HomeMy WebLinkAbout02-04-2002 MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA FEBRUARY 4, 2002 Mayor Galligan called the meeting to order at 9:30 a.m. and on call of the roll those members present Were: City Engineer Miller and Parks Director Etliott. Present were: Planning and Zoning Director Jana Ecker, Animal Shelter Director Keller, Building Commissioner Gavin, Wastewater Treatment Director Crawford, Vehicle Maintenance Director Drury, Parks Director Rick Elliott, Police Chief Mike Pavey, Assistant to Mayor White, City Attorney Galligan, Safety Director Rodden, Coordinator Davis, Street Commissioner Grant, Personnel Director Ellis, Fire Chief Mike Smith, Redevelopment Director Duggins, Engineering Coordinator Dixon, and Clerk Lynne Mayfield. City Engineer Miller made the motion to approve the payroll as presented, seconded by Parks Director Elliott and carried unanimously. City Engineer Miller made the motion to approve the minutes of 1-28-02 as presented, seconded by Parks Director Elliott and carried unanimously. - · BITUMINOUS BIDS Bids were received from Liter's Inc., Asphalt Supply, Sellersburg Stone, and Gohmann Asphalt for paving materials. (Attached) Bids were received from Makowsky Oil and Jackson-Jennings Co-op for fuel. (Attached) Engineer Miller made the motion to take all the bids under advisement for 3 weeks, seconded by Parks Director Elliott and carried unanimously. HOWARD STEAMBOAT CHAUTAUOUA Yvonne Knight appeared before the Board to announce Chautauqua being held the weekend of May 18th and 19th. She also thanked the City for all their help in the past. Mayor Galligan said she has the City's continued support. SOLICITOR' S PERMIT Derrick James asked the Board's approval to go door to door from 8 a.m. to 4 p.m. passing ~--~out brochures pertaining to Fox Pools. The Board said this would be no problem. CONDEMNATION CONFIRMING RESOLUTIONS Jorge Lanzof Jacobi, Toombs, and Lanz gave a short presentation On the Inter-City Road Project. He said this is a tremendous project and very much needed. One of the properties involved is that of Resurrection Ministries. City Attorney Galligan said two appraisals were obtained. One appraisal is in the amount of $147,000.00 and the other appraisal is $157,895.00. Attorney Galligan said the Resolution would award $157,895.00 plus $20,000.00 in relocation assistance to the church. Attorney Jack Vissing appeared before the Board representing Resurrection Ministries along with several church members to remonstrate. Attorney Vissing said g written remonstrance was submitted in regard to the acquisition and to the damage sections. He said on 8~24-01 Trustees of Resurrection Ministries received on the City of Jeffersonville's letterhead an offer orS157,895.00 signed by a Clyde Hawkins purported to be a representative. He indicated in his notice a summary of options and legally protected rights including the right to object to the public purpose and the necessity. If the city files suit to condemn, three appraisals are required. He said to his knowledge none of that has happened. Attorney Vissing said a notice of condemnation was not served on the church itself. Attorney Galligan said it was done by publication. Attorney Vissing said the church had no direct notice at any time of the condemnation. The only notice they received was a hand notice delivered stating that they would be sued and an opportunity to respond. Attorney Galligan said the church should have received a hand notice of the damages and of the remonstrance heating. Attorney Vissing said the church had no opportunity to remonstrate against the taking of the property and asked that their church not be torn down. He said tearing the church down is not necessary in order to build the Inter-City Road. Attorney Vissing said it is an historic building and it is wrong to remove it. He said an appraisal was obtained from Mills, Biggs, and Haire in the amount of $259,000.00. Jorge Lanz then spoke about the environmental study that has been done and a letter that states the alignment of the project including the taking of the church were cleared as part of the project that is to be built. Mr. Lanz said if his memory serves him fight the taking of the church was not a major issue when he spoke to the Reverend Evaline. Attorney Galligan pointed out that the road was sited prior to the current administration. Reverend Evaline stated that he was never asked if the church could be taken, just told that the road would go through the location of the church. Mayor Galligan then asked Mr. Lanz if this was done according to State Highway specifications. Mr. Lanz said everything has been done by the book. Attorney Vissing asked Mr. Lanz if this church is the criteria that makes or breaks this road. Mr. Lanz said this location is the best according to the study. City Attorney Galligan recommended that the Board take this matter under advisement until March 11, 2002 to allow time to contact our appraisers and discuss the appraisals. Engineer Miller made the motion to table the condemnation until March 11, 2002 to review the appraisals, seconded by Parks Superintendent Elliott and carried unanimously. CONDEMNATION CONFIRMATION RESOLUTION City Attorney Galligan said the property adjacent to Resurrection Ministries owned by Mr. and Mrs. Rueffis also being condemned for the Inter-City Road project. The damages that were awarded in the first resolution are $30,000.00 and the City has appraisals of $21,200.00, $28,000.00, and a review appraisal of $30,000.00. Mr. Rueffsaid for $30,000.00 this destroys him and his property. He said he feels like he is being persecuted for a crime he didn't commit. He said traffic is already a problem and now a road with a curve is to be put at the top of a blind hill and a stoplight. He said cars would be in his front yard. Mayor Galligan said he looked at trying to change the location of the road to the rear of the property but it can't be done because of the railroad tracks. Mayor Galligan said he has looked at many alternatives. He said the road needs to be built for traffic load that is becoming horrendous. Mrs. Rueff said she agrees with her husband on the traffic problem. She said cars pass on the right side of the road and end up going into her yard. Mr. Rueff said his property wouldn't be worth anything after this road is in. City Attorney Galligan said the property would be worth a great deal as commercial property. Parks Director Elliott made the motion to table this condemnation until March 11, 2002, seconded by Engineer Miller and carried unanimously. Mayor Galligan stated that he spoke with the Reverend Evaline two or three years ago and let him know the plans for the road. He said he told him that every option has been looked at and that the location chosen was dictated by Federal guidelines. Reverend Evaline said he didn't remember what all was said because it's been so long. Mayor Galligan said he's sorry this is happening tO the church but this project has been in the works for a long time. There being no further business to come before the Board of Public Works and Safety, City Engineer Miller made the mOtion to adjourn at 10:40 a.m., seconded by Parks Superintendent Elliott and carded unanimously.
