HomeMy WebLinkAbout05-03-99COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA MAY 3, 1999 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the CityrCounty Building, Jeffersonville, Indiana, at 7:00 P.M. on the 3rd day of May, 1999. The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer C. Richard Spencer Jr. at the desk. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Williams gave the invocation. Mayor Galligan asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Wiliiams III, and Vicki Conlin. Absent: None. Mayor Galligan presented the minutes ofthemeeting of April 19, 1999 for consideration by the Cound!. Councilperson Perkins made the motion to approve the minutes as presented, seconded by Council President Conlin and carded unanimously. Clerk and Treasurer Spencer presented the claim list for consideration by the Council, explaining additional claims. Following all discussion, Council President Conlin made the motion to approve the claims as presented as well as the additional, seconded by Councilperson Williams, passing unanimously. Ms. Nellie Knowland wished all good luck on election day. Ms. Knowland gave thanks for the paving in her area. She is upset with some of the Department Heads for not following through with their promises to come back and complete the job. She has experienced water in her basement. Council President conlin presented the contract with the Fraternal Order of Police, asking Deputy Mayor Phil McCauley to explain the contract. Deputy McCauley explained the process and the major changes in this contract. He explained the changes in rank, holiday and clothing pay. The increase in pay is 41/2°/o for 2000 and 4% for 2001. Deputy McCauley then explained the reductions which include vacation reductions, 10% less than base pay for a first year patrolman, and 5% less for a second year patrolman. Also, court pay will be included with base pay. He commends the Police May 3, 1999 Page 2 of 4 for their cooperation and understanding the financial position of the City. This contract will have an impact on the budget of approximately $. I 1 per $1,000 of assessed value. It will help to have a more experienced force. He does believe the City will benefit from the contract numbers. He is pleased overall with the cooperation, and feels the three year contract is reasonable. Councilperson Williams asked what the total assessed value the $. 11 increase is based on. Deputy McCauley said is was based on a value of $210,000,000. Council President Conlin thanked Mr. Helms, Officer Jason Broady, Officer John Carter and Deputy Mayor Phil McCauley for their hours of work saying it was an education. Officer Broady thanked the Council for their work. Council President Coniin made the motion to suspend the rules for Ordinance No. 99-OR-18, An Ordinance Approving Fraternal Order Of Police Contract With The City Of Jeffersonville, Indiana, seconded by Councilperson Perkins, failing on a vote of 6-1. Councilperson Frantz voted against suspension. Council President Conlin then made the motion to pass Ordinance No. 99-OR-18 on the first and second reading, seconded by Counc'tlpersons Perkins and Ellis, passing on a vote of 6-1. Councilperson Frantz voted nay. Counc'zl President Conlin announced the meeting scheduled for May 17, will be rescheduled for Tuesday, May 25 at 6:00 P.M. City Attorney Anne Made Galligan presented and explained Ordinance No. 99-OR-19, An Ordinance Transferring Certain Funds Within Same Department (City Attorney). She also explained the need for the category. Counc'flperson Perkins made the motion to suspend the rules for Ordinance No. 99-OR-19, seconded by Coundl President Coniin, passing unanimously. Councilperson Perkins then made the motion to pass Ord'mance No. 99-OR-19, seconded by Councilperson Wilson, pass'rog unanimously. Attorney Galligan presented Ordinance No. 99-OR-20, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Located At Waverley Park Subdivision, Lots 65, 66 & 67 From R-1 to R-2. Attorney Galligan explained the area stating the Plan Commission did not give a favorable recommendation. Councilperson Perkins made the motion to pass Ordinance No. 99-OR-20 on the first reading, seconded by Coun¢ilperson Wilder. Councilperson Perkins stated his intention is to bring it to a vote and vote against passage. Councilperson Wilder explained she made the second with the intention of voting against passage as it is not a good situation. The motion to May 3, 1999 Page 3 of 4 pass Ordinance No. 99-OR-20 onthefirst reading failed on a vote of0-6-1. CouncilPresident Conlin abstained. Attorney Galligan presented Ordinance No. 99-OR-21, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Block 150 From R-2 To B-1. Councilperson Ellis explained this is the proposed Community Center property location only and does not include any adjoining property. Attorney Galligan explained there is no zoning classification for recreation in the current zoning ordinance. There will be a recreation classification in the new zoning ordinance. Councilperson Ellis made the motion to suspend the rules for Ordinance No. 99-OR-21, seconded by Councilperson Williams, passing unanimously. Councilperson Ellis then made the motion to pass Ordinance No. 99-OR-21 on all three readings, seconded by Council President Conlin, passing unanimously. Attorney Galligan presented Ordinance No. 99-OR-22, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Survey #22 From R-2 To B-3. No objections have been received and the Plan Commission gave a favorable recommendation. Mr. John Lobb, Developer of the area explained the area is SUrrounded by B-3 and is not a good residential area. Mayor Galligan said the developer is receptive to ideas. Councilperson Ellis made the motion to suspend the rules for Ordinance No. 99-OR-22, seconded by Councilperson Wilson, passing unanimously. Councilperson Ellis then made the motion to pass Ordinance No. 99-OR-22 on all three readings, seconded by Councilperson Wilson, passing unanimously. Ordinance No. 99-OR-23, An Ordinance Transferring Funds Within Same Department (Cumulative Capital Development) was presented for consideration. Clerk and Treasurer Spencer explained the need for the transfer. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 99-OR-23, seconded by Council President Conlin, passing unanimously. Councilperson Perkins made the motion to pass Ordinance No. 99-OR-23 on all three readings, seconded by Council President Conlin, passing unanimously. Councilperson Ellis wishes all good luck in the election. Councilperson Wilder voiced the concerns of the Safety Director for financial planning for the hepatitis testing for effectiveness. She suggest transferring funds from Council travel. This will be discussed at the next workshop. May 3, 1999 Council President Conlin wishes all good luck. Mayor Galligan said Hamburg Pike was paved today. Page 4 of 4 It is hoped to get more paving this week. Mayor Galligan said good luck to all, and "get out and vote". There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 7:40 P.M., seconded by Council President Conlin, pass'rog unanimously.
