COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
June 6, 2005
The Common Council of the City of Jeffersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7'30 P.M. on Monday June 6, 2005.
Mayor Rob Waiz, with Deputy Clerk Treasurer Barbara Hollis at the desk, called
the meeting to order. Also present was City Attorney Les Merkley. Mayor Waiz
welcomed all in attendance, asking all those present to stand as Brother Miles gave the
invocation. Mayor Waiz then asked all those present to join him in the pledge of
allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley.
Absent: None
Council President Grooms requested a Resolution to Advertise for an additional
appropriation be added to the agenda as agenda item 18A, 'and an Ordinance amending
the salary Ordinance be added as agenda item 18B. Councilperson McCauley asked that
agenda item #11 be tabled, and Councilperson Sellers requested agenda item #12 be
tabled. Councilperson Zastawny then made the motion to approve the agenda with the
changes as requested, second by Council President GrOoms, passing on a vote of 7-0.
Mayor Waiz presented the minutes of the meeting of May 16, 2005, and May 25,
2005 for approval. Councilperson Wilson made the motion to approve the minutes of
May 15, 2005 with the correction of the spelling of the name Dafford, second by
Councilperson Fetz, passing on a vote of 7-0. Councilperson Wilson then made the
motion to approve the minutes of May 25, 2005 as presented, second by Councilperson
Sellers, passing on a vote of 7-0.
Deputy Clerk Hollis presented the claim list for consideration by the Council,
requesting the addition of three additional claims and the approval of claims to be
submitted for the expenses of the River Stage production. Councilperson Perkins made
the motion to approve the claims as presented, the additional and giving approval to pay

properly submitted claims for the River Stage prOduction not to exceed the amount of
donations collected, seconded by Councilperson Sellers passing on a vote of 7-0.
PUBLIC COMMENT'
Ms. Evelyn Smith, a resident of Utica Sellersburg Road appeared before the
Council to ask Councilperson Perkins what area is being considered for annexation.
Councilperson Perkins said it is premature as to what will happen.
Mr. R. Monty Snelling, Clark County Councilperson, appeared before the Council
recommending they squeeze every nickel due to proposed changes in the property tax
system. He commends Councilpersons Perkins and Sellers for their work on lowering the
sewer bonds. The County Council is working hard to bring money in.
Ms. Patricia Lowry expressed concerns for the apartment being built next door to
her residence of 44 years. She presented a diagram of the area, asking the Council to shut
the job down if it is not done fight. Ms. Lowry does not feel the building of apartments
in this area is enhancing life. Planning and Zoning Director Chester Hicks noted the
request for the apartments was tabled at the last meeting.
Mr. Ned Pfau and Mr. Tom Lindley appeared before the Council on behalf of The
Remnant Trust and the restoration of the Carnegie Library. Mr. Tom Lindley said this
collection will grow and could be the largest collection of rare books in the United States.
He welcomes any that would like to tour. Mr. Ned Pfau announced there will be a $4
million campaign kick off that will be a challenge. Mayor Waiz thanked all who have
been working on this project.
AGENDA ITEMS'
Councilperson Fetz introduced Mr. Danny Struck, Jeffersonville High School
wrestling coach. Coach Struck introduced Mr. Justin Cunningham and Mr. Ryan
Dawson, wrestlers who will be visiting Poland and Mr. Cody Hendrick, Mr. Dominique
Smith and Mr. Alex Bailey who will be visiting Japan. Coach Struck is very proud of
these students. Jeffersonville will host a Country next year. Councilperson Fetz
challenges Mayor Waiz to match a Council donation. Councilperson Fetz made the
motion to donate $500 from the Council promotion line, second by Councilperson
Perkins, passing on a vote of 7-0. Mayor Waiz announced he would donate $600.

Ordinance No. 2005-OR-22, An Ordinance Authorizing The Issuance Of Sewage
Works Revenue Bonds For The Purpose Of Providing Funds To Pay The cost Of Certain
Additions, Extensions And Improvements To The Municipal Sewage Works Of Said City
was introduced, having passed on the first reading previously. Mayor Waiz reviewed the
Sewer Master Plans and Expansion. He referenced letters from the Census Bureau,
Greater Clark County Schools, and Kitchen Kompact. City Attorney Merkley explained
the amendments and the time urgency for passage. Mr. Buddy Downs of Ice Miller
explained the time table. Councilperson Perkins said the process has been slowed down
and it has decreased costs. Councilperson Perkins made the motion to pass Ordinance
No. 2005-OR-22 on the second reading at the original $6.5 million, second by
Councilperson Sellers. Following discussion, Councilperson Sellers withdrew her second
and Councilperson Perkins withdrew his motion. Councilperson Perkins then made the
motion to pass the original Ordinance No. 2005-OR-22 on the second and third readings.
Councilperson Perkins withdrew this motion. Council President Grooms noted that
IDEM needs a commitment from the City. Councilperson Perkins said he understands
that $6.5 million will get the project started. Councilperson McCauley then made the
motion to pass Ordinance No. 2005-OR-22 on the second and third readings replacing
exhibit A, second by Councilperson Sellers. Councilperson Sellers appreciated
Councilperson Perkins dissention. Councilperson McCauley noted the process was well
laid out for the public and the Council. He also noted Councilperson Sellers has done a
fabulous job. All parties have handled this very well and with due diligence. The public
process has worked. Council President Grooms noted Councilperson Sellers has
challenged the Council to think outside the box. He feels there is a better plan now that
will save money. Mayor Waiz said he made sure information was available. At the
conclusion of all discussion Ordinance No. 2005-OR22 as amended passed on the second
and third readings on the following roll call vote:
Ayes: Councilpersons McCauley, Grooms, Wilson, Sellers, Fetz, and Zastawny.
Nays' Councilperson Perkins.
City Attorney Merkley explained the need 'for passage of Ordinance No. 2005-
OR-23, An Ordinance Transferring Certain Funds Within Same Department (City

Attorney). Councilperson Fetz made the motion to pass Ordinance No. 2005-OR-23 on
the first reading, second by Councilperson McCauley, passing on a vote of 7-0.
City Attorney Merkley explained Resolution No. 2005-R-19, Resolution
Approving Interlocal Agreement For Road-Related Services. City Attorney Merkley
commended City Engineer Bob Miller who has done a great job. Councilperson Perkins
made the motion to pass Resolution No. 2005-R-19, second by Councilperson Wilson,
passing on a vote of 7-0.
Councilperson Perkins said no areas will be sacrosanct from the annexation study.
It appears all are in agreement to become a second-class city. Annexation is moving
forward with due diligence. Councilperson McCauley said matters have changed and we
must look this for the' long term. This is vital for the future of Jeffersonville.
Ordinance No. 2005-OR-24, An Ordinance Changing The Zoning Map
Designation Of A Certain Tract Of Property Being Part Of Survey No. 33 Of The Illinois
Grant From I1' Business Park/Light Industrial To C2: Medium To Large General
Commercial was presented for consideration. Mr. Bob Blackert explained the need. The
Plan Commission approved this unanimously. Councilperson Fetz made the motion to
pass Ordinance No. 2005-OR-24, second by Councilperson Zastawny. No public
comment was voiced was called for. The motion passed on a vote of 7-0.
Councilperson McCauley made the motion to table agenda item #18, a Resolution
For Issuance Of Sewage Works Revenue Bonds, second by Councilperson Zastawny,
passing on a vote of 7-0.
Council President Grooms introduced Resolution No. 2005-R-20, A Resolution
Authorizing Advertising For An Additional Appropriation (Local Roads & Streets).
Street Commissioner Ron Ellis explained the need for additional funds, and Clerk
Barbara Hollis explained the funding. Councilperson Grooms made the motion to pass
Resolution No. 2005-R-20, second by Councilperson Sellers passing on a vote of 6-0.
Councilperson Fetz was out of the room at the time of the vote.
Council President Grooms explained the need for passage of Ordinance No. 2005-
OR-25, An Ordinance Amending Ordinance 2005-OR-1, Which Amended The Original
Ordinance 2004-OR-64, Fixing Basic Salaries Of Appointed Officers And Employees Of
The City Of Jeffersonville, Indiana For The Year 2005 (Parks). Council President

Grooms made the motion to pass Ordinance No. 2005-OR-25 on the firSt reading, second
by Councilperson Wilson, passing on a vote of 7-t~. Councilperson McCauley said it is
important to note there are no additional funds necessary.
CLERK TREASURER COMMENTS'
There were no Clerk Treasurer comments.
COMMITTEE REPORTS'
Councilperson Perkins announced the Redevelopment Commission is moving to
condemn a property. This is not a fast process.
Councilperson Fetz announced the budget committee is meeting with Vehicle
Maintenance Director Dmry on June 13. Meetings will be scheduled with each
department head. The budget committee is back to Councilpersons Perkins, Fetz, and
Wilson.
Council President Grooms said the Solid Waste Board meets the third Thursday
of the month.
COUNCIL AND MAYOR COMMENTS:
Councilperson Wilson said the Concerts In The Park have started and she is
excited about the turn out. Jeff Fest will be June 11 and she hopes all come down.
Councilperson Fetz said the Fire Department has requested to be on the next
worksh6p agenda. He thanks the Mayor and Council for their donation to the wrestlers.
It is a great opportunity and he appreciates the support.
Councilperson Zastawny says thank you to Council President Grooms for the
recent retreat saying it was a good process. He notes EDIT funds are being used to
remove stumps and install a traffic light which are safety issues. He feels Charlestown
Pike sidewalks are also a safety issue and are needed.
Councilperson Perkins is going to meet with the annexation attorney and surveyor
and will meet with the Utica and McCullough volunteer fire departments. He will also
meet with the Oak Park Conservancy attorney. He is getting ready to open a humongous
"can of worms".
Councilperson McCauley asks all to look at what is going on in Jeffersonville;
Concerts In The Park, Jeff Fest, River Stage, Remnant TruSt, Wrestlers, Annexation,
Sewers. The Council has created an atmosphere that is quite a tribute. He asks Mayor

Waiz to begin the process for the Sewer Board appointment due in July. Mayor Waiz
will bring it up at the Sewer Board meeting.
Council President Grooms noted the Bridgeview heating for June 15, 2005. The
next workshop will include Joe Hamm, Drainage and Chief Miles. There will be a flood
wall art fundraising meeting on June 7 at 11 A.M. The Council should contact Chuck
Branham at the Evening news for additional Council photos. Council President Grooms
thanks Officer Grimes for his attendance. He commends the River Stage group, Youth
Commission Director and Parks Department and Mayor Waiz for being persistent. He
suggests considering incorporating Jeff Fest with the July 4th parade some day. He
encourages Mayor Waiz to give every opportunity to minorities.
Mayor Waiz commends the Park Department, Youth commission, Director
Knight for a fantastic show. River Stage has start~t foot.
