COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
November 15, 2004
The Common Council of the City of Jeffersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7:30 P.M. on Monday September 15, 2004.
Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the
meeting to order. Also present were City Attorney Les Merkley, Council Attorney Allen
Morris, and Deputy Clerk Barbara Hollis. Mayor Waiz welcomed all in attendance,
asking all those present to stand as Monty Snelling gave the invocation. Mayor Waiz then
asked all those present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Barbara Wilson, Ron Grooms, and Phil McCauley.
Absent: Councilperson Connie Sellers.
Following discussion, Council President McCauley made the motion to approve
the agenda with the tabling of agenda item #11 and agenda item #12, and the addition of
two Resolutions, and one Ordinance as requested by Clerk Treasurer Wilder, second by
Councilperson Perkins, passing on a vote of 6-0.
Mayor Waiz presented the minutes of the meeting of November 1, 2004 and the
workshop o£November 1, 2004 for approval. Councilperson Wilson made the motion to
approve the minutes of the November 1, 2004 meeting as presented, second by
Councilperson Fetz, passing on a vote of 6-0. Councilperson Wilson then made the
motion to approve the minutes of the November 1, 2004 workshop as presented, second
by Councilperson Zastawny, passing on a vote of 6-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council.
Following discussion of payments from categories, Councilperson Perkins made the
motion to approve the claims as presented, seconded by Councilperson Grooms, passing
on a vote of 6-0.
PUBLIC COMMENT:
There was no public comment.

AGENDA ITEMS:
City Attorney Les Merkley explained Ordinance No. 2004-OR-68, Single Family
Residential And Accessory Structures Permit Fees. Councilperson Perkins made the
motion to pass Ordinance No. 2004-OR-68 on the second reading, second by
Councilperson Fetz, passing on a vote of 6-0.
City Attorney Les Merkley explained Ordinance No. 2004-OR-65, An Ordinance
Amending Section 5. (d): Regulatory Flood Elevations Of Ordinance No. 2003-OR-33.
Councilperson Perkins made the motion to pass Ordinance No. 2004-OR-65 on the first
reading, second by Councilperson Grooms, passing on a vote of 6-0.
Clerk Treasurer Peggy Wilder explained the need for passage of Ordinance No.
2004-OR-67, Tax Anticipation Warrant. Councilperson Perkins made the motion to
suspend the rules for Ordinance No. 2004-OR-67, second by Council President
McCauley, passing on a vote of 6-0. Councilperson Perkins made the motion to pass
Ordinance No. 2004-OR-67 on all three readings, second by Councilperson Wilson,
passing on a vote of 6-0.
City Attorney Les Merkley explained Ordinance No. 2004-OR-68, 2004 Sewer
Pre-Treatment Ordinance. It is necessary to pass this in order to be in compliance with
IDEM. Councilperson Grooms made the motion to pass Ordinance No. 2004-OR-68 on
the first reading, second by Councilperson Perkins, passing on a vote of 6-0.
Clerk Treasurer Wilder explained the need for passage of Resolution No. 2004-R-
35, A Resolution To Advertise For Additional Appropriation (Parks & Recreation).
Councilperson Perkins made the motion to pass Resolution No. 2004-R-35, second by
Council President McCauley, passing on a vote of 6-0. Council President McCauley
asked the Council to und~stand the maximum levy is being pushed.
Clerk Treasurer Wilder explained the need for passage of Resolution No. 2004-R-
36, A Resolution To Advertise For Additional Appropriation (Local Roads & Streets).
Following discussion, Councilperson Perkins made the motion to pass Resolution No.
2004-R-36, second by Councilperson Grooms, passing on a vote of 6-0.
Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2004-
OR-70, An Ordinance Transferring Certain Funds Within Same Department (Probation
User Fund). Councilperson Perkins made the motion to suspend the rules for Ordinance

No. 2004-OR-70, second by Councilperson Fetz, passing on a vote of 6-0.
Councilperson Perkins then made the motion to pass Ordinance No. 2004-OR-70 on all
three readings, second by Councilperson Fetz, passing on a vote of 6-0.
CLERK TREASURER COMMENTS:
Clerk Treasurer Wilder informed the Council the money in the health insurance
fund was getting low. She will keep them updated.
COUNCIL AND MAYOR COMMENTS:
Councilperson Fetz would like to make the appointments to the tree board at the
next meeting. He would ask the Council to consider Chuck Branham and Mack Kimher
as the two Council appointments.
Councilperson Grooms said he had talked with Street Commission Ron Ellis
regarding leaves. This year leaves have to be in yard waste containers or paper bags.
The City has ordered 5,000 bags at a cost of $.40 each. Distribution may be a problem.
He asks for thoughts. The city equipment auction will close November 18 with an
estimated amount of $25,000. The shortage of gasoline money is being worked out. The
auction will have netted over $200,000. Mowers have been purchased by auction. There
will be a Solid Waste Board meeting on Thursday.
Council President McCauley introduced Allen Morris as the new Council
Attorney. A contract has been signed and copies will be sent. He is looking forward to
working with Attorney Morris. Councilperson Perkins noted he has worked with
Attorney Morris in the prior century and is looking forward to working with him again as
he has a lot of experience. Council President McCauley said "Welcome Aboard".
Mayor Waiz welcomed Attorney Morris. Light up downtown will be Thursday.
Mr. Chester Hicks started working today as the new Planning and Zoning Director.
Mayor Waiz said the sewer rate increase ordinance and the tap-in fee ordinance will
come up at the next meeting. He asks if any have questions to please call him, Jorge
Lanz or John Skomp. Mayor Waiz recommends Ms. Dana Young, Ms Melanie Hanuner,
and Mr. Glen Dixon as his appointments to the Tree Board. Mayor Waiz wishes all a
safe trip home.
