COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
October 23,2006
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.
on Monday, October 23,2006.
Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the
meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk
Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand
as Councilperson Perkins gave the invocation. Mayor Waiz then asked all those present
to join him in the pledge of allegiance to the flag.
. The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Phil McCauley, and Ron Grooms.
Absent: None.
Following discussion, Councilperson Perkins made the motion to approve the
agenda with the removal of agenda item #13, addition of the Salary Ordinance, and the
addition of Council Comments after public comments, second by Councilperson Fetz,
passing on a vote of7-0.
Mayor Waiz presented the minutes for consideration by the Council. Council
President Wilson made the motion to approve the minutes of October 9, 2006, (7:30
P.M.) as presented, second by Councilperson Fetz, passing on a vote of 7-0. Council
President Wilson made the motion to approve the minutes of September 18, 2006 (5:30
P.M.) as presented, second by Councilperson Grooms, passing on a vote of 7-0.
Council President Wilson made the motion to approve the minutes of October 11, 2006
joint meeting with Redevelopment with the correction of the spelling of Kavanaugh,
second by Councilperson Fetz, passing on a vote of7-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council,
explaining three additional claims. Councilperson Perkins made the motion to approve
the claims and the three additional as presented, second by Councilperson Sellers, passing
on a vote of 6-0-1. Councilperson Grooms abstained.

PUBLIC COMMENT:
Mr. Bruce Herdt, 3016 Apache Drive, appeared before the Council to say Indian
Hills residents have paid for infrastructure. Annexation is a mixed bag. Mr. Herdt says it
is outrageous there are no sidewalks in front of Jeffersonville High School. He asks how
is it fair some areas have sidewalks and some don't?
Mr. R. Summers read a statement and presented a newspaper article regarding
poverty in Indiana. He feels some residents cannot afford more property taxes.
COUNCIL COMMENTS:
Councilperson McCauley explained chances for improvements are far better in
the City than in the County. He believes those that are in the poverty level are primarily
not property owners.
Councilperson Perkins explained vast areas do not have sidewalks. The City
continues to work on this. Councilperson Perkins said Umbaugh is beyond approach.
Councilperson Zastawny said the City would spend $500,000 this year to improve
sidewalks.
AGENDA ITEMS:
Ms. Julie McCoy appeared before the Council requesting passage of Ordinance
No. 2006-0R-59, An Ordinance Changing The Zoning Map Designation Of A Certain
Tract Of Property Described As Being Part Of Block No. 34, Key No. 19-24-078, 432
Meigs Avenue, In The City Of Jeffersonville, Clark County Indiana, From OC: Office
Commercial To DC: Downtown/Old City Commercial. Councilperson Perkins is not in
favor of a curb cut on Meigs. Following comments and discussion Councilperson
Perkins made the motion to pass Ordinance No. 2006-0R-59 with the contingency there
would be no drive down the side or a curb cut, second by Councilperson Sellers. Mayor
Waiz requested public comment. No comment was voiced. The motion passed on a vote
of7-0.
Planning and Zoning Director Chester Hicks appeared before the Council to
explain the need for passage of Ordinance No. 2006-0R-55, An Ordinance Of Additional
Appropriation (General Fund-Planning & Zoning). Councilperson Perkins made the

motion to pass Ordinance No. 2006-0R-55 on the second and third readings, second by
Councilperson Sellers, passing on a vote of7-0.
Clerk Treasurer Peggy Wilder presented and explained the need for passage of
Ordinance No. 2006-0R-56, An Ordinance of Additional Appropriation (General Fund-
Finance Department). Councilperson Perkins made the motion to pass Ordinance No.
2006-0R-56 on the second and third readings, second by Councilperson McCauley,
passing on a vote of7-0.
City Court employee Stacy Armour appeared before the Council to request
passage of Ordinance No. 2006-0R-60, A Salary Ordinance Amendment. Councilperson
Perkins made the motion to suspend the rules for Ordinance No. 2006-0R-60, second by
Councilperson Zastawny, passing on a vote of 7-0. Councilperson Perkins then made the
motion to pass Ordinance No. 2006-0R-60 on all three readings, second by
Councilperson Zastawny, passing on a vote of7-0.
City Attorney Les Merkley explained the need for passage of Ordinance No.
2006-0R-61, An Ordinance Of Additional Appropriation (General Fund-Vehide
Maintenance). Councilperson Zastawny said the police fuel reimbursement program has
been a fantastic compromise. Councilperson Zastawny then made the motion to pass
Ordinance No. 2006-0R-61 on the first reading, second by Council President Wilson,
passing on a vote of7-0.
Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2006-
OR-62, An Ordinance Of Additional Appropriation (EDIT-Police Radios). Council
President Wilson made the motion to pass Ordinance No. 2006-0R-62 on the first
reading, second by Councilperson Perkins, passing on a vote of7-0.
Councilperson Fetz presented an Ordinance establishing and implementing a
program to charge user fees for the deployment of public safety services rendered by the
City Of Jeffersonville for motor vehicle accidents explaining further research is needed.
Councilperson Fetz made the motion to table this, second by Councilperson Sellers,
passing on a vote of7-0.
Clerk Treasurer Wilder explained the need for passage of Resolution No. 2006-R-
47, A Resolution To Advertise For An Additional Appropriation (EDIT Fund-

Sidewalks). Councilperson Perkins made the motion to pass Resolution No. 2006-R-47,
passing on a vote of7-0.
CLERK TREASURER COMMENTS:
Clerk Treasurer Wilder has requested to receive reports from Humana and has
been denied. Unless the information is supplied she can no longer pay claims.
Supporting documents must be supplied. Title 36 gives the ability as well as the
obligation. There is no excuse to withhold information. She will file suit by the end of
the week. Mayor Waiz noted his concern for HIPA and decided to withhold the
information. Information to balance has been given to the Clerk Treasurer. Mayor Waiz
thought the Clerk Treasurer received the reports that were needed. Councilperson
McCauley made the motion to pass Resolution No. 2006-R-48, second by Councilperson
Sellers, passing on a vote of7-0.
COMMITTEE REPORTS:
Ms. Rachel Brown gave a report to the Council of The Ethics Commission
meeting on October 17. A letter is being prepared to send to employees and vendors.
They will meet again on November 21,2006 at 7:00 P.M.
Councilperson Grooms commended Councilperson McCauley for the excellent
job done on the EDIT report. He would like to look at this further with regard to the
request for funding for the Flood Wall art project.
Councilperson McCauley reported that EDIT funds have been used extensively to
uphold public safety, economic development, and culture. These projects will benefit the
community for years to come.
COUNCIL AND MAYOR COMMENTS:
Councilperson Grooms informed the Council that property abandoned by a
railroad has to be maintained by the railroad. There is no inventory of abandoned rails in
Jeffersonville. Homeowners may ask for damages. Recreational use is being looked
into. Councilperson Grooms will continue to track this. Mayor Waiz suggests contacting
Butler, Fairman and Seufert.
Councilperson Fetz noted at the last meeting he reported he would be bringing an
Ordinance regarding sexual offenders to the Council. He has found this to be tricky. It is
still in the works.

Councilperson Zastawny said he and his family had visited several destination
points during fall break. The experience made him ask what brings people to
Jeffersonville? He suggests promoting Riverstage, partner with steel, the Remnant Trust
and others. He suggests a contest for ideas.
Councilperson Perkins said there is a need to pay serious attention to the sidewalk
in the 400 block of East Riverside Drive.
Council President Wilson suggested a workshop on Monday, October 30 to
review the employee handbook. It was decided this was not a good time. There will be a
workshop Monday November 6, 2006.
Mayor Waiz announced Bob Hedge Park is coming along and looking good. The
Riverfront Greenway is also coming along. There will be an open house at City Hall on
November 5, 2006 from 2:00 to 5:00 P.M.
