BEFORE THE JEFFERSONVILLE COMMON COUNCIL
ORDINANCE NO. 2002-OR- lO
An Ordinance changing the zoning map designation of Lot No. Five (5) of
Roselawn Subdivision, as the same appears of record in the Office of the
Recorder of Clark County, Indiana, in Plat Book No. 6 at Page 63
Whereas, Dennis Julius and Joe Lee filed a petition before the
Jeffersonville Plan Commission to change the zoning map designation of the real
property described in the attached Exhibit "A," including both Lots Nos. 5 and 6 in
Roselawn Subdivision from R3: Old City Residential to MI: Limited Multifamily
Residential; and
Whereas, on January 29, 2002 the Jeffersonville Plan Commission
certified a favorable recommendation of the enactment of this proposed zoning
map designation change; and
Whereas, this matter is now before the Jeffersonville Common Council
(the "Council") at its regular meeting after certification of the proposed change of
zoning map designation pursuant to the provisions of I.C. 36-7-4-608(f)(1 ); and
Whereas the Council timely posted notice of its intent to consider the
proposed change of zoning map designation at the regular meeting scheduled for
April 1, 2002 at 7:30 o'clock p.m.; and
Whereas, at the Council's regular meeting of April 1,2002, the counsel
voted to continue consideration of the proposed zoning map designation change
until the Council's regular meeting scheduled for April 15, 2002 at 7:30 o'clock
p.m.; and
Whereas, all interested persons were given an opportunity to appear
before the Council and be heard regarding this matter as required by law; and
Whereas, after hearing the statements of Dennis Julius, Joe Lee and the
residents of Roselawn subdivision, the Council believes that it is in the best
interest of all parties that the rezoning requested for Lot No. 6 of Roselawn
Subdivision be denied and the rezoning requested for Lot No. 5 be approved
conditional upon the Jeffersonville Board of Zoning Appeals rescinding the
developmental standards variance granted to Dennis Julius and Joe Lee for the
property described in Exhibit "A."
NOW, THEREFORE, IT IS HEREBY ORDAINED by the Jeffersonville
Common Council that the zoning designation of Lot No. 5 in Roselawn
Subdivision is hereby changed from R3: Old City Residential to MI: Limited
Multifamily Residential contingent upon the Jeffersonville Board of Zoning
Appeals rescinding the developmental standards variance granted to Dennis
Julius and Joe Lee for the property described in Exhibit '%."
IT IS FURTHER ORDAINED that the zoning map of the City of
Jeffersonville shall be amended to include such change.
IT IS FURTHER ORDAINED that the proposed change of zoning map
designation for Lot 6 in Roselawn Subdivision is hereby denied.
This ordinance shall be in full force and effect upon its adoption.
SO ORDAINED this 15th day of April, 2002.
