COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
November 1, 2004
The Common Council of the City of Jeffersonville, Indiana met in regular session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7:30 P.M. on Monday November 1, 2004.
· Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the
meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk
Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand
as Reverend Larry Martin gave the invocation. Mayor Waiz then asked all those present
to join him in the pledge of allegiance ~o the flag. Mayor Waiz then asked Councilperson
Perkins to stand for all to see what he was wearing. Councilperson Perkins explained he
was attired in 1770 style colonial dress to encourage all to vote.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley.
Absent: None
Councilperson Grooms made the motion to approve the agenda with the tabling of
agenda item #15 and agenda item #18, second by Councilperson Perkins, passing on a
vote of 7-0.
Mayor Waiz presented the minutes of the meeting of October 18, 2004 along with
the minutes of the workshop of October i8, 2004 for approval. Councilperson Wilson
made the motion to approve the minutes of the October 18, 2004 meeting as presented,
second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Wilson then
made the motion to approve the minutes of the October 18, 2004 workshop as presented,
second by Councilperson Grooms, passing on a vote of 7-0.
Clerk Treasurer Wilder presented the claim hst for consideration by the Council.
Following discussion of the legal fees, Councilperson Perkins made the motion to
approve the claims as presented, seconded by Conncilperson Wilson, passing on a vote of
7-0. Posting of the legal fees will be discussed:

PUBLIC COMMENT:
Mr. Robert Osborne appeared before the Council to explain his experience of
retrieving his vehicle al[er it had been ~owed, due to it being stored because he had been
laid up. He believes his vehicle was being prepared for sale. He said he was threatened.
Mr. Osborne feels the Council should look at the towing agreement. Mayor Waiz asked
Mr. Osborne to call him with the names of those involved.
DEPARTMENT HEAD REPORTS:
Street Commissioner Ron Ellis reported the City has sold 10 items on
GovDeals.com for a total of $167,000 plus. This has been real successful.
Commissioner Ellis reviewed those items that are for sale on line at this time. The cost to
the City for this service is 7%. He said purchasers came form several states, saying the
exposure has been great. Councilperson Grooms asked if it would be possible to make
purchases in this way. Commissioner Ellis said he has been looking into the possibility.
He has made purchases from the State. He does have the right of rejection on bids.
Mayor Waiz noted the list of items for sale is not the same list as the one denied last year.
Clerk Treasurer Wilder said she would help those that did not have a computer available.
Council President McCanley commended Commissioner Ellis, saying this has been good
for the City. Councilperson Fetz asked about the leaf pick-up program. Commissioner
Ellis explained that leaves should be placed in yard waste containers or paper bags.
AGENDA ITEMS:
Redevelopment Director Barry Cahill appeared before the Council on behalf of
Resolution No. 2004-R-33, Resolution Approving Statement Of Benefits For Purposes Of
Property Tax Abatement (PI Louisville\Cardinal Investments). Mr. Doug Abncy
explained the business saying they will have an additional company as a tenant. The
companies will be no threat to employees locally. Councilperson Perkins made the
motion to approve Resolution No. 2004-R-33, second by Councilperson Grooms, passing
on a vote of 7-0.
Attorney Alan Applegate appeared before the Council on behalf of Ordinance No.
2004-OR-65, An Ordinance To Vacate Pubhc Way In Jeffersonville, Indiana. Attorney
Applegate explained the area with a map explaining this has to do with Jeffersonville
Housing Authority and Greenwood revitalization. Councilperson Perkins made the

motion to suspend the rules for Ordinance No. 2004-OR-65, second by Councilperson
Fetz. A request for public comment was made for this Ordinance as well as Ordinance
No. 2004-OR-66, An Ordinance Changing The Zoning Map Designation Of A Certain
Tract Of Property Being Part Of Kirby's Subdivision. Ms. Nellie Noland is concerned
for children that walk in the area and she does not feel this should be vacated. Mayor
Waiz noted the Board of Public Works and Safety has given its approval. The motion to
suspend passed on a vote of 7-0. Councilperson Perkins then made the motion to pass
Ordinance No. 2004-OR-65 on all three readings, second by Councilperson Fetz, passing
on a vote of 7-0. Councilperson Perkins made the motion to pass Ordinance No. 2004-
OR-66, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of
Property Being Part Of Kirby's Subdivision, second by Councilperson Wilson, passing
on a vote of 7-0. Ms Nellie Noland said she whishes the Council would c0me and look at
the area. Several of the Council said they had.
Building Commissioner Russ Seagraves explained the need for passage of
Ordinance No. 2004-OR-67, An Ordinance Transfemng Certain Funds Within Same
Department (Building Commission). Councilperson Perkins made the motion to suspend
the rules for Ordinance No. 2004-OR-66, second by Cotmcilperson Zastawny, passing on
a vote of 7-0. Councilperson Fetz then made the motion to pass Ordinance No. 2004-
OR-67 on all three readings, second by Councilperson Sellers, passing on a vote of 7-0.
Building Commissioner Russ Seagraves next explained the need for passage of
Ordinance No. 2004-OR-68, Single Family Residential And Accessory Structures Permit
Fees as discussed in the Workshop. Councilperson Perkins made the motion to pass
Ordinance No. 2004-OR-68 on the first reading, second by Councilperson Zastawny,
passing on a vote of 7-0.
City Attorney Les Merkley presented Ordinance No. 2004-OR-55, Stormwater
Illicit Discharge Control Ordinance., Councilperson Perkins made the motion to pass
Ordinance No. 2004-OR-55 on the third reading, second by Councilperson Fetz, passing
on a vote of 7-0.
City Attorney Les Merkley next presented Ordinance No. 2004-OR-56,
Construction Site Runoff Control Ordinance. Councilperson Perkins made the motion to

pass Ordinance No. 2004-OR-56 on the third reading, second by Councilperson Sellers,
passing on a vote of 7-0.
Councilperson Perkins presented Ordinance No. 2004-OR-64, An Ordinance
Amending Ordinance 2004-OR-53, Fixing Basic Salaries Of Appointed Officers And
Employees Of The City Of JeffersonVille, Indiana For the Year 2005. Councilperson
Perkins made the motion to pass Ordinance No. 2004-OR-64, on the second and third
readings, second by Councilperson Sellers, passing on a vote of 7-0.
Councilperson Perkins introduced Resolution No. 2004-R-34, A Resolution In
Support Of The Riverview Condominiums And Business Center, reviewing the dates for
footings and the amount of concrete, i Councilperson Perkins made the motion to pass
Resolution No. 2004-R-34, second by Council President McCauley. Council President
McCauley said this is a terrific program for the City that will increase the assessed value,
which in turn will lower individual property taxes. This is also a terrific boom to
downtown Jeffersonville and could be the envy of all of Indiana. Mayor Waiz said he
has been doing everything possible to promote the project. The motion to pass
Resolution No. 2004-R-34 passed on a vote of 7-0.
Council President McCauley explained the Council has interviewed two
outstanding attorneys, making the motion to contract with Attorney Allen Morris
contingent upon a reasonable and equitable financial package for 30 days with expected
renewal, second by Councilperson Grooms. Councilperson Fetz noted a vote against this
motion would not necessarily mean Attorney Morris is not qualified or would not do a
good job. The motion passed on the following roll call vote:
Ayes: Councilpersons Perkins, Zastawny, Wilson, Grooms, and McCauley.
Nays: Councilpersons Fetz and Sellers.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer comments.
COUNCIL AND MAYOR COMMENTS:
Councilperson Perkins wishes good luck to all candidates running for election
tomorrow. He is still working on the gas consumption report.

coUncilperson Zastawny complimented the other applicant for Council Attorney
saying he was very competent and experienced. Councilperson Zastawny encourages all
to get out and vote.
Councilperson Fetz said his vote in opposition to the Council Attorney was not a
reflection of his confidence in the applicant.
Councilperson Wilson reported the S1EDC meeting was very informative. She
also noted that Key Electronics is a wonderful addition to Northport. Councilperson
Wilson also encourages all to vote.
Councilperson Grooms said he has similar sentiments regarding the Council
Attorney applicants. Councilperson Grooms called attention to a letter from the YMCA
pleading for help from the City for sidewalks. He would like to see the City address this.
Mayor Waiz will work with Councilperson Grooms.
Council President McCauley praised Council Attorney Candidate Scott Lewis
remarking he is a brilliant young attorney. The Council was blessed with two great
candidates and the Council could not have gone wrong. Council President McCauley
said he does not {ake tax abatement lightly. He will be introducing a program for a
written proposal. There is a need for a stronger impression.
Mayor Waiz reminds all of the Holiday Open House downtown on November 4
from 5:00 to 9:00. Mayor Waiz also emphasized the need to vote. Mayor Waiz said
Halloween downtown went fantastic. He appreciates the help from the Council. Mayor
Waiz then said thanks for coming, wishing~fe~e.
