HomeMy WebLinkAbout2006-OR-58 -Tabled-Personal Leave Bank Policy ORDINANCE NO. 2006-OR- 58 BEFORE THE COMMON COUNCIL FOR THE CITY OF JEFFERSONVILLE, INDIANA AN ORDINANCE ESTABLISHING PERSONAL LEAVE BANK POLICY PERSONAL LEAVE BANK POLICY 1. DEFINITIONS a) Personal Leave Bank - A bank formed by voluntary contribution of employees to provide employees with additional personal leave when an illness or disability occurs that requires extended hospitalization or home confinement for the employee or in'immediate family member of the employee. b) Catastrophic Illness - An illness not consistent with ordinary illness, (e.g., cancer, heart attack, stroke, major surgery), and requiring absence from employment in excess of 15 days. c) Disability - Catastrophic Illness or serious accident, or injury disabling an individual or an immediate family member from employment for more than 15 working days as reported by a physician. d) Serious Accident - Accident requiring extensive and intensive hospitalization or at home care and disabling an individual or an immediate family member from performing his work duties for more than 15 working days. e) Immediate Family Member - includes a spouse, child or step-child. 2. PURPOSE a) The purpose of the Personal Leave Bank is to provide employees of the City of Jeffersonville, Indiana additional income protection when a catastrophic illness/serious accident occurs, and the employee has exhausted his/her personal leave before the employee's benefit of disability insurance goes into effect. The Common Council for the City of Jeffersonville, Indiana does not intend for the Personal Leave Bank to create a contractual right, which may not be modified or extinguished in the future. Rather the Council intends to create a means of collectively protecting, to some limited extent, participating employees from the detrimental effect of leave I ". F I. without pay, due to those reasons outlined in the policy, and before the disability protection takes effect. 3. ELIGIBILITY a) Participation in the Personal Leave Bank will be on a voluntary basis. b) All participants will be required to donate a minimum of one day of accrued personal leave to the bank to participate in the bank, with the understanding that once the leave is donated, it is not refundable. Donation of days, up to a maximum of 3 days, can only be done during the open enrollment period or when the number of days in the Bank drops below 25. c) Employees may join the bank only during the period of open enrollment each year, or within 30 days after employment, if a late starter. However, the year in which this policy has been adopted employees may join the bank within 30 days after the adoption ofthis ordinance. d) Employees new to the city must donate one day of sick leave to join the Personal Leave Bank. If the number of days in the bank drops below 25, all participating employees will be required to donate a minimum of one day. e) If an employee has used all his/her personal leave when the Board of Public Works and Safety, upon the recommendation of the Director of Human Resources, calls for another donation to the Personal Leave Bank, that member will remain a member until the end of that school year. The following year, that employee may join the bank during the period of open enrollment and must donate one day to the bank to join. f) The employee cannot receive Personal Leave Bank Days if receiving Long-term Disability or Worker's Compensation. g) All accrued sick, personal and/or annual (where applicable) leave, must be used before an employee is eligible to receive days from the Bank. h) The applicant must be a regular and full-time employee of the city. i) The applicant or a member of the applicant's immediate family must be experiencing either a catastrophic illness or serious injury as defined above. j) In the event that an employee has a member of his/her immediate family with a catastrophic illness, the employee may receive up to 20 days from the Personal Leave Bank after his/her own leave has been exhausted. k) An employee who has borrowed days from the Personal Leave Bank must continue to be an active member of the Personal Leave Bank until the days have been repaid. -_..~ t-." ... ... 4. EXCLUSIONS: a) Routine pregnancy with normal delivery and no pre nor post-natal complications. b) Unusual and catastrophic personal illness or injury may be defined to exclude recurring or congenital conditions, which would lead to an employee's inability to fulfill his/her contractual obligations on a continual basis. 5. ADMINISTRATION OF PERSONAL LEAVE BANK: a) In the event that the Common Council ~erminates the Personal Leave Bank Policy, the remaining days in the Personal Leave Bank will not be refunded to the members. b) The Board of Public Works and Safety will receive and review all applications to borrow days from the Personal Leave Bank and submit a written recommendation to the Director of Human Resources within five (5) workdays. e) Members may borrow up to ten (10) days for anyone illness or injury as defined in this policy, if the personal leave days are available in the bank. f) The applicant shall repay 50% of the days borrowed. Re-payment shall occur within 18 months of the last borrowed day with at least one-half of those days repaid within 12 months of the last borrowed day. g) Members may borrow days up to the end of the year for serious injury or catastrophic illness as defined in this policy. h) If the number of days in the Bank drops below twenty-five (25) days, each participant will be required to donate a minimum of one (1) non-refundable day of accrued personal leave in order to maintain eligibility. i) The contribution will be made by completing the "Contribution to Personal Leave Bank form available from the Director of Human Resources. 6. APPLICATION PROCESS a) An employee must submit a request on the official Personal Leave Bank application and it must be accompanied by the Physician's Statement Form, completed and signed by his/her physician or the immediate family member's physician. b) The Board of Public Works and Safety reserves the rightto require a second physician's opinion. . 1. to' c) The Board of Public Works and Safety will review all applications for Personal Leave Bank days and submit its recommendation to the Director of Human Resources within five (5) workdays. The Director of Human Resources will inform the applicant of his decision within five (5) workdays from receipt of recommendation.
