HomeMy WebLinkAbout06-19-2000MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA JUNE 19, 2000 In Mayor Galligan's absence, City Engineer Miller called the meeting to order at 9:30 A.M., and on call of the roll those members present were: Street Commissioner Grant sitting in for City Engineer Bob Miller, and Councilperson Frantz. Also present were: Building Commissioner Larry Decker, Vehicle Maintenance Director Mike Ewton, Planning and Zoning Director Jana Ecker, Councilperson Ellis, Wastewater Treatment Director Traylor, Redevelopment Assistant Director Duggins, Personnel Director Ellis, Animal Shelter Director Keller, Police Chief Pavey, Fire Chief Mike Smith, and Clerk Lynne Mayfield. Street Commissioner Grant made the motion to approve the payroll as presented, seconded by Councilperson Frantz and carried unanimously. RIVERFRONT LAWN TERRACE Nathan Grimes of Jacobi, Toombs, and Lanz presented a Change Order in the amount of $67,686.00 for approval on the Riverfront Lawn Terrace to re-design one of the walls. The City's portion is 20% of the total amount. Street Commissioner Grant made the motion to approve the Change Order, seconded by Councilperson Frantz and carried unanimously. 1408 E. 8TM STREET Lori Eskridge requested a resident only parking sign in front of her home at 1408 E. 8th Street. Police ChiefPavey will check out the location. OPEN STORAGE Mr. Raymond Donhauer of 647 Main Street complained about h~s neighbor s ope storage at 649 Main Street. Building Commisisoner Decker will look into. RESIDENT PARKING Bob Crawford of 705 Short Jackson requested a resident only parking sign. Police Chief Pavey will look into it. HANDICAP PARKING Mary Callahan of 811 Colonial Park Drive, Apt. 1 requested an additional handicap parking sign. Street Commissioner Grant said he will check it out. REFUSE PROBLEMS Pete Henley spoke to the Board about refuse problems from businesses on Spring Street. (list attached) City Engineer Miller said it would be looked into, PEDDLERPERMiT Julia Fawcett appeared before the Board requesting a peddler permit to sell student handbooks and children's books door to door from 8:00 a.m. to 7 p.m. Councilperson Frantz made the motion to approve the peddler permit, seconded by Street Commissioner Grant and carried unanimously. 417 W. MAPLE STREET Building Commissioner Decker recommended that Ms. Muncy be given 30 days to get a quitclaim deed by the date of 8-1-00 to start the necessary work at 417 W. Maple Street. If Ms. Muncy doesn't acquire it by 8-1-00, Mr. Muncy will be fined $200.00 per day. Each month will be totaled and billed and if it is not paid, a lien will be assessed on the property for that month until he is in compliance. Councilperson Frantz made the motion to approve Building Commissioner Decker's recommendation, seconded by Street Commissioner Grant and carded unanimously. 639 MAIN STREET Building Commissioner Decker presented to the Board a summary of actions taken in regards to the property at 639 Main Street owned by Kevin Abrahamson. After much discussion, Councilperson Frantz made the motion to approve Building Commissioner Decker's recommendation to give Mr. Abrahamson until 8-1-00 to finish the exterior work, thereafter he will be fined $200.00 per day for each day of violation, at which time the fine will be totaled and billed to Mr. Abrahamson and if not paid in 30 days a lien will be assessed on the property, seconded by Street Commissioner Grant and carried unanimously. This order will be recorded with the County Recorder. PLANT SAMPLER REPLACEMENT Wastewater Treatment Plant Director Traylor requested approval to pay for the replacement of the Influent and Effluent samplers. Replacement is needed due to the failure of the existing samplers that are 10 years old. The cost of the replacement is $8,672.00. Street Commissioner Grant made the motion to approve the replacement in the amount of $8,672.00, seconded by Councilperson Frantz and carried unmfimously. FORCE MAIN BID Street Commissioner Grant made the motion to allow L.D. Rice, the Iow bidder on the project to close halfofN.A. Chas. Pike on Saturday, June 24, 2000 to do an open cut, seconded by Councilperson Frantz and carried unanimously. AUCTION Vehicle Maintenance Supervisor Ewton reminded the department heads to get their auction items together. The auction is to be held sometime in July. SALE OF MOWER Councilperson Frantz made the motion to approve selling an old mower that the Vehicle Maintenance had for $100.00, seconded by Street Commissioner Grant and carried unanimously. There being no further business to come before the Board of Public Works and Safety, Street Commissioner Grant made the motion to adjourn at 10:45 A.M., seconded by Councilperson Frantz and carried unanimously. ATTEST: CLE~ TREASURER 417 West Maple Street Agreed to proposed schedule of correction approved on 1/20/00 as of today 6/19/00 no progress. Meet with Mrs. Muncy on 6/14/00 she will work with us after she gets quick claim deed. This order will be recorded at the County Recorders Officer. RECOMMENDATION Give Mrs. Muncy 30 days to get quick claim deed and to start a workable schedule. If no results by 8/1/00 a $200 fine per day will be levied. Each month will be totaled and billed if not paid a lien will be assessed on property for that month until in compliance. City Attorney Sedwick re-issued this order with tkreat of City doing work with a lien placed against property. Commissioner Pinkston cited Mr. Abrahamson for unsafe building on 11/3/99. (As you can see 1 year without, any work done to house) 10/3/96 to 10/16/97. Board of Public Works and Safety, Commissioner Pinkston spoke to Mr. Abrahamson and agreed to speak on his behalf to remove back part of house. Commissioner Pinkston sent letter that still not in compliance, gave 10 more days also noted work had been done on inside. (No permits or inspections), Cited to Board of Works for i/5/98 for non-compliance. BPW&S levied a fine of $I00.00 pay until compliance. This was hand delivered by officer Lougn #103. No action was taken. Letter from attorney Vissings agreeing with decision but pleaded for time due to winter. City Attorney to contact attorney Vissing. Change in Commissioner's no follow up until 4/30/98, was not aware of problems. Complaint on car and debris Commissioner Decker sent letters stating many cites and warnings without any results, left no alternative to cite to BPW&S. Grass cu/ting letter and to appear before BPW&S. BPW&S ordered rear of building down with in 30 days also to meet with Commissioner Decker for schedule of completion to front. City cut grass and billed Mr. Abrahams0n $200 (NO receipt oi'Payment). 12/7/98 12/10/98 4/8/99 5-8-99 6/1/99 Sonletime in July 8/19/99 on or about 9/5/99 11/15/99 on or about 11/25/99 12/1/99 12/13/99 12/23/99 12/29/99 Complaint from neighbors on condition of property, toilet on front porch, debris scattered, windows broke, doors open for kids to get in, no floor in some rooms. Cited Mr. Abrahamson for 1990 unsafe bulldog 1/25/99. BPW&S ordered rear of house down within 30 days. His attorney Mr. Leveritt suggests he comply with order. No progress No progress Cite BPW&S for non-compliance fail to attend meeting. BPW&S decision City would remove rear of structure in 30 days with bill and $1000 fine also remaining building to have siding by 7/1/99. Mr. Abrahamson removed rear of house Neighbors complaint about condition of house. Meet with Mr. Abrahamson on site to establish a schedule of exterior and interior compliance in the presents of Mr. Gavin no commitment from Mr. Abrahamson. Cite to BPW&S 12/13/99. Meet with Mr. Abrahamson to set up a schedule of repairs in the present of Mr. Gavin, no progress. TOld Mr. Abrahamson to meet me on 12/1/99 and I would give him a schedule. Meet with Mr. Abrahamson in the presents of Mr. Morris and gave him a schedule, at that time I told him this is What I will present on December 13th BPW&S meeting and if he had an alternate to present it at that time. In the absent of Mr. Abrahamson the Board voted to adopt my schedule with possible removal of house if not complied with schedule~ Letter sends that day .notifying him of decision. Attorney Voelker, Mr. Abrahamson sent me a letter stating Kevin is doing best he can and didn't receive a letter until 12/14/99 (This was a letter stating results of the meeting he should have attended). Reply to Mr. V0elker I intend to implement order. Dec. 99 5/16/00 5/19/00 Mr. Abrahamson got electrical, HVAC, Plumbing permits, and no inspections as of today 6/19/00. Cite to the BPW&S for non-compliance See pictures, toilets on front porch with' flowers RECOMMENDATION For violation of or 105.105 Exterior Maintenance, siding, gutters, p A $200 fine for each day of violation, will start o~ch month of non-compliance the fine will be totaled and bille&to'~r. Abrahamson and if not paid in 30 days a lien will be assessed on the proper~y. The max/mum fine should not exceed the fair market value of house. This order will be recorded with the County Recorder.
