COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
SEPTEMBER 20, 1999
The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose
Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 20th day of
September, 1999.
The meeting was called to order by Mayor Thomas R. Galligan, with Clerk Barbara Hollis
at the desk. Mayor Gailigan welcomed ail in attendance, asking all those present to stand as
Councilperson Williams gave the invocation. Mayor Galligan asked all those present to join him in
the pledge of ailegiance to the flag.
The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna
M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicki Conlin.
Absent: None.
Clerk Hollis presented the claim list for consideration by the Council. Following all
discussion, Council President Conlin made the motion to approve the claims as presented, seconded
by Councilperson Wilson, passing unanimously.
Mr. Mark Dobbins, Attorney representing Tri-Tel and Sprint, appeared before the Council
expressing his thanks to the Plan Commission, the Council, and the Mayor for working with the
telecommunications people with regard to the cell tower ordinance. Mr. Dobbins listed areas of
concern and the reasons for the concerns. These concerns include maximum height limits, wind load
requirements, set backs, and the ban in the historic district. He thanks all for their flexibility.
Mr. Harold Dilman, Attorney, appreciates the opportunity to speak. He would ditto what Mr.
Dobbins has said.
Attorney Gailigan presented Ordinance No. 99-OR-52, An Ordinance Amending Certain
Portions Of Section t Of Ordinance No. 99-OR-49 for thethird reading. Councilperson Frantz made
the motion to pass Ordinance No. 99-OR-52 on the third and final reading, seconded by Council
President Coffiin, passing on a vote of 5-2. Councilpersons Perkins and Ellis voted in opposition.

Attorney Galligan presented Ordinance No. 99-OR-53, An Ordinance Transferring Certain
Funds Within Same Department (Common Council) for the third reading. Council President Coniin
made the motion to pass Ordinance No. 99-OR-53 on the third and final reading, seconded by
Councilperson Williams, passing on a vote of 4-3. Councilpersuns Perkins, Ellis, and Wilson voted
nay.
Ordinance No. 99-OR-54A, An Ordinance Amending Certain Portions Of Section 1 Of
Ordinance No. 98-OR-47 (Sewage Department) was presented for consideration. It was explained
the object is to have three people trained in the collection office when Manager Bob Goldman retires
at the end of the year. Council President Conlin made the motion to pass Ordinance No. 99-OR-54A
on the first and second readings, seconded by Councilperson Williams, passing on a vote of 5-2 with
Councilpersons Perkins and Ellis voting nay.
Ordinance No. 99-0R-55, An Ordinance Amending Certain Portions Of Section 1 Of
Ordinance No. 99-OR-49 (Sewage Department) was presented for consideration. Council President
Conlin made the motion to pass Ordinance No. 99-OR-55 on the first and second readings, seconded
by Councilpersun Wilder, passing on a vote of 5-2 with Councilpersons Perkins and Ellis voting nay.
Ms. Jana Ecker, Director of Planning and Zoning, presented Ordinance No. 99-OR-45, An
Ordinance Amending The Jeffersonville Zoning Code RE: Telecommunications Towers, addressing
previous comments and reviewing the revisions. The Plan Commission has unanimously
recommended this for adoption by the City Council. Councilperson Perkins made the motion to pass
Ordinance No. 99-OR-45 as amended on the second and third reading, seconded by Council President
Conlin, passing unanimously.
Ordinance No. 99-OR-54, An Ordinance Of Appropriations And Tax Rates was presented
as advertised. Public comment was requested. Ms. Nellie Knowland said if this will result in higher
taxes, she feels it is wrong. Mayor Galligan said the State Legislature is working on a way ~o make
t~g more equitable. Ms. Knowland feels all residents are not treated the same as her area does not
have sidewalks, curbs, and gutters. Councilperson Wilder explained different areas use different
services and at this time there is no better way. Mr. Jeremy Snelling questioned a project started
months ago that is still n0,,t comp!~te. (~Center.and Lo. ui~ Str~...e$.). He qu~igns why the contractor

Council President Conlin presented and explained changes to the Council budget and the creation of
a Board of Public Works department budget. Councilperson Perkins questions why this is presented
at 7:50 P.M. onthe final reading. He feels it is the Council's responsibility to handle the fiscal areas
and this gives the authority to the Mayor. Attorney Galligan explained the Council does not spend,
it only appropriates. There is a separate authority set out by the State Board of Accounts for the
Board of Public Works. The only difference is who signs the claims. The claims will be on the claims
list every meeting. Councilperson Perkins asks why make the change if the Council appropriates and
approves the claims. He does not think it fair to shirr hundreds of thousands of dollars at the last
minute. Attorney Galligan again stated the only change is who signs the claims. Councilperson
Williams made the motion to amend Ordinance No. 99-OR-54 to change the categories as discussed,
seconded by Councilperson Wilder, passing on the following roll call vote:
Ayes: Councilpersons Conlin, Wilder, Williams, and Frantz.
Nays: Councilpersons Perkins, Ellis, and Wilson.
Councilperson Williams then made the motion to pass Ordinance No. 99-OR-54 as amended,
seconded by Councilperson Wilder, passing on the following roll call vote:
Ayes: Councilpersons Conlin, Wilder, Williams, and Frantz.
Nays: Councilpersons Perkins, Ellis, and Wilson.
Council President Conlin reported on a workshop she attended at the Indiana Association of
Cities and Towns conference regarding community involvement. The whole concept is to get the
wold community involved. It is hoped to get Jeffersonville representatives on a site selection
committee for future conferences.
Councilperson Williams suggests amending the sidewalk construction ordinance funding
mechanism. He would like to see the sidewalk and driveway prol-~'ams work the same. This will be
reviewed.
Mayor Galligan reported on a workshop he attended during the IACT conference put on by
IDEM and EPA. He warns all to "fasten seatbelts" with regard to new regulations for storm and
sanitary sewers. This is getting very technical. Regulations will be confing down hard. No funding

Councilperson Ellis said Liter's Quarry is still trashing one half mile of streets. The residents
are definitely suffering.
Mayor Galligan said the police are on top of the recent shooting at the Ken Ellis Center and
the fire by arson. People need to stay away from guns and they need to stand up and report.
There being no further business to come before the Council, Councilperson Perkins made the
motion to adjourn at 8:20 P.M., seconded by Councilperson Williams, passing unanimously.
