OF JEFFERSONVILLE, INDIANA
DECEMBER 13, 1999
The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose
Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 13th day of
December, 1999.
The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer C.
Richard Spencer Jr. at the desk. Mayor Galligan welcomed all in attendance, asking all those present
to stand as Councilperson Williams gave the invocation. Mayor Galligan asked all those present to
join him in the pledge of allegiance to the flag.
The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna
M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicki Conlin.
Absent: None.
Mayor Galligan presented the minutes of the meeting of December 6, 1999 for consideration
by the Council. Councilperson Perkins made the motion to approve the minutes as presented
seconded by Councilperson Williams and carried unanimously.
Clerk and Treasurer Spencer presented the claim list for consideration by the Council
explaining an additional claim and two changes. Following all discussion, Councilperson Wilder mad~
the motion to approve the claims as presented as well as the additional, seconded by Councilperson
Williams, passing unanimously.
Council President Conlin presented Clerk and Treasurer Spencer with a clock commemoratin
his 28 years as Clerk and Treasurer. Clerk and Treasurer Spencer said he is pleased and honore~
He has no regrets. He wishes good luck to incoming Clerk and Treasurer Wilder. Clerk and
Treasurer Spencer said his deputies, Suzy Bass, Barbara Hollis, and Lynne Mayfield have made
easy and less stressful.
Mr. Brian Dixon, President, Pacesetters Swim Club, presented the Council with a petition ot
approximately 90 signatures asking the Council to proceed with the work necessary for the muc~
needed proposed indoor/outdoor swimming pool.
Attorney Anne Marie Galligan presented Ordinance No. 99-OR-69, An Ordinance To Amenc

Ordinance No. 98-OR-75 Concerning The Construction Of Additions and Improvements To Th
Sewage Works Of The City Of Jeffersonville; Authorizing The Issuance Of Sewage Works Revenue
Bonds, For Such Purpose; Addressing Other Matters Connected Therewith, Including The Issuance
Of Notes In Anticipation Of Bonds; And Repealing Ordinances Inconsistent Herewith, explaining
additional changes in wording. Councilperson Williams made the motion to approve the corrections
to Ordinance No. 99~OR-69, seconded by Councilperson Wilder, passing on a vote of 5-2.
Councilpersons Perkins and Ellis voted against. Councilperson Williams then made the motion tc
pass Ordinance No. 99~OR-69 on the third reading, seconded by Council President Conlin, passing
on a vote of 5-2. Councilpersons Perkins and Ellis voted nay.
Councilperson Perkins made the motion to table Ordinance No. 99-OR-76, An Ordinance
Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey No
22 Of The Illinois Grant From R-2 And B-3 To B-3 Entirely, as no representative is present:
seconded by Council President Conlin, passing unanimously.
Deputy Mayor McCauley announced the assessed value of the City of Jeffersonville has beer
set at $220,407,380 which reduces the tax rate for 2000 below that for 1999. An increase of$.l l
had been anticipated. The conditions are now in place ahead of schedule for growth. Deput3
McCauley makes this announcement to encourage the Council to pass Ordinance No. 99-OR-66, At
Ordinance Regarding Approval Of A Lease Between The Jeffersonville Redevelopment Commissio~
And The Jeffersonville Redevelopment Authority. Mayor Galligan noted the Park Board is veT
supportive. Councilperson Wilson asked about the liability involved with the skateboard park
Attomey Galligan said there is less liability ifa place is designated for skateboarding rather than usin~
other public areas. Skateboarders will have to wear protective equipment to use the park
Councilperson Williams made the motion to pass Ordinance No. 99-OR-66 on the third and fina
reading, seconded by Councilperson Frantz, passing on a vote of 5-2. Councilpersons Perkins am
Ellis voted against passage.
Councilperson Perkins made the motion to untable Ordinance No. 99-OR-76, An Ordinanc~
Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey No
22 Of The lllinois Grant From R-2 And B-3 To B-3 Entirely, as a representative is now present. Mr
Scott Thomas, representing Robert Lynn explained the area and the need for the changes. Ther,

were no resident complaints at the Plan Commission meeting. Public comment was asked for. There
being no public comment, Councilperson Perkins made the motion to suspend the rules for Ordinance
No. 99-OR-76, seconded by Councilperson Ellis, passing unanimously. Councilperson Perkins then
made the motion to pass Ordinance No. 99-OR-76 on all three readings, seconded by Councilperson
William, passing unanimously.
Attorney Galligan presented Ordinance No. 99-OR-77, An Ordinance Establishing A Parks
Department Non-Reverting Fund. This is not a new fund. Council President Conlin made the motion
to suspend the rules for Ordinance No. 99-OR-77, seconded by Councilperson Williams, passing
unanimously. Council President Conlin then made the motion to pass Ordinance No. 99-OR-77 on
all three readings, seconded by Councilperson Williams, passing unanimously.
Attorney Galligan presented Resolution No. 99-R-35, Resolution Approving Interlocal
Agreement Concerning The Participation Of The Cities Of Jeffersonville And Chaflestown And The
Town Of Utica In The INAAP Reuse Authority, explaining this is a separate agreement for the
municipalities. The Redevelopment Commission will provide the funding. Councilperson Perkins
questioned the funding formula. Deputy McCauley said the profit from the sale of property in the
T.I.F. district will be used, not tax money. Councilperson Ellis asked about the appointments to the
commission. Attorney Galligan explained tt~ is set by statute. Councilperson Perkins questioned
the reimbursement. Attorney Galligan said this should be considered an investment. The majority
of the readily developable property is in Jeffersonville Township. Councilperson Perkins said he will
support the Resolution but he does have concerns. Them is a need to get the project up and going.
He feels the City of Jeffersonville is footing 90 percent of the project. Council President Conlin made
the motion to pass Resolution No. 99-R-35, seconded by Councilperson Williams, passing on a vote
of 6-1. Councitperson Ellis voted no, stating he is not opposed to the project, he is opposed to the
last minute presentation and he would like to see the rest of the agreement.
Mayor Galligan presented Ordinance No. 99-OR-78, An Ordinance Authorizing The City Ot
Jeffersonville General Fund To Borrow Funds From The City Of Jeffersonville Sewage Fund,
explaining the need and use. Following all discussion, Councilperson Wilder made the motion to
suspend the rules for Ordinance No. 99-OR-78, seconded by Councilperson Williams, passin~
unanimously. Councilperson Wilder then made the motion to pass Ordinance No. 99-OR-78 on all

three readings, seconded by Councilperson Williams, passing unanimously.
R.esolution No. 99-R-36, A R.esolution To Initiate Special Appropriation (Local Roads and
Streets) was presented and discussed. Council President Conlin made the motion to pass R.esolution
No. 99-R-36, seconded by Councilperson Williams, passing unanimously.
Ordinance No. 99-OR-79, An Ordinance Transferring Certain Funds Within Same Department
(Vehicle Maintenance) was presented and explained. Councilperson Perkins made the motion to
suspend the rules for Ordinance No. 99-OR-79, seconded by Council President Conlin, passing
unanimously. Councilperson Perkins made the motion to pass Ordinance No. 99-OR-79 on all three
readings, seconded by Council President Conlin, passing unanimously.
Ordinance No. 99-OR-80, An Ordinance Transferring Certain Funds Within Same Department
(Motor Vehicle) was presented and explained. Councilperson Perkins made the motion to suspend
the rules for Ordinance No. 99-OR-80, seconded by Council President Conlin, passing unanimously.
Councilperson Perkins made the motion to pass Ordinance No. 99-OR-80 on all three readings,
seconded by Council President Conlin, passing unanimously.
Ordinance No. 99-OR-81, An Ordinance Amending Certain Portions Of Section 1 Of
Ordinance No. 98-OR-47 (Fire Department) was presented and explained. Council President Conlin
made the motion to suspend the rules for Ordinance No. 99-OR-81, seconded by Councilperson
Williams, passing unanimously. Council President Conlin made the motion to pass Ordinance No.
99-OR-81 on all three readings, seconded by Councilperson Williams, passing unanimously.
Ordinance No. 99-OR.-82, An Ordinance Transferring Certain Funds Within Same Department
(Fire Department) was presented and explained. Councilperson Perkins made the motion to suspend
the rules for Ordinance No. 99-OR.-82, seconded by Council President Conlin, passing unanimously.
Councilperson Perkins then made the motion to pass Ordinance No. 99-OR-82 on all three readings,
seconded by Council President Conlin, passing unanimously.
Ordinance No. 99-OR-73, An Ordinance Transferring Certain Funds Within Same Departmenl
(Common Council) was presented for the third reading. Councilperson Perkins made the motion tc
pass Ordinance No. 99-OR.-73 on the third and final reading, seconded by Councilperson Ellis.
passing on a vote of 6-1. Council President Coniin voted against passage.
Council President Conlin thanked Councilpersons Frantz, Williams, Wilder, and Perkins fe

their years of service. She thanked the police and fire department for their professional work at a
recent armed robbery. She wishes all a safe and nice holiday season. She is looking forward to 2000.
Councilperson Perldns said this is his last meeting after 16 years. He has tried to think about
the taxpayer first. He has worked hard for historic preservation, animal rights and more. He takes
pride in not missing any meetings. Councilperson Perkins named many of the 30 to 40 elected
officials he has had a chance to serve with. He has enjoyed serving and will probably serve again in
the future. He has few regrets. The only thing that he feels he should not have done was to go against
Clerk and Treasurer Spencer. He publically apologizes to Dick.
Councilperson Ellis congratulated the out-going Councilpersons. He looks forward to
working with Peggy Wilder as Clerk and Treasurer. He has learned from each and everyone.
Councilperson Ellis said it has truly been a pleasure working with Clerk and Treasurer Spencer and
he apologizes for his mistake with Clerk and Treasurer Spencer. He is pleased to know him and
considers him a friend. Councilperson Ellis considers Councilperson Perkins as close as family. He
thanks all for their help and wishes good luck to Peggy Wilder.
Councilperson Wilder has truly enjoyed the last eight years. The group has been diverse and
has not always agreed. This has been good for the City. She will miss those leaving the Council.
She is looking forward to serving as Clerk and Treasure.
Councilperson Wilson has enjoyed the last 6½ years. She wishes the best of luck to those
leaving the Council and is looking forward to those coming on. She wilt miss Dick Spencer.
Councilperson Williams said it has been and honor and privilege to serve and he says thank
you.
Councilperson Frantz says thank you. A lot of good has been done for the City. She thanks
Mayor Galligan, Attorney Galligan and most of ail Phil McCauley for their work on the pool. This
is a quality of life issue. She hopes there will be a 15 meter natatorium. She thanked Brian Dixon
for his work. Councilperson Frantz says thank you again as it has been a pleasure.
Clerk and Treasurer Spencer thanks all for what has been said. When he lost the election he
would not look at the vote total. He congratulates Peggy Wilder. Councilperson Wilder stated she
appreciates Dick making the transition easy. She will be keeping the staffin the office. Clerkand
Treasurer Spencer said his first concern was for his staff. He is sure they will be loyal to her. He has

no intention of ever running for Clerk and Treasurer. Council President Conlin said Clerk and
Treasurer Spencer will be missed.
Council President Conlin received a call that there will be an additional $50,000 for the boys
and girls club.
Mayor Galligan said he and Clerk and Treasurer Spencer have had their differences and he
commends him for working with him. He considers him a professional and he is always welcome as
he has done a lot for the City. He wishes good luck to Clerk and Treasurer Spencer. Mayor Galligan
has enjoyed working with this Council. He will miss those getting off. All have brought different
things to the table. All have tried to move the City forward. The first four years have been enjoyable
and he looks forward to the next four. He commends Deputy McCauley and others for the increase
in the assessed value. This has been a team effort. Mayor Galligan announced the ribbon cutting that
will be held Saturday morning for Amtrack. This is a big asset. As a community Jeffersonville is a
major player. He noted the Spring Street project. He is pleased to be Mayor. He invites all to a
workshop sponsored by Historic Southern Indiana, January 27 and 28 in New Harmony, Indiana.
Mayor Galligan invites the current and incoming Council to a Christmas luncheon Friday, December
17 from 11:30 - 2:00 in the Mayor's Conference Room
There being no further business to come before the Council, Councilperson Perkins made the
motion to adjourn at 8:30 P.M., seconded by Councilperson Ellis, passing unanimously.
