Common Council Workshop
Monday, November 21, 2005
The Common Council of the City of Jeffersonville met in workshop session on Monday
November 21, 2005, in the City County Building Mayor's Conference Room. City
Council President Ron Grooms called the meeting to order at 5:30 P.M.
Those in attendance were: Councilpersons Ron Grooms, Phil McCauley, Barbara
Wilson, Cormie Sellers, Ed Zastawny and John Perkins. Councilperson Keith Fetz was
not in attendance. Also present were Mayor Rob Waiz and City Attorney Les Merkley,
Redevelopment Director Barry Cahitl, Planning and Zoning Director Chester Hicks, and
Deputy Clerk Barbara Hollis.
Council President Grooms reviewed the agenda w/th additions. Councilperson Zastawny
made the motion to approve the agenda as presented, second by Councilperson Sellers,
passing on a vote of 5-0. Council President Grooms did not vote.
No Smoking Ordinance
Councilperson Wilson introduced Dr. Adewale Troutman, Louisville Metro Health
Department Director. Dr. Troutman said the first concern is the health issue and the
second is the workers rights issue. He noted a reduction of heart attacks and no economic
impact. Louisville's ban has been in place four days with there being only a few calls
with a couple of complaints. It has been a smooth transition. Dr. Troutman urged the
Council to pass the strongest Ordinance possible. Council President Grooms questioned
the enforcement and cost. Dr. Troutman explained the health department enforces the
ban with no additional staff. The cost has been in creating materials and marketing.
Councilperson Perkins questioned the compliance. Dr. Troutman answered the
compliance has been great. This has been a two-year process. Council President Grooms
asked Dr. Troutman to comment on Section 200. Dr. Troutman said to let the health
issue be the driving force. Councilperson Sellers commented the City does not have a
health department.
Public Comment
Mr. Conrad Storz said more time is needed to work on the Ordinance. It takes a~vay
business rights.
Mr. Dan Christianson voiced his concern for enforcement and the cost.
Mr. Jason Lisovich of the Louisville American Cancer Society urged the Council to pass
the ban:

Mr. Mike Hutt said he is confused about the enforcement asking if the Police can enforce
the ban. Mr. Hutt was told the Police would be able to enforce the ban.
Mr. Mike Moore said this is a huge issue. It is an injustice not to hear the public. More
time needs to be taken. The enforcement scares him to death. He is concerned for the
loopholes.
Mr. Harry Munzer voiced his concern for enforcement and the cost. This has been done
too fast and not thought out. He believes it is theory that smoking is a problem. Mr.
Munzer said, "It just stinks".
Mr. Steve Shaffer voiced his opposition. His concern is with hotel rooms.
Councilperson Perkins reviewed proposed changes to the Ordinance. He is in favor of
the Ordinance 100% and applauds Councilperson Wilson. He does believe it is a health
issue. Many studies prove smoking is harmful.
Councilperson McCauley voiced his concern for food service industry employees.
There followed a 5-minute recess.
River Ridge UEZ
Mr. James Williams Attorney representing River Ridge and Mr. Marc Elliott, Executive
Director of River Ridge reviewed services. Following discussion, Councilperson Perkins
made the motion to pass Resolution No. 2005-R-44 A Resolution In Support Of
Jeffersonville Urban Enterprise Zone, second by Councilperson Sellers, passing on a vote
of 5-0. Council President Grooms did not vote. Councilperson Perkins then made the
motion to pass Resolution No. 2005-R-45 A Resolution In Support Of River Ridge
(INAAP) Urban Enterprise Zone, second by Councilperson McCauley, passing on a vote
of 5-0. Council President Grooms did not vote.
Review
Council President Grooms reviewed a letter from Texas Gas, a letter from Farm Bureau,
and the Bridges open house for November 29, 2005
Additional Appropriation Resolutions
Following explanation from Deputy Clerk Hollis, Councilperson Sellers made the motion
to pass Resolution No. 2005-R-46, A Resolution Of Additional Appropriation (General
Fund-Animal Shelter), second by Councilperson Zastawny, passing on a vote of 5-0.
Council President Grooms did not vote. Councilperson Sellers then made the motion to
pass Resolution No. 2005-R-47, A Resolution Of Additional Appropriation (General
Fund-Clerk Treasurer), second by Councilperson Zastawny, passing on a vote of 5-0.
Council President Grooms did not vote.
