HomeMy WebLinkAbout09-07-99COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA SEPTEMBER 7, 1999 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 7th day of September, 1999. The meeting was called to order by Mayor Thomas R. Galligan, with Deputy Clerk Barbara Hollis at the desk. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Williams gave the invocation. Mayor Galligan asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicki Conlin. Absent: None. Mayor Galligan presented the minutes of the meetings of August 16, and August 18, 1999 for consideration by the Council. Councilperson Perkins made the motion to approve the minutes for August 16 as presented, seconded by Councilperson Williams and carried unanimously. With regard to the minutes of August 18, 1999, Councilperson Ellis would like to have his vote to remain as a vote to abstain. Attorney Galligan said the situation is clear in the minutes. Councilperson Ellis read a statement he received from Indiana Association of Cities and Towns: Attorney Galligan replied there are grounds for which the ordinance passed. The first is that Councilperson Ellis said no first, and the second is that Councilperson Ellis stated he was against the ordinance. Councilperson Perkins read from page 403 and 399 of the 9~h edition of Robert's Rules of'Order, giving his interpret ation. At the conclusion of all discussion Attorney Galligan stated the ordinance can be contested. Councilperson Frantz made the motion to approve the minutes for the meeting of August 18, 1999 as presented, seconded by Councilperson Wilder. A roll call vote was taken as follows: Ayes: Councilpersons Frantz, Williams, and Wilder. Nays: Councilpersons Wilson, Ellis, and Perkins. Abstain: Councilperson Conlin. September 7, 1999 Page 2 of 4 Mayor Galligan cast his vote in favor of approving the minutes of the meeting of August 18, 999 as presented. Councilperson Perkins questioned how this can be correct if the Historic District Ordinance was ruled as passing on the first and second reading? Attorney Galligan gave her opinion. Clerk Hollis presented the claim list for consideration by the Council, explaining two additional claims. Councilperson Wilson questioned the cost of a truck from the Riverfront Development Fund. Mayor Galligan explained the truck will be used on the fiverfront as the car that was being used fell apart. Following all discussion, Council President Conlin made the motion to approve the claims as presented as well as the additional, seconded by Councilperson Williams, passing on a vote of 6-1. Councilperson Ellis voted against passage. Mr. Charles Kenneth White stated he is sorry that Jeffersonville is not north of Indianapolis. Mr. White said a comment was made previously that nobody can understand Robert's Rules of Order. He would like to know why it is brought up now, all should accept the vote and move on. Mr. Doug Carden inquired when the street lights would be put up on Spring Street. Mayor Galligan said it would be in the next four weeks. As soon as the lights are received they will be put up. Mr. Carden questioned why the contract for Spring Street ~vould allow for the street to be dark. He has a business on Spring Street and fears for customer's safety after dark. Mr. Carden would like the City to watch for loopholes when contracting. He does appreciate the effort for improvements and feels it will be good for Jeffersonville. Mayor Galligan will see if something can be done as soon as possible. Ms. Anne M. Charbonneau of the Jeffersonville Police Department appeared before the Council asking for donations for a memorial/charity softball game the Jeffersonville Police Department is hosting. Following all discussion, Councilperson Wilson made the motion to donate $250 from the Council promotion fund, seconded by Councilperson Perkins passing unanimously. Ordinance No. 99-OR-51, An Ordinance Transferring Certain Funds Within Same Department (Motor Vehicle) was presented for consideration. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 99-OR-51, seconded by Councilperson Williams, passing un,,,a~,mq,u~ly. September 7, 1999 Page 3 of 4 Attorney Galligan presented Ordinance No. 99-OR-52, An Ordinance Amending Certain Portions Of Section 1 Of Ordinance No. 99-OR-49 (Sewage DePartment), explaining the need for passage. This ordinance has to do with the Sewage work crew. Discussion followed regarding some of the projects that are under construction and areas of funding. At the conclusion of all discussion, Councilperson Williams made the motion to suspend the rules for Ordinance No. 99-OR-52, seconded by Councilperson Frantz, failing on a vote of 6-1. Councilperson Perkins voted nay. Councilperson Williams then made the motion to pass Ordinance No. 99-OR-52 on the first and second readings, seconded by Councilperson Frantz, passing unanimously, It was announced this meeting has been advertised as a public hearing on the budget for 2000. The budget as presented reflects a tax rate of $4.65. Final passage will be considered at the September 20, 1999 meeting as advertised. Council President Contin read aloud Resolution No. 99- R-28, A Resolution Stating Various Monies Not Be Spent For The Entire Budget Year 1999. Councilperson Frantz made the motion to pass Resolution No. 99-R-28, seconded by Councilperson Williams, passing on a vote of 4-3. Councilpersons Perkins, Ellis, and Wilson voted against passage. Ordinance No. 99-OR-53, An Ordinance Transferring Certain Funds Within Same Department (Common Council) was presented. Council President Conlin explained the amount of money in the 1999 budget for insurance would have paid the 1998 claim, hoWever the 1999 claim is considerably higher. Council President Conlin made the motion to suspend the rules for Ordinance No. 99-OR- 53, seconded by Councilperson Williams, failing on a vote of 5-2. Councilperson Perkins and Ellis voted nay. Council President Conlin made the motion to pass Ordinance No. 99-OR-53 on the first and second readings, seconded by Councilperson Williams. Councilperson Wilson stated a promise was made to the people the City would not use the $300,000 b.udgeted for water, and that amount would be used to lower the tax rate. This promise has to be kept. Councilperson Wilder stated her concern for the taxpayer but knows this must be paid and this solution would have no different end result than an additional appropriation. Attorney Galligan said the City has been lucky for the last three years with the insurance premiums. Councilperson Perkins agrees with Councilpersons Wilson and Wilder. It is only a matter of taking the payment from the left pocket or the right pocket. September 7, 1999 Page 4 of 4 Council President Conlin asked for comments on Ordinance No. 99-OR-54, An Ordinance Of Appropriations And Tax Rates. No public comments were voiced. The subject of a workshop regarding the budget was discussed. Councilperson Wilson has some questions as she sees some things that she feels are not necessary. Council President Conlin suggests those having questions should get with Deputy Mayor McCauley or the Department Head. Mayor Galligan was of the understanding the Council would approve the budget at a rate of $4.65. Council President Conlin made the motion to pass Ordinance No. 99-OR-54 on the first and second readings, seconded by Councilperson Frantz. Councilpersons Contin, Wilder, Williams, and Frantz vote yes, Councilpersons Wilson and Perkins vote no, and Councilperson Ellis votes present. There will be a budget workshop on Monday, September 20, 1999 at 5:30 P.M., with the regular meeting at 7:00 P.M. Councilperson Wilson said the groundbreaking was very nice. Councilperson Perkins inquired about the paving of the 900 block alley between East Court and East Maple. Attorney Galligan announced a special Plan Commission meeting will be held Thursday, September 16 on the cell tower ordinance. Comments were made and discussion held regarding cell towers. Mayor Galligan reported on the groundbreaking by the Barrester Group. He also reported Rocky's is coming along and it is hoped they will be open by Thanksgiving. Traffic problems were reviewed. It has been tough with the growth keeping up with traffic and Jeffersonville does not have the infrastructure to handle the growth. This is being worked on. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 8:20 P.M., seconded b~_~u~William~ ~yly. I am asking for each council person and the City of Jeffersonville for donations for a memorial/charity softball game that the Jeffersonville Police Dept. is hosting. The game will be Jeffersonville Police and othez city employees VS. Clark County Juvenile Detention and other county employees. In memory of Russ Bush, who was a supervisor at the detention center and a dear friend to the police department. The charity is the Dream Factory, an organization to grant dreams for terminally ill children.
