HomeMy WebLinkAbout07-23-2001 �v 7-0?y—ba MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA JULY 23, 2001 Mayor Galligan called the meeting to order at 9:30 a:m. and on call of the roll those members present Were: City Engineer Miller and Councilperson Frantz. Also present were: Safety Director Rodden, Planning and Zoning Director Jana Ecker, Wastewater Treatment Director Traylor, Animal Shelter Director Keller, Parks Director Rick Elliott, Personnel Director Ellis, Administrator Rich Davis, Fire Chief Smith, Building Commissioner Gavin, Street Commissioner Grant, Wastewater Collection Supervisor Wright, Councilperson Wilson, Police Detective Thompson, City Attorney Galligan, and Deputy Clerk Lynne Mayfield. Engineer Miller made the motion to approve the minutes of 7-16-01 as presented, seconded by Councilperson Frantz and carried unanimously. Engineer Miller made the motion to approve the payroll as presented, seconded by Councilperson Frantz and carried unanimously. 206 MARTIN CIRCLE Eddie Greene appeared before the Board again in regard to working on cars at his mother's residence at 206 Martin Circle. Planning and Zoning Director Ecker said there have been numerous complaints again recently. This item was tabled last week until Mayor Galligan returned. Mayor Galligan said that Mr. Greene is essentially running a business from his mother's home, which is not permitted in a residential area. Mr. Greene said he was not running a business from his mother's home, but that he just liked to work on cars and he fixes them up for himself. Mayor Galligan asked if he owned the two trucks. Mr. Greene stated he did. Mayor Galligan asked if he bought the cars, towed them to his mother's house, fixed them up and then sold them again. Mr. Greene stated that was correct. Mayor Galligan asked if he was a non- profit organization. Mr. Greene stated he was not; he was trying to make money. Mayor Galligan told him that from what he had described, he was running a business and he needed to go and rent a commercial location and stop repairing cars at his mother's house. Mrs. Ecker stated this could not even be considered a home occupation, as he did not live there. Mr. Greene said he would like to get in writing something from the City stating that he's not to work on cars at his mother's residence and said he may consult a lawyer. After much discussion, Engineer Miller made the motion to give Mr. Greene 30 days to relocate his vehicles and equipment, seconded by Councilperson Frantz and carried unanimously. �l. SOLICITOR'S PERMIT Barry Fisher of A and B Sales which sells home cleaning products asked for a peddler permit to sell door to door. Councilperson Frantz made the motion to approve the permit, seconded by Mayor Galligan and carried unanimously. DRAINAGE Councilperson Wilson along with Mellwood Subdivision residents Rick and Cindy Bedwell and Jane Hop appeared before the Board in regard to drainage problems. Mr. Bedwell said that every time it rains he has water standing in his yard that attracts mosquitoes and crawdads. Ms. Hop appeared on her son's behalf and said that during the heavy rain on Sunday, July 22°d her son's house was flooded and had six inches of water and mud throughout it. She said carpets were mined along with other items. His homeowner's insurance will not pay for this damage. Mayor Galligan agreed that there is a problem with drainage in the subdivision because of the way the subdivision was built. He said he doesn't have the funds to totally correct the problem. City Attorney Galligan suggested that the residents appeal to the City Council for more money for drainage. The Mayor said he would start doing some work in the subdivision this year to try to alleviate some of the problem. He said an engineer would be sent out to look at it. Councilperson Wilson said some residents are concerned about the overflow of water from Jeff High where work is being done. Mayor Galligan said it hasn't been seeded yet and really needs another detention basin. w There being no further discussion to come before the Board the motion was made by Councilperson Frantz to adjourn at 0:40 a.m., seconded by gineer Miller and carried unanimously.
