AN ORDINANCE AMENDING OR[)INANCE NO. 2006-0R-.72 AN ORDINANCE
ESTABLISHING A JEFFERSONVILLE BUILDING AUTHORITY CAPTIAL
IMPROVEMENT RESERVE FUND AND A JEFFERSONVILLE BUILDING
AUTHORITY OPERATING NON-REVERTING FUND
WHEREAS, the City of Jeffersonville Building Authority (the "Authority") is
organized under the provisions of Indiana Code 36-1-13; and;
WHEREAS, the City of Jeffersonville (the "City") has entered into a lease with
the Authority to lease the premises commonly called the Jeffersonville City Hall at
Quartermaster Court located at 500 Quartermaster Court in Jeffersonville, Indiana;
and
WHEREAS, the lease between the City and the Authority includes payments
for purposes of operating expenses for the Jeffersonville City Hall; and
WHEREAS, the Jeffersonville Building Authority deems it necessary to have
funds available for the purposes of paying operating expenses and for capital
improvements; and
WHEREAS, it is economically desirable to create such fund for the
operating ~xpenses for the Jeffersonville City Hall and for the long term management
and maintenance of the Jeffersonville City Hall; and
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of Jeffersonville, Indiana, as follows:
1. A special Jeffersonville Building Authority Operating non-reverting fund is
hereby established for the purpose of paying operating expenses for the
Jeffersonville City Hall and the Jeffersonville Building Authority Capital'
Improvement Reserve Fund is hereby established for funding capital
improvements to the Jeffersonville City Hall.
2. One fund shall be entitled "Jeffersonville Building Authority Operating Non-
Reverting Fund and one fund shall be entitled "Jeffersonville Building
Authority Capital Improvement Reserve Fund.
3. That those lease payments made by the City to the Authority for purposes
of paying operating expenses for the Jeffersonville City Hall shall be
deposited into the "Jeffersonville Building Authority Operating Non-
Reverting Fund and the annual reserve fund payments shall be paid into
the "Jeffersonville Building Authority Capital Improvement Reserve Fund;
and
4. The monies may be expended from either fund only upon the filing of a
proper claim in issuance of a warrant for payment by the Clerk-Treasurer
after appropriation by the City Council except the monies in the said non-
reverting fund shall be soley expended for the funding of capital
improvements to Jeffersonville City Hall as deemed appropriate by the
Jeffersonville Building Authority.
5. That the Board is hereby required to use these Non-Reverting Funds to
the extent and in the manner allowed by law.
This Ordinance shall be in full force and effect from and after its passage and
approval.

NON-REVERTING FUND

WHEREAS, the City of Jeffersonville Building Authority (the "Authority") is
organized under the provisions of Indiara Code 36-1-13; and;
