WHEREAS, the transportation and disposal of litter, trash and paper refuse has created an unusual and annoying problem to most cities and towns, and including the City of Jeffersonville, WHEREAS, many vehciles used for the purpose of transporting such litter, trash and paper refuse are of the open type, which permits a portion of the load to be blown out of and off of the vehicle while the same is moving along and across the city streets and, WHEREAS, such portion leaving the vehicle is then propelled by the wind and comes to rest along the curbs and gutters and on the lawns and yards of abutting property owners, and WHEREAS, such rubbish so deposited is unsightly, costly to remove and generally detrimental to the city and the citizens thereof. NOW, THEREFORE, in order to alleviate and correct the condition hereinabove set out, it is ordained by the Common Council of the City of Jeffersonville: Section 1. That all trucks used by any person, firm or corporation for the purpose of transporting litter, trash or paper refuse overl aiong!i!~nd across the streets of the city shall either be of the closed type or shall be so covered by tarpaulin, or other manner or material, that no portion of the load being carried or transported shall blow out, fall out, leak or in any manner come to rest on the street, sidewalk, curb, gutter or ajoining property. Section 2. Be it further ordained that all persons, firms or corporations engaged in an activity or business that by its nature tends to create an excessive amount of litter, trash and paper refuse, shall provide ample containers in a sufficient number to properly hold such trash secure until same is removed, and those persons, firms or corporations engaged in a retail business that sells his or its product in a throw-away container, be'it paper, cardboard, plastic or other material, shall provide a sufficient number of trash containers, strategically located as to encourage and induce his or its customers to use same. Section 3. Be it further ordained that no person shall throw, drop or deposit any trash, litter or other refuse on any street, sidewalk, curb, or alley within the city except into a proper container provided for that purpose. Section 4. Any person, firm or corporation violating any of the provisions of sections one, two or three hereof shall be fined not less than ten dollars ($10.00) nor more than fifty dollars ($50.00), and each day shall be considered a separate offense in the event that such violation is a continuing one. Section 5. This ordinance shall be in full force and effect after its final passage by the council, approval by the Mayor and its legal publication.
