COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
July 11, 2005
The Common Council of the City of Jeffersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7:30 P.M. on Monday July 11, 2005.
Mayor Rob Waiz, with Deputy Clerk Treasurer Barbara Hollis at the desk, called
the meeting to order. Also present was City Attorney Les Merkley. Mayor Waiz
welcomed all in attendance, asking all those present to stand as Reverend Amanda
Wagoner of First Christian Church gave the invocation. Mayor Waiz then asked all those
present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCaule'y.
Absent: None
Council President Grooms made the motion to table agenda item #10 until the
August 1, 2005 meeting, second by Councilperson Fetz, passing on a vote of 7--0.
Council President Grooms made the motion to table agenda item #15 until the August 1,
2005 meeting, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson
McCauley made the motion to table agenda item #18 until the next meeting, second 'by
Councilperson Perkins, passing on a vote of 7-0. Councilperson Perkins then made the
motion to approve the agenda as amended, second by Councilperson Sellers, passing on a
vote of 7-0.
Mayor Waiz presented the meeting memorandum of June 6, 2005 for approval.
Councilperson Perkins made the motion to approve the memorandum correcting the
attendance to show all Council present, second by Council President Grooms, passing .on
a vote of 7-0.
Deputy Clerk Hollis presented the claim list for consideration by the Council.
Following discussion Councilperson Perkins made the motion to approve the claims as
presented, second by Council President Grooms passing on a vote of 7-0.

PUBLIC COMMENT:
There was no public comment.
AGENDA ITEMS:
Mr. Joe Weber, Attorney representing Mr. John ZurSchmiede, explained the need
for passage of Ordinance No. 2005-OR-30, An Ordinance Changing The Zoning Map
Designation Of A Certain Tract Of Property Described As 8.859 Acre Tract Located
Adjacent To 4314 Hamburg Pike In The City Of Jeffersonville From RI' Low Density
Residential To C2: Medium To Large General Commercial. The Plan Commission has
given this request a favorable recommendation. Mayor Waiz announced this is a public
heating, asking for comments.

There being no comments, Councilperson Perkins made

Mr. Steve Klein, on behalf of BILDM, LLC, explained the need for passage of
Ordinance No. 2005-OR-31, An Ordinance Changing The Zoning Map Designation Of A
Certain Tract Of Property Described As Being Part Of Survey No. 22 Of The Illinois
Grant In The City Of Jeffersonville Containing A 9.528-Acre Tract Located NW Of
Rolling Ridge Subdivision. This received a unanimous favorable recommendation from
the Plan Commission. Mayor Waiz announced this is a public heating, asking lbr
comments. As there were no comments voiced, Council President Grooms made tlhe
motion to pass Ordinance No. 2005-OR-31, second by Councilperson Fetz, passing on a
vote of 7-0.
Mr. David Nachand, Attorney representing S & A LLC, explained the need for
passage of Ordinance No. 2005-OR-32, An Ordinance Changing The Zoning Map
Designation Of A Certain Tract Of Property Described As Being Part Of Survey No. 20
Of The Illinois Grant In The City Of Jeffersonville Containing A 2.248 Acre Tract And A
2.25 Acre Tract More Or Less Located At 3312 And 3318 Hamburg Pike From RI: Low
Density Residential To M2' Multifamily Residential. The request received a unanimous
favorable recommendation from the Plan Commission. The project and the procedure
was explained. Mayor Waiz asked for public comment. As there was no comme:nt,
Councilperson Wilson made the motion to pass Ordinance No. 2005-OR-32, second by
Councilperson Sellers, passing on a vote of 7-0.

Mr. David Nachand, Attorney representing DRB, LLC-Duard B. Avery Jr.,
requested passage of Ordinance No. 2005-OR-33, An Ordinance changing The Zoning
Map Designation Of A Certain Tract Of Property Described As Being Part Of Survey
No. 21 Of The Illinois Grant In The City Of Jeffersonville Containing A 11.328 Acre
Tract More Or Less Located On Charlestown Pike Near Wohrle Road And Adjacent To
Foxboro Subdivision From MI' Limited Multifamily Residential To R2' Mediu:m
Density Residential. Attorney Nachand described the project of 47 custom designed
units. Mayor Waiz asked for public comment. Following discussion regarding drainage
areas and the fountain, Councilperson Perkins made the motion to pass Ordinance No.
2005-OR-33, second by Councilperson Sellers, passing on a vote of 7-0.
City Attorney Merkley presented Ordinance No. 2005-OR-34, An Ordinance
Rescinding Ordinance No. 2004-OR-45 Vacating A Portion Of Wall Street, A Public
Way In The City Of Jeffersonville. Councilperson Perkins made the motion to pass
Ordinance No. 2005-OR-34 on the first reading, second by Council President Grooms.
Councilperson McCauley questioned the need for compensation, and feels this action is
not necessary, if the object is to reopen the street. City Attorney Merkley explained this
is an unusual vacation as it was for two years or completion of the project. Council
President Grooms said there is a need to send a message that the City is serious. The
deed has not been recorded. Mayor Waiz said the City has been working for several
months to get the road reopened. CitY Attorney Merkley said he is not comfortable with
the Ordinance as it is written. Councilperson Fetz made the motion to table Ordinance
No. 2005-OR-34, second by Councilperson Sellers. Council President Grootns
withdraws draws his second for passage on the first reading this time saying he will fight
to the end next time. Councilperson Perkins' motion to pass on the first reading then died
for lack of a second. Councilperson Perkins made the motion to ask to have the street
vacated and if it is not done ask the Board Of Public Works to start condemnation.
Councilperson McCauley again said let's get the street open. Attorney Alan Applegate
made several suggestions. Councilperson Zastawny then made the motion to table
Ordinance No. 2005-OR-34, second by Councilperson McCauley, passing on a vote of 7-

Ordinance No. 2005-OR-35, An Ordinance Amending The Zoning Code Of The
City Of Jeffersonville was presented for discussion. Planning and Zoning Director
Chester Hicks explained the Ordinance and presented a map. City Attorney Merkley
explained the procedure for passage. Councilperson Perkins would like to lower the 500
pound requirement. Councilperson Perkins made the motion to amend Ordinance No.
2005-OR-35 by replacing 100 pounds for every 500 pounds, second by Council President
Grooms. Councilperson Zastawny asked to add childcare facilities to Section B.
Attorney Alan Applegate explained enforcement is the problem, suggesting dealing with
the situation through special use. Much discussion followed. Councilperson Perkins
made the motion to pass Ordinance No. 2005-OR-35 on the first reading adding child
care in B and reducing the 500 pounds to 100 pounds, second by Council President
Grooms. Councilperson Fetz explained he. will abstain as he is a member of the Plum
Commission. Following further discussion Council President Grooms withdrew his
second. Council President Grooms then made the motion to table Ordinance No. 2005-
OR-35, second by Councilperson Perkins, passing on a vote of 6-0-1. CounCilperson
Fetz abstained.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer comments.
COMMITTEE REPORTS:
There were no committee reports.
COUNCIL AND MAYOR COMMENTS:
CounCilperson Wilson reviewed the Parks Board meeting.
Councilperson Perkins said the budget committee is working on making sure all
employees are paid from the right departments. He is concerned that some businesses
have city garbage pick up and some do not. Councilperson Perkins would like to see the
take-home car situation reviewed due to gasoline prices. He asks that the Council, Board
of Public Works and Safety and the Mayor discuss this.
Councilperson Zastawny is looking forward to the Rails To Trails feasibility
study. He supports Med Venture's move to Jeffersonville, and he is glad to see City Hall ·
moving to the Quadrangle.

Council President Grooms noted the need to plan the budget process calendar. He
reminded the budget committee to provide memorandum for budget committee meetings.
Next Monday he will give the first of two state of the Council addresses. There will be
no workshop prior to the next meeting. Council President Grooms thanks Officer Grimes
for his attendance this evening. He said the City Hall move is awesome. Council
President Grooms will put in writing for the Mayor and Department of Redevelopment
the approval for the plans for the Council offices. He thanked all for attending.
Mayor Waiz announced the next Mayor's Night In The Neighborhood will be this
Thursday at 6'30 P.M. along Springdale Drive.
