A RESOLUTION ENDORSING TRANSFER OF THE
RIVER FALLS MOTEL TO THE JEFFERSONVILLE
REDEVELOPMENT COMMISSION
WHEREAS, the City of Jeffersonviile, Indiana (the "City") received the
property described in Exhibit "A" attached hereto and incorporated herein by
reference, commonly known as the River Fails Motel & Lounge ("River Falls"),
from River Fails, Inc., an Indiana corporation, by Warranty Deed (the "Deed')
dated November 9, 2005 and recorded November 10, 2005 in Deed Drawer in
the office of the Recorder of Clark County, Indiana; and
WHEREAS, the Deed was conveyed pursuant to an Order Approving
the Sale by Auction of River Fails Motel conducted on June 24, 2005; and
WHEREAS, the City desires that the River Fails be developed for
purposes of promoting economic development; and
WHEREAS, the Jeffersonville Redevelopment Commission (the
"Commission") is a governmental entity under Indiana law; and
WHEREAS, the Jeffersonville Board of Public Works and Safety
approved transfer of the River Falls to the Commission on the __ day of
,2005; and
WHEREAS, the River Falls is not needed for operation of any City
services; and
WHEREAS, the Commission intends to advertise and solicit request
for proposals pursuant to Indiana law; and
WHEREAS, development and renovation of the River Fails is in the
best interest of Jeffersonville's citizens.
NOW, THEREFORE, IT IS HEREBY RESOLVED that the
Common Council of the City of Jeffersonviile endorses and approves the
transfer of the River Falls to the Commission for the sum of not less than
$325,000.00, which shall be paid from any proceeds from the Commission's
sale of the River Fails.
IT IS FURTHER RESOLVED that the aforementioned sum shall be
deposited into the Economic Development Income Tax (EDIT) funds.
