OF THE CITY OF JEFFERSONVILLE, INDJANA
AUGUST 21, 2000
Mayor Galligan called the meeting to order at 9:30 A.M., and on call of the roll those
members present were: City Engineer Bob Miller, and Councilperson Frantz.
Also present were: Building Commissioner Lar[y Decker, Wastewater Treatment
Director Traylor, Vehicle Maintenance Foreman Mike Ewton, Safety Director Rodden,
Redevelopment Assistant Director Duggins, Planning and Zoning Director Ecker, Street
Commissioner Grant, Asst. Wastewater Treatment Plant Director Wilkey, Councilperson
Walz, Animal Shelter Director Keller, Parks Superintendent Elliott, Police Chief Pavey,
Fire Chief Mike Smith, and Clerk Lynne Mayfield.
City Engineer Miller made the motion to approve the payroll as presented, seconded by
Councilperson Frantz and carried unanimously.
RIVERFRONT PROJECT
Jorge Lanz of Jacobi, Toombs, and Lanz asked the Board to approve a Change Order for
a $53,000.00 credit. Engineer Miller made the motion to approve the Change Order,
seconded by Councilperson Frantz and carried unanimously.
PLEASANT RUN PROJECT-DIVISION B
Jorge Lanz of Jacobi, Toombs, and Lanz told the Board that a sanitary sewer intemeptor
needs to be installed on the Pleasant Run Project but REMC's power poles impede this.
REMC does not want to jeopardize the safety of it's personnel or equipment. REMC also
does not want to be responsible for any damages that might be caused by the blasting.
Hall Contracting has looked at the situation for a way to brace the poles but thinks it
cannot be done because of the amount of blasting required to excavate the trench for the
sewer. Hall thinks the sewer should be moved to the opposite side of the road. Mr. Lanz
said the sewer can't be installed along the opposite side of the road because of the
existence of a water line and the regulatory requirement of 10 ft. horizontal separation
between water and sewer. K and I Construction would like to find an alternative other
than blasting. Mayor Galligan suggested that K and I get with the blaster and try to work
something out.
AMERICAN HEART WALK
Jennifer Riley asked the Board to approve closing the Second Street Bridge on September
16, 2000 from 9-10 a.m. for the American Heart Walk. Engineer Miller made the motion
to approve the closure frbm 9-10 a.m., seconded by Councilpers°n Frantz and carried
unanimously.
STOP SIGN REQUEST
Ivan Dinger of 1816 E. 8th Street requested a stop sign on 8th Street between Roma
Avenue and Goyne Avenue for safety reasons. Mayor Galligan said he would look into
this and see what options there are.
BESTWAY TRUCKING
Planning and Zoning Director Jana Ecker said that Bestway Trucking has requested an
extension on the violation given them in regard to complaints about dust from their
parking lot pending the outcome of litigation they are in at the present time. Mayor
Galligan said Bestway Tmcking is donating a right of way for the Inter-City Road
Project and are involved in a lawsuit over the property. As soon as the litigation is over
the parking lot will be moved. Mayor Galligan said that for the time being, dust oil can be
put down on the parking lot to hold down the dust.
There being no further business to come before the Board of Public Works and Safety,
City Engineer Miller made the motion to adjourn at 10:15 A.M., seconded by
Councilperson Frantz and carried unanimously.

Dear Jay:
A couple o£ days ago we discussed the above referenced project, and the fact that your power
poles impede the installation of a samcary sewer interceptor within the public right-of-way along
the north side of Chariestown Pike, from Utica-Sellersburg Road to about 450 feet south of King
Road.
I understood you to say that you had sent your Contractor, Hall Contracting, to look at the
situation and figure out how to brace the poles, and that Hall had reported that it could not be
done because of the rock blasting that will be required to excavate the trench for the sewer, and
that the sewer should be moved to the opposite side of the road.
Please note that we cannot install the sewer along the south or opposite side of the road because
of the existence of a water iine, and the regulatory requirement of 10 feet horizontal separation
between water and sewer.
I cannot understand why temporary bracing cannot be installed to support your poles.
K & I Construction will be contacting you immediately about this matter. We respectfully
request your cooperation in finding a solution to this conflict so that we can install the sanitary
sewer.

I had a phone conversation this AM with Mr. Vick ofK & I Construction, and since that time I
have received a copy ofyou~ letter dated from 081700 f~om Mr. Viclq and also have received
such letter by mail. Per my phone conversation ~ AM with Mr. Vick, we had scheduled a
mcciin~ on site for Monday 082100 ~ 9 AM. Since that time I have receivcd a message, from a
uip to our officc by Mr. Vick, that K & I Construction is to proceed with the blasgng excavation
for this project, as scheduled, starting 7:30 AM on Monday 081700. To do so is at the detriment
of you and your a~ents.
Enclosed I have attached a copy cfa letter sent to Brian $. Dixon, P.E. With OMNI Engineering,
Inc. Dated 052200.
The RI~MC and/or it's a~nts cannot and will not jeopardize the salty of it's personnel and/or
equipment to pursue your current outlined course of actions on this project. Should you continue
your proposed outlined course of actions, ti~ responsibilities ancot consequ~nc~ are th~ full
burden of you and/or yottr agents.
The REMC serv~ notice to you and/or your agents that you should not follow through with any

Dear Mr. Dixon:
Per our phone conversation we have reviewed your request to brace our existhlg 3-phase utility
poles on the west ~ide of Chaflestown Pike. Our understanding is your request is ao your
contractor may excavate 12 to 15 feet in depth at the base of our poles. We have b~. able to
honor tach a request in the past by u)ili~Jng our digger derrick trucks to winch offat the base of
the pole and balance the top of the pole with the pole claw at the e~d oftbe boom. This was a
possible scenario when mechanical excavation means were ~. Our understanding is you
now request bracing for a scenario where blasting excavation is the means you hoed to u!!__'!i~,e? I
do not see any way posm'ble we can brace our pole for your blasting scenario.
We turned to Hall Contra~fing, a I/ne co~',~uctien company out of Louisville, KY, for a
op/nion. Per a site review with Mr. lohn Gunning of Hall Contracting, we are in agreement that
bracing the poles for blasting excavation this dose to our poles is a physical impo~m'bility. It is
our rocommendation that your proposed route of const~c~ion be relocated across the road or to
a more suitable Iocatioo away ~'om our pole line. Should you insist on utilizing your proposed
route of construction, anaagementa should be made with us to study the po~ibility oftbe ILEMC
relocating our facilities. Should you chose the REMC to relocate our facilities, we will prepare a
eos~ estimate for reimbursement and request your ass~sUmce in scouring adequate right-of-way for
the relocation.
Please contact me so we may proceed in the direction which best meets your requirements.
