COMMON COUNCIL OF THE CITY
OF JEFFERSONVI~LLE, INDIANA
October 3, 2005
The Common Council of the City of Je£fersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7:30 P.M. on Monday October 3, 2005.
Mayor Rob Waiz, with Deputy Clerk Treasurer Barbara Hollis at the desk, called
the meeting to order. Also present was City Attorney Les Merkley. Mayor Waiz
welcomed all in attendance, asking all those present to stand as Council President
Grooms gave the invocation. Mayor Waiz then asked all those present to join him in the
pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Phil McCauley, and Ron Grooms.
Absent: None.
Council President Grooms made the motion to approve the agenda, tabling agenda
item #11, and agenda item #15 second by Councilperson Zastawny, passing on a vote of
7-0.
Mayor Waiz presented the minutes for approval. Councilperson Wilson made the
motion to approve the minutes of the September 12, 2005 regular meeting as presented,
second by Councilperson McCauley, passing on a vote of 7-0. Councilperson Wilson
then made the motion to approve the minutes of the September 19, 2005 regular meeting,
second by Council President Grooms, passing on a vote of 7-0. Councilpersun Wilson
next made the motion to approve the minutes of the August 31, 2005 special meeting as
presented, second by Council President Grooms, passing on a vote of 7-0.
Deputy Clerk Hollis presented the claim list for consideration by the Council,
explaining two additional claims. Councilpersun Perkins made the motion to approve the
claims as presented as well as the two additional claims, second by Councilperson
Sellers. Council President Grooms called attention to the expenditures for cell phone
use. Mayor Waiz explained he is looking at another plan this week. Following
discussion the motion to approve the claims passed on a vote of 7-0.

PUBLIC COMMENT:
There was no public comment.
DEPARTMENT HEAD REPORTS:
Planning and Zoning Director Chester Hicks gave a road certification update,
answering questions.
AGENDA ITEMS:
Mr. Greg Fifer, Attorney, representing LTL Developers, requested passage of
Ordinance No. 2005-OR-54, An Ordinance Changing The Zoning Map Designation Of
Certain Tract Of Property Described As A 4.0 Acm Tract Being Part Of Survey 10 Of
The Illinois Grant Located At 1640 Kehoe Lane From RI: Low Density Residential To
R3: Old City Residential. Attorney Filer explained the area, noting the Plan Commission
gave unanimous approval. Council President Grooms made the motion to pass
Ordinance No. 2005-OR-54 under the condition the same conditions as Liberty Point are
met, second by Councilperson Sellers. Mayor Waiz asked for public comment.
Following no public comment, the motion passed on a vote of 7-0.
Councilperson Zastawny explained the changes made to Ordinance No. 2005-OR-
56, An Ordinance Requiring The Clerk Treasurer To Publish The Twenty (20) Highest-
Compensated Employees' Names Bi-Annually. Following discussion, Councilperson
Zastawny made the motion to pass Ordinance No. 2005-OR-56 on the second reading,
second by Councilperson Perkins, passing on a vote of 7-0.
Councilperson Zastawny next explained the changes made to Ordinance No.
2005-OR-57, An Ordinance Requiring The Clerk Treasurer To Publish The Twenty (20)
Highest-Compensated Contractors' Names Bi-Annually. Following discussion,
Councilperson Zastawny made the motion to pass Ordinance No. 2005-OR-57 on the
second reading, second by Councilperson Wilson, passing on a vote of 7-0.
City Attorney Merkley presented Ordinance No. 2005-OR-40, An Ordinance To
Prohibit Basketball Goals In Public Street Right-Of-Way. Councilperson Fetz explained
the changes and read the Ordinance aloud. Following discussion, Councilperson Fetz

made the motion to table Ordinance No. 2005-OR-40, second by Councilperson Sellers,
passing on a vote of 7-0.
Councilperson Zastawny presented Resolution No. 2005-R-34, A Resolution To
Advertise For An Additional Appropriation (EDIT Fund - Charlestown Pike Sidewalks).
Councilperson Zastawny presented a proposal for sidewalks on Charlestown Pike with a
map and cost estimates by section. The total project cost is estimated at $500,000. He is
requesting $350,000 hoping to have subdivisions and drainage will do some.
Councilperson Zastawny made the motion to pass Resolution No. 2005-R-34 in the
amount of $350,000, second by Councilperson Sellers. Councilperson Wilson said she
would like to add sidewalks for Perrin Lane. Councilperson Zastawny feels that is a
worthy project but feels it should be separate. Councilperson Fetz said he would like to
have a list with priorities, suggesting a committee be formed. Councilperson Perkins
agrees. Councilperson Zastawny feels the Charlestown Pike project is a safety issue.
Councilperson Sellers agrees. Council President Grooms encourages Mayor Waiz 'to
bring a package to the Council. Councilperson Fetz would like to look at the whole City.
Cou.ncilperson Wilson said the Perrin Lane sidewalks were promised years ago,
explaining the history. She has been informed the sidewalks can be done without doing
the streets. At the conclusion of all discussion, the motion to pass Resolution No. 2005-
R-34 passed on a vote of 7-0.
Council President Grooms introduced and explained Ordinance No. 2005-OR-59,
An Ordinance Of Additional Appropriation (General Fund, Common Council,
Spay/Neuter). Council President Grooms then made the motion to pass Ordinance No.
2005-OR-59 on the first reading, second by Councilperson Fetz, passing on a vote of 7-0.
Council President Grooms next introduced and explained Ordinance No. 2005-
OR-60, An Ordinance Of Additional Appropriation (EDIT Fund, Flood Wall Art),
making the motion to pass on the first reading, second by Councilperson Sellers, passing
on a vote of 7-0.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer Comments.

COMMITTEE REPORTS:
Council President Grooms introduced Evan Boggs, a Jeffersonville High School
student filming for the school television station. He then asked the other JHS
government class students to introduce themselves.
Councilperson Perkins said he has talked with David Blankenbeker regarding the
Umbaugh armexation study. The 7-area study has been started.
Councilperson McCauley said the Redevelopment Commission has received an
application for potential tax abatement.
Council President Grooms announced the fire station study committee will meet
October 12 at 10:00 A.M. The sanitation committee will meet before or after the fire
station study committee.
COUNCIL AND MAYOR COMMENTS:
Councilperson Fetz asked about a registered letter he received regarding Dutch
Lane. City Attorney Merkley said the Zoning Board would address this situation.
Councilperson Fetz has received phone calls regarding trees hanging too low over the
roads. Councilperson Perkins recommends trees in front of the old Elks building and
Applebees be taken down. A different species needs to be looked at. Councilperson Fetz
is also concerned with the sunken brinks at the intersection of Spring and Market Streets~
Councilperson Perkins voiced concerns about the lack of property assessments in
Utica Township. He and Mayor Waiz will get together on this. Councilperson Perkins
announced he would be circulating a petition to put the riverboat gaming issue on the
ballot for the May 2006 election.
Councilperson McCauley is also concerned regarding the property assessment
problems in Utica Township. Councilperson McCauley said the Tree Committee needs
clarification. The committee is not a committee to cut down, but to plant trees. He
commends the Council for the good use of the EDIT funds.
Council President Grooms thanked Officer Grimes for his attendance tonight.
Council President Grooms noted the recent passing of a good friend Ann Fowler, saying
she has served her community well, asking all to keep her in their prayers. He then called
attention to a publication on budget sawy. Council President Grooms has distributed a
form to be used when requesting an agenda item. He then reviewed upcoming dates for

Leadership Southern Indiana speakers. The Council will hold a workshop on Monday
October 17 at 5:30 P.M. He reminded all of the NAACP banquet. Council President
Grooms is in receipt of a letter from Clark County Emergency Management, calling
attention to a website.
Mayor Waiz reminded all of the sewer discussion to be held October 6, 2005 at
5:00 P.M. ~
As there was no further business to ouncil, the meeting was
adjourned 8:40 P.M.

Proposed Sidewalks on Charlestown Pike
The totaI cost to sidewalk one side of Charlestown Pike from Thomas Jefferson
Elementary school (corner of Hamburg Pike and Charlestown Pike) to Holmans Lane
(near Wilson Elementary School) is an estimated $500,000 based on Jorge Lm~z's
surveys and estimates. This estimate assumes that the city pays for 100% of this project
which wiI1 likely not be the case since developers and drainage funds shonld be available.
This sidewalk would be just over 2 miles long. This sidewalk would connect numerous
subdivisions and increase safe travel between those subdivisions and from these
subdivisions to Thomas Jeff'erson and/or Wilson School.
The first half of this sidewalk project would run down the Eastside of Charlestown Pike
from Thomas Jefferson School to Tall Oakes Dr. This first half would connect Suburban
Acres, GulP'Jew East, Country Club Estates. Elk Pointe, Gulf View. Button Wood and
Northaven. This sidewalk would then cross over to the Westside of Charlestown Pike
near Tall Oakes and continue until it hits Holmes Lane. The second half of the project
would connect the final phase of Buttouwood homes (currently under construction),
Courtyard of Buttonwood patio homes. Foxboro. Flagstaff. and Mallard Run.
I recommend we fund sidewalks for the full length of Charlestown Pike at this time with
the idea that it will cost less than $500,000 since drainage funds may be used and because
new Buttonwood construction will require the developers to add the sidewalks for aborn a
~A mile stretch along the Westside of Charlestow2~ Pike. This being the case, I am asking
for the council to approve the advertising of $350,000 EDIT Funds which I believe may
be enough for the full length after you add drainage 5rods and developer improvements.
If this sum is not enough for the full lengrth of Charlestown Pike this amount will be
enough to make a significant safety impact for pedestrian travel on Charlestown Pike.
Also, we can always reconsider additional funds at a later time if necessary to complete
this project.
Below- is an estimated cost by segmenting Charlestown pike into 5 segments:
Thomas Jefferson School to Clearstream Way (Suburban Acres) = $88.000
Clearstrem Way to Elk Pointe Blvd (Elk Pointe Subdivision) = $83,000
Elk Pointe to Tall Oaks Dr ( Buttonwood/Northaven Subdivision) = $70,000
Tall Oaks Dr to Gander Dr. (Mallard Run )
$125,000
Gander Dr. (Mallard Run) to Holmans Lane
= $134.000
Total cost of sidewalks on oue side of Charlestown Pike = $500.000
