COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
August 21, 2006
The Common Council of the City of Jeffersonville, Indiana met in regular session in
Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7 :30 p.m. on
Monday August 21, 2006.
Mayor Rob Waiz announced that the GRC 9-10 yr old girls Softball Team won the State
Championship on May 22, 2006. He presented all the team members with special
plaques and proclaimed August 22, 2006 as GRC Girls Softball State Championship Day.
Mayor Waiz announced that the 15-16 yr old boys All Star Team won the State
Championship on July 30th, 2006. He presented all team members with special plaques
and proclaimed August 23, 2006 as ' 15-16 yr old Boys All Star State Championship Day.
Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to
order. Also present were City Attorney Les Merkley and Chief Deputy Clerk Suzy Bass.
Mayor Waiz welcomed all in attendance, asking all those present to stand as
Councilperson Ron Grooms gave the invocation. Mayor Waiz then asked all those
present to join him in the pledge of allegiance to the flag.
The roll was called and those present were: Councilpersons John Perkins, Ed Zastawny,
Keith Fetz, Connie Sellers, Barbara Wilson, Phil McCauley, and Ron Grooms.
Absent: None
After discussion, the motion was made by Councilperson Fetz to add 14A - A resolution
to Advertise for Additional Appropriation in the Edit Budget for the Police Department,
seconded by Councilperson Sellers passing on a vote of 7 -0.
Mayor Waiz presented the minutes for consideration by the Council. Council President
Wilson made the motion to approve the minutes of August 7, 2006 (5:30 P.M.) as
presented, seconded byCouncilperson Perkins, passing on a vote of7-0.

Clerk Treasurer Wilder presented the claim list for consideration by the Council,
explaining two additional claims for Scott Doty and for Ma1cum Robinson for moving
labor during the move for City Hall. Councilperson McCauley made the motion to
approve the claims with the two additionals, seconded by Councilperson Zastawny
passing on a vote of 7 -0.

The following residents spoke in regards to annexation:

AGENDA ITEMS:
Sharon Marra appeared before the Council to discuss the Council's desire to continue the
curbside recycling program. She said that as of May, the County elected not to
participate in the program. She said the fees per apartment and per home are the same.
The landlords are billed for the apartment complexes. Councilperson Zastawny
questioned whether the user fees would. increase if other entities did not participate. Ms.
Marra said that the increase will probably only be about 15% and it is mainly because of
the price of gasoline.
Jack Vissing appeared before the Council with a petition to de-annex a piece of real
estate at Serenity House located at the edge of Jeff and Clarksville. Council person
Perkins asked why Clarksville doesn't ll-nnex instead of Jeff. Mr. Vissing said that 80 %
of the property is already in Jeff. He said that Mayor Waiz was in support of the /
annexing. After further discussion, the motion was made by Councilperson Perkins to
suspend the rules in anticipation of passing the ordinance on all three readings, seconded
by Councilperson Sellers passing on a vote of 7 -0. The motion was made by
Councilperson McCauley to pass 2006-0R-44, an Ordinance to Petition to De-Annex
Territory from the Town of Clarksville .and to Petition to be Annexed into the City of
Jeffersonville, seconded by Councilperson Perkins passing on a vote of7-0.
Clerk Treasurer Wilder asked that Ordip.ance 2006-0R-4l be tabled until a future
meeting. The motion was made by Councilperson Perkins to table 2006-0R-41, an
Ordinance Amending 2003-0R-18 Fixed Asset Ordinance, seconded by Councilperson
Zastawny, passing on a vote of7-0.
The motion was made by Councilperson Zastawny to pass 2006-0R-42, an Ordinance
Creating the Jeffersonville Major Moves Special Fund on the 3rd reading seconded by
Councilperson Sellers passing on a vote of7-0.
Clerk Treasurer Wilder presented 2006-0R-43, an amendment to the 2006 Salary
Ordinance, for consideration on the 2nd & 3rd Reading, adding 2 positions in her office.
The motion was made by Councilperson Perkins to pass 2006-0R-43 on the 2nd & 3rd
Reading, seconded by Councilperson Fetz, passing on a vote of7-0.
Councilperson Fetz made the motion to approve Resolution 2006-R-36 a Resolution to
advertise for additional appropriation from the EDIT Fund for $15,000.00 for SRT
Equipment, seconded by Councilperson Zastawny passing on a vote of 7 -0.
Councilperson Sellers made the motion to hire Attorney Scott Lewis to review what steps
need to be taken to review the City Hall Funds seconded by Councilperson Fetz.
Councilperson Grooms is all in favor of having the Funds reviewed but not by an
attorney. Councilperson Sellers said that Attorney Lewis' role would be to decide what
we would need for the financial review ,not to do the actual review. Councilperson
McCauley asked Attorney Merkley if the City had access to all the records needed to
complete the review. Attorney Merkley said the City would have access if we have all
of the records from Redevelopment.
Councilperson McCauley said that in his meeting with Redevelopment, they would like
to deed City Hall over to the City after all of the punch lists are completed, hopefully
within 60 days. Mayor Waiz invited the Council to go over the punch list and he will do
the same with the Department Heads.
Councilperson McCauley said that he was not in favor of hiring an Attorney to do this, as
the City should know what they want. Councilperson Perkins called for the question.
The roll was taken with Councilpersons McCauley, Grooms, Wilson, and Zastawny
voting no, and Councilpersons Perkins, Fetz, and Sellers voting yes. The discussion
continued. Hershel Frierson from Crow~ Chizek and Lucy Emison from Ice Miller
answered questions from the Council. Attorney Merkley affirmed that the
Redevelopment Bonds were paid with TIF monies and the shortfalls would come from
TIF monies. The vote was taken and on the call of the roll, Councilpersons Perkins,
Zastawny, Fetz, and Sellers voted yes to hire Attorney Scott Lewis, and Councilpersons
Wilson, Grooms, and McCauley voted no. The motion passed.
Clerk Treasurer Wilder said that the clQck for the Council Chambers is in but has not
been put up yet. She also asked MayorWaiz if Phil Wheeler could quote the cost ofthe
blinds for City Hall. Mayor Waiz said that he would be happy to get another quote.
COMMITTEE REPORTS:
Councilperson Perkins said that the facts and figures for the Fiscal Policy for the
annexation is still being gathered and when it is finished, it will be made available for aU
to look at. He hopes it will be available by September 5, 2006.
Councilperson McCauley asked Attorney Merkley to prepare an ordinance setting the
fees for the tax abatements for the next meeting.
Councilperson Grooms said that he has. asked Diane Swank to prepare a financial
statement on the health insurance showing Profit & Loss, and Expenditures & Incomes in
the near future.
COUNCIL COMMENTS:
Councilperson Perkins said that the Council pictures now hanging in the Council
Chambers will be rematted and the dates corrected.
Councilperson Sellers said the Animal Shelter will be having an open house in September
with kittens available for adoption.
Councilperson McCauley said that he appreciates all comments about annexation. He
wants to make sure everyone has all of the correct figures and facts. He felt there were
some excellent points brought forward. He does not appreciate anyone who personally
attacks the Council about their fiscal responsibility as he feels the Council is very fiscally
responsible.
Councilperson Grooms reminded all that the dedication of the football fields will be
August 20, 2006 at noon.
The Council thanked Officer Jason Jackson for being present at the meeting.
Council President Wilson said that the Riverside Drive paintings are beautiful. She also
reminded all ofthe River Breeze wine tasting on September 7,2006 at 6:00 p.m.
Council President Wilson reminded all about the Concerts in the Park on Fridays. They
have been drawing between 750 - 800 persons each night.
Mayor Waiz reminded everyone that August 29 in Mayor's night in the neighborhood
beginning at 6:00 p.m.
Mayor Waiz told everyone that he hopes to have Open House for City Hall the first
Saturday of October.
