HomeMy WebLinkAbout2005-OR-68 ORDINANCE NO. 2005-OR-68 AN ORDINANCE AMENDING SECTION 150.077 OF THE JEFFERSONVILLE MUNICIPAL CODE BE IT ORDAINED BY THE COMMON COUNCIL OF JEFFERSONVILLE, INDIANA: WHEREAS, Section 150.077 of the Jeffersonville Municipal Code provides for registration of plumbers requirement; and WIqF~REAS, the registration procedure is administered by the Office of the Building Commissioner; and wm~,REAS, Section 150.077 of the Jeffersonville Municipal Code is in need of some technical amendments to allow for greater efficiency and compliance within the re is~ration rocedure. NOW THEREFORE, IT IS I-W~REBY ORDAINED that Section 150.077 of the Jeffersonville Code is hereby amended to read as follows: Section 150.077 REGISTRATION OF PLUMBER CONTRACTORS (A) Plumbing registration required; It shall be unlawful for any plumbing contractor 9r journeyman plumber, as these terms are defined by the laws of the state of Indiana Code IC 25-28.5 to operate or engage in the business of plumbing within this city's jurisdiction without first registering with said city in the manner provided in this chapter, in order that the plumbing inspector have the records necessary to inspect the work of the persons registered hereunder. (B) Non-transferability and non-negotiability; Any registration issued under this subehapter may not be transferred, assigned, sold, or negotiated to another person, It is tmlawfifl to transfer, assign, sell, or loan such registration for the use of.any other person, firm~ or corporation to enable such person~ firm, or corporation to work on a iob without obtaining the proper license or permit. (C) No plumbing registration ghall be issued or renewed during any period a registrant is under citation by Indiana. Plumbing Commission for violation of Indiana statutes or rules or regulations of such commission; provided, however, that such registrant nhall be entitled ~o the issuance ora certificate of registration at all times that such registrant is validly licensed by such commission as a plumbing contractor, or a journeyman plumber. DRAFT COPY (D) Insurance Requiremems; (1) Each plumbing contractor actively employed, for hire in the City must, at the time application for renewal, provide the Building Commissioner with proof of liability insurance for each occurrence in the mount of $100,000/$300,000 by an insurance company licensed to do business in the state. (2) The following exceptions to this requiremem may be allowed; (a) If the registration holder is currently employed by a firm that carries insurance on the individual, and he/she does not do work for the hire in the City, be/she may retain his/her registration by renewal, that renewal bearing an indication by the Office of the Building Commissioner that this individual may not obtain permits for work within the city limits without proof of insurance, except on the premises of the firm maintainln~ the insurance. (b) If the registration holder is currently not actively engaged itn his/her trade but wishes to retain his/her registration by renewal, that registration bearing an indication by the Office of the Building Commissioner that this indivJdnal may not obtain permits for work within the cit~ limits without proof of insurance. (E) Issuance of permits; It is the responsibilit~ of registered contractors to secure permits required by the provisions of this chapter prior to commencing work. All work performed pursuant to a permit issued to a registered contractor is the sole responsibility of that contractor. No registered contractor may allow any other person to do or cause to be done any work under a permit secured by said contractor except persons in his employ. (F). Exemption; No registration under this subchapter is required for the execution or performance of the following work: (1) The performance of work in a one-family dwelling by the owner-occupant of the dwelling; provided, however, that this exemption does not apply to any person hired by the owner-occupant for compensation to assist or to perform such plumbing work on that dwe!lin.~- and that the applicant sign such waiver required by the Buitdi~ Commission; and (2) The maintenance and servicing of an existing system for the purpose of maintaining it in a Safe operating condition in conformance with the provisions of this chapter. DRAFT COPY (G) New Applicants must apply for a registration prior to any permits being issued or the start of any work. The application must be in writing to include the following; (1) The applicant's name, address, telephone number, and date of birth (2) The applicantss present place of employment (Business Name) (3) Payment of $50.00 for contractors registration fee (4) Payment of $25.00 for journeyman registration fee (5) Copy of State or,diana Plumbing Licenses (6) Photo Identification (7) Proof of insurance (Contractor Only) outlined in (E) above (H) Registration renewal; (1) A!1 registration holders will receive a notice from the office of the Building Commissioner up to six weeks prior to the expiration of (2) Registration holders must renew their registration on or before December 31 of each year. Should a registration holder fail to renew his/her registration by that date, the registration holder will incur a penalty of $30.00 so that the renewal fee will be $80.00 per year for contractor and $55.00 for journeyman. (3) Any registration renewed after the December 31 deadline will be made effective retroactively to the previous December 31 renewal deadline. A registration holder may renew his/her registration so long as each of the previous years renewal fees are paid commencing December 31, 2005. Any work performed by a registration holder who fails to renew his/her registration in a timely fashion will be deemed in violation of this ordh~ance and one performing such work will become subject to the penalties outlined in Section 150.999 of this Code. DRAFT COPY (1) The contractor's registration fee is $50.00 payable on or before December. 31 oftbe following year. (2) The ioumeyman's registration fee.is $25.00 payable on or before December 31 oftbe following year.. (3) During the time an inspector is employed by the City of Jeffersonville as a Plumbing Inspector, the Inspector's annual registration fee will be waived. The Plumbing Inspector may not practice Ins/bet respective Wade during employment with the City. (J) Revocation of Registration; In the event the plumbing license issued by the Indiana Plumbing Cm. inission to any registrant shall, at anytime, be.revoked or suspended by such commission, then and in such event the certificate of registration held by said registrant shall, become void and of no effect and shall remain void nntll such registrant is again the holder of a valid license from such commission~ DRAFT COPY This Ordinance shall be in full force and effect from and after its passage and approval. ~~, passedthis ,.~1 dayof~'-~ ,200 Robert L.
