HomeMy WebLinkAbout07-06-2004COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERS ONVILLE, INDIANA July 6, 2004 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:30 P.M. on Tuesday, July 6, 2004. Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand as Councilperson Perkins gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons John Perkins, lid Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley. Absent: None Councilperson Perkins made the motion to approve the agenda asking Mayor Waiz to include comments regarding INAAP, second by Councilperson Grooms, passing on a vote of 7-0. Mayor Waiz presented the minutes of the meetings of June 7, 2004, June 21, 2004, and the workshop of June 21, 2004 for approval. Councilperson Wilson made the motion to approve the minutes of June 7, 2004 as presented, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Wilson then made the motion to approve the minutes of June 21, 2004 as presented, second by Councilperson Fetz, passing on a vote of 7-0. Following discussion of the workshop minutes of June 21, 2004, Councilperson Fetz made the motion to table approval, second by Councilperson Sellers, passing on a vote of 7-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council explaining one additional claim. Councilperson Wilson questioned one claim for Jeff Fest. Councilperson Perkins then made the motion to approve the claims as presented, with the additiona1 and pending research on the Jeff Fest claim, second by Councilperson Grooms passing on a vote of 7-0. July 6, 2004 PUBLIC COMMENT' There was no public comment. AGENDA ITEMS' Ms. Roxanna D. Whitaker appeared before the Council to request passage ,of Ordinance No. 2004-OR-38, Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Block D Of Lot 59 & 60 From R3' Old City Residential To NC' Neighborhood Commercial. Ms. Whitaker explained the intended use. Councilperson Fetz Said the Plan Commission gave favor to this change. Following comments, Councilperson Perkins made the motion to pass Ordinance No. 2004-OR-38, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Fetz presented Ordinance No. 2004-OR-39, An Ordinance Amending Ordinance No. 2004-OR-47, An Ordinance Repealing And Replacing Ordinance No. 97-OR-46 (Replacing Ordinance No. 93-OR-66) Establishing Retiree's Health Insurance Benefits For City Employees. Councilperson Fetz reviewed the table showing the differences. Attorney Merkley cautioned the Council regarding the contracts with the police and fire, reading the pertinent articles. Councilperson Fetz said he has talked with a representative of the State Board of Accounts who said the articles pointed out by Attorney Merkley are subject to interpretation. Council President McCauley has concerns addressing health insurance issues before police and fire negotiations are comlSlete. Councilperson Grooms feels tier rates should be" looked into. Following all discussion, Councilperson Fetz made the motion to pass Ordinance No. 2004-OR-39 on the first reading saying he will get letters from the police and fire, second by Councilperson Perkins. Council President McCauley would like to see computations of cost differences to the City as the City is at the maximum levy and the money would have to be taken from somewhere else. He feels this stretches the budget. Councilperson Zastawny feels the missing years were to the advantage of the retirees and feels the benefit has been given. Council President McCauley pointed out the average Jeffersonville yearly household income is $34,000 and these are the people that are paying the bills and not getting the health insurance advantages. Councilperson Grooms said the increase will bring in more than was brought in six months ago. The motion to July 6, 2004 pass Ordinance No. 2004-OR-39 on the first reading, passed on the following roll call vote' Ayes' Councilpersons Perkins, Fetz, Sellers, Wilson, and Grooms. Nays' Councilpersons Zastawny and McCauley. Ordinance No. 2004-OR-40, An Ordinance Transferring Certain Funds Within Same Department (Probation User Fund) was presented and explained. Following discussion, Councilperson Perkins made the motion to suspend the roles for Ordinance No. 2004-OR-40, second by Councilperson Fetz, passing on a vote of 7-.0. Councilperson Perkins then made the motion to pass Ordinance No. 2004-OR-40 on all three readings, second by Council President McCauley, passing on a vote of 7-0. Clerk Treasurer Wilder presented and explained Ordinance No. 2004-OR-41, An Ordinance Amending Ordinance No. 2004-OR-~, Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 2004. Animal Shelter Director Harry Wilder explained the need for the change. Councilperson Sellers made the motion to suspend the roles for Ordinance No. 2004-OR-41, second by Councilperson Perkins, passing on a vote of 7-0. Councilperson Sellers then made the motion to pass Ordinance No. 2004-OR-41 on all three readings, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Zastawny asked Director Wilder if he could track where the animals come from. Director Wilder has the information. Attorney Merkley explained the need for passage of Ordinance No. 2004-OR-42, An Ordinance Regulating Portable Private Family Swimming Pools. Following discussion, Councilperson Fetz made the motion to pass Ordinance No. 2004-OR-42 on the first reading, second by Councilperson Sellers, passing on a vote of 7-0. Attorney Merkley next explained the need for passage of Ordinance No. 2004- OR-43, An Ordinance Regulating Off Street Parking In Residential Districts. Councilperson Perkins expressed concerns for the older neighborhoods that have gravel driveways and alleys. Attorney Merkley said these would be "grandfathere~d''. Councilperson Grooms asked for a definition of parking. Councilperson Grooms made the motion to pass Ordinance No. 2004-OR-43 on the first reading, second by Zastawny, passing on a vote of 7-0. July 6, 2004 Councilperson Grooms presented and explained Ordinance No. 2004-OR-44, An Ordinance Transferhng Certain Funds Within Same Department (Motor Vehicle). This will provide for the four part-time employees. Councilperson Grooms made the motion to pass Ordinance No. 2004-OR-44 on the first reading, second by Councilperson Fetz, passing on a vote of 7-0. CLERK TREASURER COMMENTS: Clerk Treasurer Wilder presented a budget calendar, explaining advertising and heating dates, thanking Mayor Waiz for getting the budgets to her. COUNCIL AND MAYOR COMMENTS: Councilperson Zastawny reviewed the funds for the operation of the animal shelter from the other entities. Councilperson Zastawny asked the status of the tap-.in fees. Mayor Waiz said this is ongoing. Councilperson Zastawny commends the appointment of Barry Cahill as Director of Redevelopment. Councilperson Sellers said the adoptions at the animal shelter are going well. Councilperson Grooms reminds the Mayor regarding the auction of equipment. Councilperson Grooms said he struggles with the passage of Ordinances on all ttu:ee readings. Council President McCauley said the state of the Council address is being prepared and will be submitted to the Council for input. He would like this to be included ih the workshop of July 21. The Council has asked that"requests for donations for the 2005 budget be in by July 1. Council President McCauley has received three or four. He feels some may not know of the deadline. He will get a list and make notifications. Mayor Waiz announced the next Mayor's Night In will be Saturday at 2 P.M. He will be attending an INAAP meeting tomorrow with Director Elliott and Mayor Hall. Mayor Waiz has talked with Charlestown Mayor Hall regarding finding a place to use jointly for K9 training and storage of the K9 equipment. There was discussion regarding changing the Ordinance regarding the auctioning of city property. The Council gives Mayor Waiz permission to sell any piece of equipment declared surplus valued at less than $25,000.
