COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
NOVEIVIBER 1, 1999
The Common Counc'fl of the City of Jeffersonville met in regular session in the Multi-Purpose
Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 1st day of
November, 1999.
The meeting was called to order by Mayor Thomas R. Gailigan, with Clerk and Treasurer C.
Richard Spencer Jr. at the desk. Mayor Galligan welcomed all in attendance, asking all those present
to stand as Councilperson Ellis gave the invocation. Mayor Galligan asked all those present to join
him in the pledge of allegiance to the flag.
The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna
M. Frantz, Peggy Knight Wilder, Barbara W'flson, and Vicki Conlin.
Absent: Andrew Williams III.
Mayor Galligan presented the minutes of the meeting of October 18, 1999 for consideration
by the Cotmc'fl. Counc'flperson Ellis made the motion to approve the minutes as presented, seconded
by Council President Conlin and carried unanimously.

Clerk and Treasurer Spencer presented the dalm list for consideration by the Council
explaining additional claims. Following all discussion, Council President Conlin made the motion t(
approve the claims as presented as well as the additional, seconded by Councilperson Wilder, passing
unanimously.
City Attorney Anne Made Galligan noted the request for an ordinance changing the zoning
map designation of a certain tract of property being part of lot No. 22 from R-2 to B-I has been
withdrawn for this meeting. An Ordinance limiting council members abstention from voting has also
been withdrawn.
Ms. Pat Lowexy appeared before the Council requesting a traffic signal at the intersection of
Holman's Lane and Charlestown New Albany Pike. Mayor Galligan explained the problem will be
taken care of in the construction of the innercity road. This will be in the next year to 18 months.
Ms. Debbie Frazier a resident of Cardinal Lane asked why the land was being cleared between

French Quarter and Mellwood. Mayor Galligan said he had no idea. There has been no rezoning and
he will not let anything happen that will cause further drainage problems.
Attorney Galligan presented Resolution No. 99-R-33, A Resolution Approving Sale Of Real
Estate With A Value Over $50,000.00, explaining railroad office property has been taken by the State
for 165 expansion. Following discussion, Councilperson Perkins made the motion to pass Resolution
99-R-33 with the understanding the proceeds from the sale will go into the Animal Shelter Buildin
and Capital Improvement Fund, seconded by Councilperson Frantz, passing unanimously.
Councllperson Wilson read aloud a request from Waymon Payne for financial assistance fc
the Eastbrook Subdivision Christmas program. Councilperson Wilson made the motion to donate
$300 from the Council Promotion Fund, seconded by CouncilpersonPerkins. Councilperson Frantz
has received requests for street lights in Eastbrook. Mayor Galligan is getting prices. Council
President Conlin would like input from other subdivision residents. Councilperson Wilder said the
subdivision is open to all residents of Jeffersonville. Councilperson Perkins said when neighborhoods
pull together for a project it is good for the City to be supportive. Council President Conlin and
Councilperson Frantz are concerned for other subdivisions. The motion passed unanimously.
Ordinance No. 99-OR-64, An Ordinance Changing The Zoning Map Designation Of A
Certain Tract Of Property Being Part Of Survey No. 11 From R-2 To B-1 was introduced for
consideration. This is a request from the home owners who will be selling the property to be used
as an accounting business. Councilperson Ellis explained the request had unanimous approval at the
Plan Commission. Councilperson Perkins made the motion to suspend the rules for Ordinance No.
99-OR-64, seconded by Councilperson Ellis passing unanimously. Councilperson Perkins then made
the motion to pass Ordinance No. 99-OR-64 on all three readings, seconded by Councilperson
Williams, passing unanimously.
Mr. Mike Gillenwater, Attorney representing BWT Development, LLC, appeared before the
Council to request passage of Ordinance No: 99-OR-64, An Ordinance Changing The Zoning Map
Designation OrA Certain Tract Of Property From R,2 To Planned Unit Development. Attorney
Gillenwater explained the area and the Plans. Councilperson Ellis said the drainage board has given
the development conditions. As there were many questions, Council President Conlin suggested a
workshop to go over all questions. Mayor Galligan expressed the need for a sidewalk on

JeflTCharlestown Pike. Following all comments and questions Councilperson Ellis made the motion
to table Ordinance No. 99-OR-64, seconded by Council President Coniin, passing unanimously.
There will be a workshop November 15 at 5:00 P.M.
Ordinance No. 99-OR-65, An Ordinance Transferring Certain Funds Within Same Department
(Animal Shelter) was presented for consideration. Councilperson Perkins made the motion to
suspend the rules for Ordinance No. 99-OR-65, seconded by Council President Conlin, passing
unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 99-OR-65 on all
three readings, seconded by Council President Conlin, passing unanimously.
Council President Conlin has received a request for the annual donation for the Jeff Clark
Preservation Christmas Home Tour. She has also received a request from the Louisville Orchestra
for a donation of $2,500. Councilperson Frantz stated she would rather support her own community.
Mayor Galligan said this request has to do with the Martin Luther King Jr. celebration and if
Jeffersonville wants a relationship with the arts there is a need to show good faith. He further stated
if Ieffersonville wants to build an amphitheater there is a need to build a relationship. He suggests
all look at the overall picture. This will be discussed at the workshop. CounCilperson Frantz said
Thunder is an example of Jeffersonville giving. She would like comments from the local Martin
Luther King Jr. committee. Mayor Galligan will made the contact.
Councilperson Perkins said the new street lights on Spring Street are nice. Councilperson
Perkins asked the Quadrangle Ordinance be put back on the agenda for the November 15 meeting.
Attorney Galligan explained an additional 90 days has been given by the Judge. Councilperson
Perkins questions the ability of a Judge to give an order to a Council not to pass an Ordinance.
Councilperson Ellis wishes all candidates the best of luck on election day.
Mayor Galligan met recently with J. Reid Williams of Historic Landmarks Foundation of
Indiana, who said the revitalization of downtown was faster than any Main Street project he has seen.
He also toured the Quadrangle and offered ideas about revenue sources. Mayor Galligan expressed
the need for all to get out and vote, and wishes all good luck.

motion to adjourn at 8:15 P.M., seconded by Council President Conlin, passing unanimously.
