HomeMy WebLinkAbout05-17-2004 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA May 17, 2004 The Common Council of the City of Jeffersonville, Indiana met in regular session at River Valley Middle School, Jeffersonville, Indiana, at 1:30 P.M. on Monday, May 17, 2004. Mayor Rob Waiz, with Chief Deputy Clerk Treasurer Suzy Bass at the desk, called the meeting to order saying he was happy to be here. Also present were City Attorney Les Merkley and Deputy Clerk Barbara Hollis. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag, asking a student to lead the pledge. Members at the desk introduced themselves explaining their position. The roll was called and those present were; Councilpersons John Perkins, Ed Zastawny, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley. Absent: Councilperson Keith Fetz. Mayor Waiz introduced Police Chief Rick Ashabranner, Assistant Police Chief Mark Lovan, FOP President Jason Broady, and FOP Vice President Todd Hollis. Chief Ashabrarmer introduced Officer Robert McGhee explaining the officer had saved the life ora man. Officer McGhee was given an award by the FOP as well as an award from the City and Chief. Chief A'shabranner then explained a new Officer Of The Quarter Award he has implemented. This was presented to Officer McGhee as the first recipient. Officer McGhee expressed his thanks and appreciation for the training he has received saying anyone on the department would have done what he did. Councilperson Perkins made the motion to approve the agenda with the deletion of agenda items #10, #11, and #12, as they will be heard at the 7:30 meeting second by Councilperson Zastawny, passing on a vote of 6-0. Mayor Waiz presented the minutes of the workshop meeting of May 5, 2004 and the regular meeting of May 5, 2004 for approval. Councilperson Wilson made the motion to approve the minutes of the workshop as presented, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson Grooms asked that a correction be made on page 4 to change the Hospital Board to Clark County Health Clinic Inc. May 17, 2004 2 Councilperson Wilson then made the motion to approve the minutes of the meeting of May 5, 2004 as corrected, second by Council President McCauley, passing on a vote of 6-0. Deputy Clerk Treasurer Bass presented the claim list for consideration by the Council. Councilperson Perkins made the motion to approve the claims as presented, seconded by Councilperson Grooms passing on a vote of 6-0. DEPARTMENT HEAD REPORT: Street Commissioner Ron Ellis appeared before the Council to request the purchase of new garbage trucks. Commissioner Ellis gave the years of the macks saying the maintenance bills are high and he can no longer depend on having the trucks on the street every day. A five-year lease/purchase would cost between $2,200 and $2,700 per month. Councilperson Grooms has been requesting the cost comparison between privatization and City pick up. Commissioner Ellis has received only one response for privatization. Council President McCauley said the Council owes it to the public and to themselves to look into the cost differences. Commissioner Ellis reminded the Council the Sanitation Department provides multiple services. Councilperson Perkins said he has been on the Council when the city went from public to private and back to public. There is a significant cost to go from private back to public. Mayor Waiz asked Commissioner Ellis to come back to the meeting scheduled for June 7, 2004. PUBLIC COMMENT: There was no public comment. AGENDA ITEMS: Councilperson Grooms introduced Resolution No. 2004-R-17, A Resolution Regarding Contribution By City Council, explaining this makes good business sense. Councilperson Perkins has a concern for emergencies, extraordinary events or catastrophes. Councilperson Grooms is willing to add such a provision. Attorney Merkley suggests inserting a provision to suspend by 2/3 vote. Councilperson Grooms agrees. Council President McCauley would prefer a $2,000 unrestricted amount. Following discussion, Councilperson Grooms made the motion to add an amendment allowing for emergencies by 2/3 vote of the Council, second by Councilperson Perkins. May 17, 2004 3 Councilperson Grooms then made the motion to pass Resolution No. 2004-R-17 as amended, seconded by Councilperson Perkins, passing on a vote of 6-0. Councilperson Perkins presented a list of changes for Ordinance No. 2004-OR-22, An Ordinance Regulating Newsracks, making the motion to pass Ordinance No. 2004- OR-22 as amended on the second reading, second by Councilperson Wilson, passing on a vote of 6-0. Attorney Merkley explained Ordinance No. 2004-OR-25, An Ordinance Amending 88-OR-16 (Regulating The Disposition Of Abandoned Vehicles). Following questions and discussion, Councilperson Perkins made the motion to pass Ordinance No. 2004-OR-25 on the second and third readings, second by Councilperson Sellers, passing on a vote of 6-0. Attorney Merkley explained Resolution No. 2004-R-18, A Resolution Approving Department of Redevelopment Resolution 2004-2. Councilperson Perkins made the motion to pass Ordinance No. 2004-R-18, second by Council President McCauley. Attorney Merkley explained the need and the procedure. Councilperson Zastawny explained the difference in a TIF district is the taxes collected go back into the district. The motion to pass Resolution No. 2004-R-18 passed on a vote of 6-0. COUNCIL AND MAYOR COMMENTS: Councilperson Perkins said it was nice to be back in a middle school and complimented the students on being well behaved. Councilperson Zastawny said the abandoned vehicle and trash ordinances go along way to beautify the city. Councilperson Sellers announced the new Storm Water Advisory Board will be meeting once a month. Councilperson Wilson said the Parks Board has been very active as the pool is getting ready to open. She has enjoyed the students. Councilperson Grooms noted the manner of conduct of the students is something to be proud of. Councilperson Grooms had two daughters attend River Valley so being here today is like coming back home. He thanked the students for coming. May 17, 2004 4 Council President McCauley encouraged the students to take an active interest in the community. He recently attended an NAACP meeting where it was noted there are no ethnic minorities on the Council for the first time in a long time. Mayor Waiz announced Veteran's Parkway is now open. He also announced the Beautification Committee is working on Court Avenue and 165. Mayor Waiz said the students have been an excellent audience. He thanked the administration and the faculty. Mayor Rob Waiz, with Deputy Clerk Treasurer Barbara Hollis at the desk, called the meeting to order. Also present was City Attorney Les Merkley. Mayor Waiz welcomed all in attendance, asking all those present to stand as Councilperson Perkins gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons John Perkins, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Phil McCauley. Absent: None Councilperson Grooms made the motion to approve the agenda to include agenda items #10, #11, #12, and #18, second by Councilperson Sellers, passing on a vote of 7-0. PUBLIC COMMENT: There was no public comment. AGENDA ITEMS: Ms. Camie Stahl appeared before the Council to request passage of Ordinance No. 2004-OR-27, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being A Certain Tract Of Property With The Address Of 5710 I/2 Hamburg Pike From RI: Small To Medium Scale General Commercial. Ms. Stahl explained the area is surrounded by commercial property. The request did receive approval from the plan commission and zoning board. At this time the public was asked to comment. There was no public comment regarding this matter. Councilperson Perkins made the motion to pass Ordinance No. 2004-OR-27, second by Council President McCauley, passing on a vote of 7-0. May17,2004 2 Ms. Julie McCoy appeared before the Council to request passage of Ordinance No. 2004-OR-28, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being A Certain Tract Of Property Located In Survey 21 Of The Illinois Grant Containing 3.579 Acres With The Address Of 2326 Charlestown New Albany Pike From IS: Institutional To CI: Small To Medium Scale General Commemial. Ms. McCoy explained the need. At this time the public was asked to comment. There were no public comments. Council President McCauley made the motion to pass Ordinance No. 2004-OR-28, second by Councilperson Fetz, passing on a vote of 7-0. Mr. Greg Filer, Attorney representing Realty Equities, LLC, appeared before the Council to request passage of Ordinance No. 2004-OR-29, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being All Of Lots 56, 57, And 58 And Part Of Lots 54, 55 And 59 In The City of Jeffersonville From M2; Multifamily Residential To PD-M2; Planned Development Multifamily Residential. Attorney Fifer and Mr. Hal Kovert presented drawings and explained the project. The group will be seeking a vacation of Wall Street Between Market and Riverside during construction. There will be a commercial association for levels 1 and 2 and a residential association for levels 3 thru 10. The existing scrap steel and other components from the building should be razed by early June. The group is committed to starting construction this summer. The Plan Commission gave unanimous approval. Council President McCauley asked if this project would be in competition with cm/ent business in the area. Attorney Filer said there would not. Council President McCauley said he would like to see financing in place before construction starts. Attorney Fifer said he would be glad to do that. Councilperson Grooms asked if the building would be done in phases. Attorney Fifer said it would not; the exterior will be finished. Attorney Fifer said the group would work with all local boards and associations. At this time the public was asked for comment. Ms. Peggy Hardaway said she hopes the Council considers future projects and the value later on. She does not want to see this project happen. It is a big change for Jeffersonville. There being no further comments, Councilperson Perkins made the motion to pass Ordinance No. 2004-OR-29, second by Councilperson Fetz, passing on a vote of 7-0. May 17, 2004 3 COUNCIL AND MAYOR COMMENTS: Councilperson Perkins noted this was a wonderful day for government as the Council had conducted a meeting at River Valley Middle School. The students were great and it was a pleasure to be there. Councilperson Zastawny was asked when the Council is going to Parkview. Councilperson Fetz said the Police Chief and Fire Chief are anxious to start contract negotiations. Councilpersons Fetz, McCauley, and Zastawny will represent the Council. Council President McCauley said he has talked with Fire Chief Miles and has his O.K. to work on the Police contract first. Councilperson Wilson reminds everyone to come to the Concerts in the Park. Councilperson Grooms has some information fi-om Street Commissioner Ellis he will get to the Council. Council President McCauley has received 4 applications for Council Attorney. May 21st is the deadline. The budget will be presented to the Council by June 15. Council President McCauley noted there are no ethnic minorities on the Council. There is a need for input and representation and he urges the Council to be sensitive. Mayor Waiz announced May 22, 2004 would be Clean Sweep Day. There will be an executive meeting of the Council June 7, 2004 at 6:30 to discuss pending litigation.
