COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
December 18, 2006
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.
on Monday December 18, 2006.
Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the
meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk
Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand
as Councilperson McCauley gave the invocation. Mayor Waiz then asked all those
present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, and Phil McCauley.
Absent: Councilperson Ron Grooms.
Following discussion, Councilperson Perkins made the motion to approve the
agenda with the removal of agenda item #14, second by Councilperson Fetz, passing on a
vote of 6-0.
Mayor Waiz presented the minutes for consideration by the Council. Council
President Wilson made the motion to approve the minutes of December 4, 2006, (5 :30
P.M.) as presented, second by Councilperson McCauley, passing on a vote of 6-0.
Councilperson McCauley asked that "a Charlestown Town Council member" on page 3
ofthe December 4,2006 (7:30) minutes be removed. Council President Wilson made the
motion to approve the minutes of December 4,2006 (7:30 P.M.) as corrected, second by
Councilperson Sellers, passing on a vote of 6-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council,
explaining two additional claims. Councilperson Perkins made the motion to approve the
claims and the two additional as presented, second by Councilperson McCauley, passing
on a vote of 6-0.

PUBLIC COMMENT:
Mr. Tom Yingling appeared before the Council wishing all a Merry Christmas
and expressing his appreciation for the invocation given by Councilperson McCauley.
Mr. Yingling reviewed her pursuit of records, asking the Council to approve Attorney
Greg Fifer to release records regarding annexation. He delivered a letter requesting
records to the Council and Clerk Treasurer Wilder last Friday. Mr. Yingling referred to a
newspaper article regarding an anticipated $1,000,000 shortfall to the City. He asks how
the City will be able to provide services to the proposed annexed areas.
Mr. Charlie Milburn wishes all a Merry Christmas and a Happy New Year. Mr.
Milburn presented a copy of a news article regarding the poor in American (attached).
He read a comment regarding the $1,000,000 shortfall as "not pretty". He feels increases
to property taxes due to annexation are "not pretty".
Mr. R. Summers suggests the Council approve an amendment to help those who
cannot afford property taxes. He asks the Council to reconsider their position on
annexation. He asks the Council not to force people out of their homes.
Mr. Dustin White gave a year-end report on the Commission On The Social
Status Of Black Males. Councilperson Sellers asked if those participating would be
tracked. Mr. White said they would.
Mr. Derek Spence requested an update on the proposed Fire Station projects as
the bids came in higher than anticipated.
COUNCIL COMMENT:
Councilperson Perkins made the motion to provide the names and addresses of
those in the proposed annexed area, as they are compiled, to the public, second by
Councilperson Zastawny. Councilperson McCauley explained these names and addresses
are not required at this time. Clerk Treasurer Wilder explained her office does not have
copies of deeds. Attorney Fifer explained a map has been provided; the other
information Mr. Yingling has requested has never been filed in the Clerk Treasurer's
Office. He feels the map is clear. He will however give Mr. Yingling a list and file one
with the Clerk Treasurer. He will waive the work product privilege. He does not have
deeds. The motion passed on a vote of 6-0.

Councilperson McCauley also has a concern for the poor. The numbers clearly
show property valued at $100,000 or less will not have an increase in property tax due to
annexation. It does not help to say people will be put out of homes. The Council is not
out to adversely affect the poor.
Councilperson Fetz asked City Attorney Les Merkley to give a Fire Station
update. Attorney Merkley explained the one bid request included three separate projects.
Station #4 and City Garage are O.K.; Station #2 will be cut back. Mayor Waiz said there
would be no training tower. Councilperson Fetz explained most cuts were aesthetics; the
needed facilities are still in the plans.
AGENDA ITEMS:
Clerk Treasurer Wilder presented Ordinance No. 2006-0R-71, An Ordinance
Fixing Basic Salaries Of Elected Officials Of The City Of Jeffersonville, Indiana For The
Year Of 2007. Councilperson Perkins made the motion to pass Ordinance No. 2006-0R-
7J on the second reading, second by Council President Wilson, passing on a vote of 6-0.
The final reading will take place Friday, December 30, 2006 at noon.
Councilperson McCauley made the motion to pass Ordinance No. 2006-0R-73,
An Ordinance Of Additional Appropriation (Clerk Treasurer Travel & Computer
Programming) on the second and third readings, second by Councilperson Perkins,
passing on a vote of 6-0.
Councilperson Perkins made the motion to pass Ordinance No. 2006-0R-74, An
Ordinance Of Additional Appropriation (City Attorney Travel) on the second and third
readings, second by Councilperson Sellers, passing on a vote of 6-0.
City Attorney Merkley explained the need for passage of Ordinance No. 2006-
OR-75, An Ordinance Establishing A Beautification Committee Non-Reverting Fund.
Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2006-
OR-75, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson
Perkins then made the motion to pass Ordinance No. 2006-0R-75 on all three readings,
second by Councilperson Zastawny, passing on a vote of 6-0.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer Comments.

Councilperson Zastawny said that, although he missed the last meeting, he does
support the Council's vote to deny the request for rezoning by Sprigler. Councilperson
Zastawny feels the Council should look to raise the salary of the Mayor if annexation
takes place.
Councilperson McCauley attended a long cooperative meeting regarding the
comprehensive plan that included the fringe. A lot was accomplished and he is glad to
see it is moving along.
Council President Wilson thanked all for coming, as it is nice to have all here.
