas Jefferson Elementary School about an auto accident that had occurred on Hamburg Pike by the school. He said he met with Mayor Galligan and Engineer Miller and some things were to take place but when the School Board found out that the improvements weren't going to change with the road, they decided not to reconstruct the parking lot until the changes are made with Hamburg Pike. She said there have been several accidents there. Mayor Galligan said there is an enormous amount of utilities in that area and he has tried to get them moved so that the problem can be dealt with but he hasn't had any luck with the utility companies. The Mayor said he plans to do some work on this problem this year and part next year. The utilities involved are Cinergy, Ameritech, and Insight Cablevision. The City Attorney suggested that Mr. Blake call the utilities and then if no action is taken after contact he might consider publicity of the matter. SIDEWALK RAMPS Judy Sapp asked about ramps to sidewalks. She said there s a business on Spnng Street t at is attempting to make their building compliant to the ADA. They have a small step in front of their building that they want to smooth out flush to the sidewalk. She asked how much a variance would the City allow for this. Mayor Galligan asked her what she was talking about. Building Commissioner Gavin said she was referring to a case that he reported to her. The Mayor said sidewalks couldn't be blocked by ramps for liability reasons. The Mayor said if they want to cut the curb down to slope and meet all the requirements of ADA it could be done. Each situation has to be looked at individually said City Attorney Galligan and ifa business is handicapped accessible in the rear it doesn't have to be in the front. Judy Sapp voiced concerns about all things that were noted as non-compliant during an inspection (not just parking) and that businesses are given time frame to make the corrections and advise the Building Commissioner's office. She said the Building Commissioner's office should have a policy to follow up with businesses that don't comply. Nellie Knowland thanked the City for delivering dumpsters for her neighborhoods use. She requested one for the coming weekend. Engineer Miller said Conrad Moorer of Northside Christian Church asked if he could put up a directional sign at 1-265. Engineer Miller said he would get with Planning and Zoning Director Padgett on this matter. There being no further discussion to come before the Board the motion was made by Engineer Miller to adjourn at 1,0430 a.m., s~onded by Councilperson Waiz and carried unanimously.
